BANGOR BOROUGH COUNCIL MEETING HELD AT 197 PENNSYLVANIA AVENUE, BANGOR, PA MINUTES FEBRUARY 27, 2023 - 6:30 PM CALL TO ORDER AND PLEDGE TO FLAG ROLL CALL Members Present: James W. Kresge Marissa Donnelly Joanna Paulson Robert Goffredo, Sr. James Augustine Rosemarie Capone Barry G. Schweitzer Others Present: Stephen M. Reider, Borough Manager Mary Ellen DeFranco, Mayor David J. Ceraul, Esq., Solicitor Jeffrey Ott – Ott Engineering Bernadette Kearney – HRMM&L (via phone) Justin Massie – Terraform Engineering ACTION ITEMS: 1. Mayor DeFranco swore in James DeLeone, Jr. as the new full-time police officer. 2. A MOTION to approve payment of the bills totaling $366,639.06 was made by Goffredo, seconded by Donnelly. All were in favor. MOTION carried. 3. Manager Reider reported that the subdivision and land development application for the housing complex at 428 Market Street was reviewed by the Bangor Borough Planning Commission at their meeting on February 14, 2023. The applicant and engineer have submitted waiver requests for the project. Council discussed the requests so that revisions can be made to the plan submittals. 4. Manager Reider and Council reviewed and discussed the current pool stand contract. After discussions it was decided to keep the contract as is. 5. Manager Reider provided the proposed fee schedule for 2023 with revisions that were discussed at the February 13, 2023, meeting. A MOTION was made by Donnelly, seconded by Capone to approve the revisions. All were in favor. MOTION carried. 6. Manager Reider provided updated estimates to Council for lighting upgrades at the parks and fire company buildings. A MOTION was made by Schweitzer, seconded by Paulson to approve the lowest responsible bidder, Ryerson Electric & Contracting Services. Vote-6-1, Kresge-Nay. MOTION carried. 7. Council President Kresge stated that the Bangor Borough Authority Recommendation will be discussed during Executive Session. COUNCIL COMMENTS: 1. Officer in Charge Jones stated that the focus was getting Officer DeLeone, Jr. sworn in. Officer DeLeone, Jr. will start FTO with Officer Hunsicker for three weeks and then with Officer Sabatine. 2. Mayor DeFranco stated that she is thrilled about Officer DeLeone, Jr. She thanked Officer Jones for doing a fantastic job and the police department seems to be functioning very well. 3. Fire Chief Engle reported that the tower repairs have been completed and is certified for another year. An engine went down on 3012 for Second Ward and failed inspection. Repairs have been made and it is back in service. Engle is awaiting an update from the manufacturer regarding the air packs. 4. Council Member Paulson thanked Manager Reider for the purchase of the new chairs. 5. Council Member Capone stated that the first Park Board Meeting of the year will be held on March 6th. 6. Manager Reider mentioned the traffic build up that occurred in the borough on 2/23 due to the accident on Route 80 and thanked everyone involved. EXECUTIVE SESSION: A MOTION to go into Executive Session at 7:48 P.M. to discuss legal and personnel matters with potential action to follow was made by Augustine, seconded by Donnelly. All were in favor. MOTION carried. Open session was re-entered at 8:27 P.M. Council President Kresge stated that personnel matters regarding the police department and potential legal actions were discussed. A MOTION was made by Donnelly, seconded by Capone stating that Borough Council approves Bangor Borough Authority terminating merger discussion with Roseto Borough Sewer Authority and supports Bangor Borough Authority in notifying both Roseto Borough and Roseto Borough Sewer Authority that they are in breach of the contract that they are currently operating under with the Bangor Borough Authority and that Bangor Borough Authority intends to pursue any and all remedies that are provided to them. All were in favor. Vote-6-0, Goffredo-Abstained. MOTION carried. ADJOURNMENT: A MOTION to adjourn was made by Paulson, seconded by Donnelly. All were in favor. MOTION carried.
