CITY OF AVENAL SPECIAL JOINT MEETING OF THE AVENAL CITY COUNCIL/SUCCESSOR AGENCY TUESDAY, NOVEMBER 26, 2019; 4:30 P.M. CITY HALL; 919 SKYLINE BLVD., AVENAL, CA 93204 MINUTES Mayor Pro called the meeting to order at 4:31 p.m. Council Members Absent: Mayor Ovalle. Staff Present: Whitten, Perkins. ROLL CALL: Councilman Hernandez, Councilman Harvick, Mayor Pro Tem Woolley, Councilman Preciado joined the meeting at 4:04 p.m. CITY CLERK: Government Code Section 54952.3: The members of the City Council and Successor Agency are entitled to receive a total of $300.00 per month because of being elected to the City Council. They receive no other compensation for sitting as a member of the Successor Agency. PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULED APPEARANCES: None. The Council went into Closed Session at 4:32 p.m. CLOSED SESSION: It is the intent of this governing body to meet in closed session to review its position and to instruct its designated representative: A. POTENTIAL/PENDING LITIGATION (Government Code § 54956.9). It is the intention of this governing body to meet in closed-session concerning: Conference with legal counsel – Deciding whether basis exists for closed-session for anticipated litigation (Government Code § 54956.9(d)(3)). Number of potential cases is: 1. Mayor Pro Tem Woolley re-opened meeting at 4:37 p.m. with no action to report. NEW BUSINESS: A. Consider Purchase of City of Avenal 2019 Surplus Water by Westlands Water District: Ms. Whitten went over the Staff Report regarding the Purchase of City of Avenal 2019 Surplus Water by Westlands Water District. After a brief discussion, following action was taken. RESOLUTION 2019-58: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL ENTERING INTO A WATER TRANSFER AGREEMENT BETWEEN THE CITY OF AVENAL AND WESTLANDS WATER DISTRICT AND FINDING NO SIGNIFICANT ENVIRONMENTAL IMPACT(S) DUE TO THE TRANSFER; AND, FURTHER, AUTHORIZE THE CITY MANAGER TO SIGN AND EXECUTE AGREEMENT INCLUDING ANY OTHER RELATED TRANSFER DOCUMENTS AS NEEDED/REQUIRED ON BEHALF OF THE CITY. A motion was made by Councilman Preciado, seconded by Councilman Hernandez and carried. Roll Call Vote: AYES: Harvick, Hernandez, Preciado, Woolley. Special Joint Meeting City Council/Successor Agency November 26, 2019 Page 2 of 2 NOES: None. ABSTAIN: None. ABSENT: Ovalle. CORRESPONDENCE/ANNOUNCEMENTS/CLOSING COMMENTS: Councilman Harvick stated that there are dumpsters on the sidewalk at 5th Avenue by Avenal High School. Councilman Hernandez reported the following: 1) he thanked everyone that helped with Operation Gobble which was very successful and wished everyone Happy Thanksgiving. Councilman Preciado reported the following: 1) he asked about study sessions regarding transportation and marijuana for the next meeting. Ms. Whitten mentioned that Senator Melissa Hurtado and Alicia Ramirez (Salas Office) were present at Operation Gobble and Jose Ramirez was not. ADJOURNMENT.
