MINUTES The minutes from the January 9, 2023 Board of Aldermen Meeting were submitted for approval. Alderman Frank Fleming made a motion to approve the minutes as submitted, which was seconded by Alderman Michael Finley. The minutes from the January 9, 2023 Board of Aldermen Meeting were approved unanimously. CITIZEN COMMENTS________________________________________________________ Mr. Jim Bowlin, Mayor of Wildwood, stated that he is running for Senate District 15 as a Republican. He spoke about his values and what he hopes to achieve in the Senate if elected. Mr. Mark Harder, St. Louis County Council member representing District 7, stated that he is also running for Senate District 15, and spoke about what he hopes to achieve in the Senate if elected. Mayor Pogue wished both gentlemen luck on their campaigns. BALLWIN, MO 63011 LEGISLATION______________________________________________________________ BILL 4156 - AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF BALLWIN, MISSOURI TO EXECUTE A COLLECTIVE BARGAINING AGREEMENT WITH THE EASTERN MISSOURI COALITION OF POLICE, FRATERNAL ORDER OF POLICE, LODGE 15 ON BEHALF OF SERGEANTS AND LIEUTENANTS FOR THE FOUR YEAR PERIOD FROM 2023 THROUGH 2027. A motion was made by Alderman Fleming and seconded by Alderman Stallmann for a first reading of Bill 4156, title only. The motion passed unanimously and Bill 4156 was read for the first time. Discussion: Alderman Roach asked if the Lodge has approved the agreement. City Administrator Sterman responded they have held their vote and approved it; the City received the signed agreement after the packet had been distributed. Alderman Siegel said that as a union member, he did not take this lightly, and thought it was the best outcome. He hopes that the sergeants and lieutenants feel the same. Alderman Stallmann asked Chief Schaeffler to extend the Board’s thanks to all the officers. A motion was made by Alderman Fleming and seconded by Alderman Siegel for a second reading of Bill 4156, title only. The motion passed unanimously and Bill 4156 was read for the second time. A roll call vote was taken for passage and approval of Bill 4156. Bill 4156 was approved unanimously and became Ordinance No. 23-02. -------- BILL 4157 - AN ORDINANCE AMENDING CHAPTERS 15 AND 17 OF THE MUNCIPAL CODE REGARDING CONTROLLED SUBSTANCES TO ADDRESS MISSOURI CONSTITUTIONAL CHANGES CONCERNING RECREATIONAL MARIJUANA. A motion was made by Alderman Stallmann and seconded by Alderman Fleming for a first reading of Bill 4157, title only. The motion passed unanimously. Discussion: Alderman Stallmann pointed out that this ordinance change is to bring the City into compliance with State law after the passage of the constitutional amendment last November. A motion was made by Alderman Fleming and seconded by Alderman Utt for a second reading of Bill 4157, title only. The motion passed unanimously and Bill 4157 was read for a second time. A roll call vote was taken for passage and approval of Bill 4157. Bill 4157 was approved unanimously and became Ordinance No. 23-03. City of Ballwin- Board of Aldermen Meeting Minutes January 23, 2023 2  BOARD OF ALDERMEN Meeting Minutes JANUARY 23, 2023 7:00 PM 1 GOVERNMENT CTR. BALLWIN, MO 63011 BILL 4158 - AN ORDINANCE RESTRICTING PUBLIC SMOKING AND CONSUMPTION OF MARIJUANA. A motion was made by Alderman Bullington and seconded by Alderman Fleming for a first reading of Bill 4158, title only. The motion passed unanimously. Discussion: Alderman Roach asked about selling marijuana infused products – would that require an amended Special Use Exception (SUE)? City Administrator Sterman clarified that this bill is specific to the City’s Clean Air ordinance. Regarding consumption of those products on the site where they are sold, it is not allowed at the licensed dispensary. If an existing business wishes to sell marijuana-infused products, it would require going through the City’s SUE process, or an amendment of an existing SUE, to do so. A bill will be coming before the Board after it goes through Planning & Zoning that addresses this. A motion was made by Alderman Bullington and seconded by Alderman Fleming for a second reading of Bill 4158, title only. The motion passed unanimously and Bill 4158 was read for a second time. A roll call vote was taken for passage and approval of Bill 4158. Bill 4158 was approved unanimously and became Ordinance No. 23-04. PRESENTATION__________________________________________________________ Chief Doug Schaeffler introduced new police officers Kasey Meyers and Luke Shockley. He then congratulated Lt. Curt Saitta for graduating from the 284th session of the FBI National Academy class in Quantico, Virginia, in December 2022. Lt. Saitta was recognized in the class as having the most years of service. Chief Schaeffler noted that less than 1% of law enforcement executives from around the world are chosen to attend this academy. Mayor Pogue congratulated Lt. Saitta for this great accomplishment. CONSENT ITEMS__________________________________________________________ Parks & Recreation – Zero Turn Mower Staff recommends that the City award the contract for the purchase of a new Ferris zero turn radius mower to Scott’s Power equipment through the Missouri State contract for $14,939 and sell the old ZTR on GovDeals. Public Works – Truck with Leaf Vacuum Staff recommends the City purchase a 2023 M108SD Freightliner with a leaf vacuum attachment from Truck Centers and Woody’s Municipal Supply for $ 352,446.80 Discussion: Alderman Roach asked if the truck can be used for anything other than a leaf vacuum. Public Works Director Link responded that it is a swap loader and can be used for all Public Works operations. BALLWIN, MO 63011 it is a smaller truck than the swap loader used for concrete. Public Works Director Link confirmed this, and said that this purchase will be the third swap loader owned by the City. Alderman Roach asked how long the City will have the trucks. Public Works Director Link said trucks last an average of 10-13 years; longer if they are kept under cover. Alderman Mark Stallmann made a motion to approve all consent items. Alderman Siegel seconded the motion, which was approved unanimously. MAYOR’S REPORT__________________________________________________________ Mayor Pogue requested the reappointment of Jim Lieber, Darryl Holman, and Dan Aiken to the Ballwin Days Committee: Jim Lieber for two years (to expire in December 2024), and Darryl Holman and Dan Aiken for three years (to expire in December 2025). Alderman Stallmann made a motion to accept the appointments. Alderman Utt seconded the motion, which passed unanimously. CITY ADMINISTRATOR’S REPORT__________________________________________________ Nothing to report. CITY ATTORNEY’S REPORT_________________________________________________ Nothing to report. STAFF REPORTS Parks & Recreation – Golf Course Greens Roller Staff recommends awarding the purchase of the greens roller to MTI Distributing in the amount of $16,812.90. Alderman Stallmann made a motion to accept staff’s recommendation. Alderman Bullington seconded the motion, which passed unanimously. ALDERMANIC COMMENTS__________________________________________________ Alderman Finley gave a summary of the Public Health & Safety Committee meeting held at 6:00 and stated that no formal action was taken.
