BANGOR BOROUGH COUNCIL MEETING HELD AT 197 PENNSYLVANIA AVENUE, BANGOR, PA MINUTES October 30, 2017 7:00PM CALL TO ORDER AND PLEDGE TO FLAG ROLL CALL Members Present: James W. Kresge Michael J. Bilotta Jane E. Gorman Robert W. Engle Robert J. Rhodes, Jr. Barry G. Schweitzer Others Present: Nathaniel J. Dysard, Borough Manager Joseph H. Capozzolo, Mayor Absent: Bonnie J. LaBar Robert Goffredo, Sr. Sascha Gutierrez, Junior Council Member David J. Ceraul, Esq., Solicitor PUBLIC COMMENTS 1. David Houser of 575 Grand Avenue and James Parry of 211 North Eight Street were present to discuss sidewalk issues. Mr. Parry is complaining about the corner sidewalk at the intersection of PA Avenue and North Eight Street. David Houser feels that this is not ADA compliant. Mr. Parry also commented about abandoned cars parked on his street and garbage on porches in town. Council President Kresge stated that the sidewalk does not have to be ADA compliant until it is replaced. The sidewalk on North Eight Street was a repair due to it being unsafe. Council President Kresge also stated that the cars across the street were registered. The code enforcement officer will be asked to look at the sidewalk issue again and the Borough 72 Hour Violation Ordinance will be reviewed. 2. Susan Emrick of 201 North Eight Street was present to discuss the sink holes on First Avenue and the alley. Manager Dysard will have Public Works look at it. 3. Lelia Ross of 129 Messinger Street asked when the culvert project was going to begin. President Kresge stated that the Borough did receive a grant from PennVest for approximately two million dollars. APPROVAL OF MINUTES A MOTION to approve the minutes dated September 11, 2017 & September 25, 2017 was made by Bilotta, seconded by Engle. All were in favor. MOTION carried. APPROVAL OF BILLS TO BE PAID A MOTION to approve the bills totaling $481,437.09 to be paid was made by Engle, seconded by Rhodes. All were in favor. MOTION carried. ACTION ITEMS 1. Council President Kresge stated that Rescue Fire Company is a Civic and Service Association as defined for the Small Games of Chance license. Because Rescue does not have 501 status there is a provision in the law that allows the borough to designate Rescue as a Civic and Service Association, allowing them to continue obtaining a small games of chance license. A MOTION was made by Schweitzer, seconded by Bilotta to approve the Rescue Fire Company Small Games of Chance Resolution. All were in favor. MOTION carried. 2. Manager Dysard discussed the 2018 draft budgets with Borough Council. The main changes revolve around the incorporation of the PennVest grant and purchasing a new zero turn lawn mower. There is a proposed $10.00/year increase in the Authority residential sewer/sanitation fees. COUNCIL COMMENTS 1. Council Member Schweitzer suggested using email to speed up the approval of items on the Authority agendas. Manager Dysard stated that would be a violation of the Sunshine Act. 2. Council Member Gorman stated that Octoberfest was a success and thanked everyone involved. 3. Mayor Capozzolo stated that the Messinger Bridge Street Opening was held on October 28th and he thanked Michael Ortoski of the Blue Valley Times for all his help. The Halloween Parade was also a success. 4. Council President Kresge complimented the Park Board on Octoberfest and the firemen for their hardwork. ADJOURNMENT A MOTION to adjourn was made by Rhodes, seconded by Bilotta. All were in favor. MOTION carried. The Bangor Borough Council Meeting adjourned at 8:03 P.M.
