BANGOR BOROUGH COUNCIL MEETING HELD AT 197 PENNSYLVANIA AVENUE, BANGOR, PA MINUTES July 24, 2017 7:00PM CALL TO ORDER AND PLEDGE TO FLAG ROLL CALL Members Present: Robert Goffredo, Sr. James W. Kresge Michael J. Bilotta Jane E. Gorman Robert W. Engle Joseph H. Capozzolo, Mayor Barry G. Schweitzer Others Present: Nathaniel J. Dysard, Borough Manager David J. Ceraul, Esq., Solicitor Sascha Gutierrez, Junior Council Member Absent: Bonnie J. LaBar Robert J. Rhodes, Jr. PUBLIC COMMENT 1. Scott Parsons (Executive Director of the Slate Belt COG) was present to speak on behalf of the Pup Park Posse organization. The Pup Park Posse is interested in the property behind the baseball field at Bangor Park for a dog park. Mr. Parsons is asking for Council approval to move forward. Council President Kresge commented that this topic was discussed in the past and a motion was passed stating that the borough supports a concept of having this in town but not on borough property. Manager Dysard stated that the property has many concerns other than liability (infrastructure and environmental concerns). Mr. Parsons updated Council on the current activities of the Animal Control Officer (Christine Mammi) and the program is going well. He also stated that the Multi-Municipal Comprehensive plan grant has been filed. APPROVAL OF MINUTES A MOTION to approve the minutes dated June 12, 2017 & June 26, 2017 was made by Engle, seconded by Bilotta. All were in favor. MOTION carried. APPROVAL OF BILLS TO BE PAID A MOTION to approve the bills totaling $323,623.25 to be paid was made by Schweitzer, seconded by Goffredo. All were in favor. MOTION carried. ACTION ITEMS 1. Manager Dysard stated that the 2016 Annual Borough audit is complete. Chris Herr from Mallie was present to review the audit with Borough Council and answer any questions. A MOTION was made by Engle, seconded by Gorman to accept the 2016 Borough Audit. All were in favor. MOTION carried. 2. A MOTION to accept Police Directive 2.5.1 (Police Department Clerk) was made by Engle, seconded by Bilotta. All were in favor. MOTION carried. 3. Manager Dysard reported that there is a list of approximately 600 boxes of files to be destroyed as per the adopted Records Retention Manual. They contain files from the Authority, Borough and Police Department. A MOTION was made by Schweitzer, seconded by Goffredo to approve the shredding of these documents. All were in favor. MOTION carried. 4. Manager Dysard indicated that Liberty Fire Company might be using the Boroughs Zoning Hearing Board Solicitor for their representation to challenge our Zoning and Hearing Board. The problem is that the Boroughs previous Alternate Solicitor is no longer the Alternate Solicitor and the Zoning Hearing Board does not have one. If our Solicitor engages with the Fire Department the Borough would be without representation. Manager Dysard would like to make a recommendation for an Alternate Solicitor to the Zoning and Hearing Board. Solicitor Ceraul will give Manager Dysard a list of recommendations. OTHER PUBLIC COMMENTS 1. Michelle Roussos from 93 Ridge Road was present to come before Borough Council to address the issue of a red car parked at the incinerator site driveway next to her house. The owner of the car walked on her property. Chief Felchock advised Roussos that the law states that her property needs to be posted as ‘No Trespassing” for the law to take effect. The incinerator site property is posted. COUNCIL COMMENTS 1. Council Member Schweitzer commended Manager Dysard in controlling the budget for 2016. Schweitzer also addressed the issue of the numerous rentals in the Borough taking away from the tax revenue. Schweitzer is recommending a licensing fee for the landlords to increase revenue. Manager Dysard stated that the Borough currently has a residential licensing program and it’s a minimal fee because being a Borough entity you can only charge a fee where the borough breaks even. 2. Council Member Engle stated that everything with the fire department is going well and the Roseto Big Time starts July 26th. 3. Council Member Gorman commended that the Luau was a success. 4. Council Member Goffredo asked everyone to come and support the Roseto Big Time. He also stated that the Roseto Fire Department has adopted Act 172. 5. Council Member Bilotta also requested everyone to support the Fire Company and the Roseto Big Time event. EXECUTIVE SESSION A MOTION to go into Executive Session at 8:15 P.M. to discuss personnel matters, with action to follow was made by Engle, seconded by Schweitzer. All were in favor. MOTION carried. Council President Kresge stated that the personnel matters were discussed. A MOTION was made by Bilotta, seconded by Engle to advise the Teamsters that the grievance has expired and to authorize Manager Dysard to negotiate the settlement agreement. All were in favor. MOTION carried. ADJOURNMENT A MOTION to adjourn was made by Schweitzer, seconded by Gorman. All were in favor. MOTION carried. The Bangor Borough Council Meeting adjourned at 9:01 P.M.
