MINUTES The Minutes from the April 25, 2022, Board of Aldermen meeting were submitted for approval. Alderman Fleming requested an amendment to his comments under “Aldermanic Comments”; he requested that “because it is something he enjoys” be removed. A motion was made by Alderman Fleming and seconded by Alderman Roach to accept the amendment. A voice vote was taken with unanimous affirmative result and the motion passed. A motion was made by Alderman Fleming and seconded by Alderman Finley to approve the minutes from the April 25, 2022 Board of Aldermen meeting as amended. BALLWIN, MO 63011 PRESENTATION_____________________________________________________________ 2021 Audit Presentation The 2021 Audit Report was presented by Rick Gratza, Partner with Kerber, Eck & Braeckel LLP. The financial statements received an unmodified opinion with no material weaknesses or material noncompliance noted. No new accounting policies were adopted during the year, and no misstatements were detected as a result of audit procedures. A series of charts were presented which reflected various ratios for the City in each of the past five years. The level of fund balance that is unassigned in the general fund as a percentage of expenditures is 73%, with 20% usually considered desirable. Capital asset condition is 28%. Over the past four years, the City’s depreciable capital assets have had approximately a third of their useful lives remaining indicating a continual investment by the City that is keeping pace with depreciation. The pension plan funding ratio is 110%. Plans with a funding ratio of 80% or more are generally considered healthy plans. The current ratio is a measure of the City’s ability to pay its short-term obligations. The City’s ratio is 8.9%; a current ratio of 2.00 or higher indicates good current liquidity and an ability to meet the short-term obligations. Mayor Pogue asked if the pension plan includes both the police department and other City staff combined; the response was yes. LEGISLATION_______________________________________________________________ BILL 4123 - AN ORDINANCE GRANTING A SPECIAL USE EXCEPTION TO ALTON M. KLEIN D/B/A KIDS EMPIRE FOR AN INDOOR ENTERTAINMENT FACILITY AT 14880 MANCHESTER ROAD, SUITE B. A motion was made by Alderman Bullington and seconded by Alderman Fleming for a first reading of Bill 4123, title only. A voice vote was taken with unanimous affirmative result and the motion passed. Bill 4123 was read for the first time. Discussion: Alderman Roach asked if there were any concerns. Mayor Pogue stated that the only concern was addressed. The petitioner acknowledged there would be no alcohol sales or alcohol allowed on the premises. The petitioner was in agreement to add this as a condition of the SUE, so it has been added as #12 of Exhibit 1 to not allow sales or consumption of alcohol on the premises. BALLWIN, MO 63011 A motion was made by Alderman Bullington and seconded by Alderman Fleming for a second reading of Bill 4123, title only. A voice vote was taken with unanimous affirmative result and the motion passed. Bill 4123 was read for the second time. A roll call vote was taken for passage and approval of Bill 4123 with the following results: Ayes – Aldermen Utt, Finley, Roach, Stallmann, Fleming, Bullington, Siegel Nays -- Bill No. 4123 was approved and became Ordinance No. 22-10. CONSENT ITEMS____________________________________________________________ Administration – Personnel Manual Changes Staff recommends approval of the proposed changes to the personnel manual. Discussion: Alderman Roach thanked staff for keeping a close eye on these things. A motion was made by Alderman Stallmann and seconded by Alderman Bullington to accept staff’s recommendation. A voice vote was taken with unanimous affirmative result and the motion passed. MAYOR’S REPORT__________________________________________________________ Mayor Pogue requested a motion to adopt the summer schedule. For the months of June, July and August, only the second meeting of the month (fourth Monday) will be held. A motion was made by Alderman Stallmann and seconded by Alderman Utt. A voice vote was taken with unanimous affirmative result and the motion passed. Mayor Pogue stated that in April 2020 the Board approved a state of emergency to include an emergency operations plan with regard to the Covid pandemic. He called an end to the state of emergency and it’s operating plan. Mayor Pogue appointed Alderman Stallmann to the Planning and Zoning Commission Board. A motion was made by Alderman Roach and seconded by Alderman Finley to approve the appointment. A voice vote was taken with unanimous affirmative result and the motion passed. CITY ATTORNEY’S REPORT_________________________________________________ Nothing to report STAFF REPORT____________________________________________________________ Public Works – Mosquito Spraying Public Works Director Jim Link stated we are recommending to contract with St. Louis County for mosquito spraying for the 2022 season due to low staffing in Public Works. Ballwin currently has a contract in place with the County for adulticiding (truck mounted fogging), while Ballwin does routine spraying. Mr. Link explained the process that the County follows to determine when fogging takes place. Mayor Pogue stated that, when we used County before, there were many complaints. Alderman Finley shared information on research he’s done and stated, with his take on the research, the County seems to be doing what they should be doing. He also talked about “bacterial dunks” that involves putting bacteria in pools of standing water which would then kill the larvae; he believes Ellisville does this. City Administrator Sterman stated he talked with Ellisville; they use the County as they have stopped doing adulticiding. Ellisville focuses more on larviciding and they will use the tablets in areas of standing water. Alderman Finley also stated he feels that there should be some citizen input on the subject and possibly we should wait to vote on this for the next meeting to give citizens the opportunity. BALLWIN, MO 63011 asked if Ballwin currently has anyone licensed; Mr. Link replied we have one employee so we can start anytime. Alderman Fleming stated it seems this is an all or nothing thing and he can see going with the County; if it doesn’t work, we can reconsider and go with our crews. Mr. Link stated his crew is ready to start on Monday. Alderman Bullington asked if the traps from the County are in place and if the traps are monitored regardless; Mr. Link replied yes to both questions. Mayor Pogue stated it would be good to put out an educational piece on social media to remind residents to get rid of any standing water on their property. A motion was made by Alderman Fleming and seconded by Alderman Finley to accept the staff recommendation. A roll call vote was conducted with the following results: Ayes: Aldermen Fleming, Finley Nays: Aldermen Siegel, Stallmann, Bullington, Utt and Roach. The motion did not pass.
