BANGOR BOROUGH COUNCIL MEETING HELD AT 197 PENNSYLVANIA AVENUE, BANGOR, PA MINUTES FEBRUARY 13, 2023 - 6:30 PM CALL TO ORDER AND PLEDGE TO FLAG ROLL CALL Members Present: James W. Kresge Marissa Donnelly Joanna Paulson Robert Goffredo, Sr. James Augustine Rosemarie Capone Barry G. Schweitzer Others Present: Stephen M. Reider, Borough Manager Mary Ellen DeFranco, Mayor David J. Ceraul, Esq., Solicitor PUBLIC COMMENTS: 1. Josephine Hildabrant spoke to Council about the ongoing issues that Ms. Marouchoc (583 Fairview Avenue) is having with a neighbor regarding cameras and a chicken coop. ACTION ITEMS: 1. A MOTION to approve the minutes dated January 9, 2023, and January 23, 2023, was made by Donnelly, seconded by Goffredo. All were in favor. MOTION carried. Council Member Augustine noted a correction on the January 9, 2023 minutes. The Vote for Fahrenkrug for Planning Commission should be 4-3. A MOTION was made by Donnelly, seconded by Goffredo to amend the MOTION to include the correction. All were in favor. MOTION carried. 2. Manager Reider updated Council on the chicken coop situation that was discussed during public comment. Melissa Marouchoc, Cristie Derea, and Nancy Martocci were present to discuss this as well. Reider and Council discussed Ordinance #980 Animals and Animal Nuisances. A MOTION was made by Augustine, seconded by Goffredo to approve drafting a letter to Ms. Marouchoc and the neighbor stating that, borough council considers the run not to be a pen or coop and therefore the property at 583 Fairview Avenue is in compliance with Ordinance #980. All were in favor. MOTION carried. Council discussed the issues of the neighbor’s cameras pointed at 583 Fairview Avenue. Council President Kresge suggested that the borough staff research camera ordinances to be discussed at the next Council meeting. 3. Manager Reider stated that there have been issues with tractor trailers traveling on PA Avenue and other parking problems on Division Street. Reider discussed the minor changes to Ordinance #973, Vehicles, Traffic, and Parking Regulations with Council. A MOTION was made by Donnelly, seconded by Capone to authorize advertising the ordinance amendment. Adding PA Avenue between 1st and A Streets and Upper PA Avenue between 8th and Market Streets as commercial vehicles prohibited and no parking on both sides of Division Street between PA Avenue and Second Ave. All were in favor. MOTION carried. 4. Manager Reider is proposing some changes to the boroughs fee schedule. Manager Reider and Council discussed the proposed changes. A MOTION was made by Capone, seconded by Schweitzer to table the fee schedule for next meeting. All were in favor. MOTION carried.  5. Manager Reider provided cost estimates to Council for improvements to the Administrative Office and Police Department. A MOTION was made by Augustine, seconded by Donnelly to approve the estimates without including the wall to the Administrative Office improvements. All were in favor. MOTION carried. 6. Manager Reider provided cost lighting estimates to Council for upgrades at the parks and fire company buildings. A MOTION was made by Schweitzer, seconded by Goffredo to table this and have Manager Reider contact Ryerson Electric to have them provide a more detailed quote. All were in favor. MOTION carried. 7. Manager Reider stated that Police Directive 3.1.1-Use of Force needs to be updated due to the purchase of the new .22 rifle. A MOTION was made by Donnelly, seconded by Capone to approve the changes to Police Directive- 3.1.1 Use of Force. All were in favor. MOTION carried. 8. Council President Kresge stated that a letter of interest was received from Empire Coffee to continue to operate the food stand at the Bangor Memorial Park Pool. A MOTION was made by Capone, seconded by Augustine to approve Empire Coffee. Vote: 6-1 Paulson-nay. MOTION carried. 9. A MOTION was made by Schweitzer, seconded by Capone to approve the CDBG Bid Packet Advertisement (Stormwater Infrastructure). All were in favor. MOTION carried. 10. A MOTION was made by Donnelly, seconded by Augustine to appoint Joanna Paulson to the Disruptive Conduct Board as a property owner. All were in favor. MOTION carried. 11. A NOMINATION for Jeffery Paulson for Civil Service Commission was made by Donnelly, seconded by Capone. A MOTION to appoint Jeffrey Paulson was made by Donnelly, seconded by Capone. All were in favor. MOTION carried. COUNCIL COMMENTS: 1. Mayor DeFranco thanked Council for the condolences and sympathy regarding the passing of her sister. 2. Officer in Charge Jones stated that he would prefer that the new police vehicle use gas other than electric/gas. Jones provided a report to Council outlining the current Police Department activities. 3. Todd Albert stated that the tower ladder truck completed recertification and they are having trouble with some air packs but the manufacturer is working with them to address the issues. 4. Council Member Paulson also thanked Council and the Staff for their condolences regarding the passing of her sister. 5. Council Member Capone stated that the first Park Board Meeting of the year will be held on March 6th. The Mission of Love storage building should be completed by April. EXECUTIVE SESSION: A MOTION to go into Executive Session at 8:50 P.M. to discuss legal and personnel matters with potential action to follow was made by Donnelly, seconded by Capone.
