BANGOR BOROUGH COUNCIL MEETING HELD AT 197 PENNSYLVANIA AVENUE, BANGOR, PA MINUTES MAY 22, 2023 - 6:30 PM CALL TO ORDER AND PLEDGE TO FLAG ROLL CALL Members Present: James W. Kresge Marissa Donnelly James Augustine Rosemarie Capone Barry G. Schweitzer Robert Goffredo, Sr. Joanna Paulson Others Present: Stephen M. Reider, Borough Manager David J. Ceraul, Esq., Solicitor Mary Ellen DeFranco, Mayor PUBLIC COMMENT: 1. Scott Zukowski was present from 51 North First Street to discuss with Council the issues he is having with the resident at 65 North First Street. Manager Reider stated that he will work with Code Enforcement and post a Cease-and-Desist Order on the property. ACTION ITEMS: 1. A MOTION to approve the minutes dated April 10, 2023, and April 24, 2023, was made by Paulson, seconded by Capone. All were in favor. MOTION carried. 2. A MOTION to approve payment of the bills totaling $313,503.32 was made by Donnelly, seconded by Goffredo. All were in favor. MOTION carried. 3. Frank Cutter, Jordan Borger, and Jim Patti were present from Liberty Fire Company to discuss with Council their request for the borough to apply for an LSA grant on their behalf for the completion of their retaining wall project. This was tabled until the June 12, 2023 Council Meeting so Council can review the figures to be provided by Manager Reider for the LSA Grant for the Public Works Garage. Council can then review both LSA Grant applications and come to a decision. 4. Chief Jones stated that he would like to order new uniforms for the officers and create a new patch for the police department. Mayor DeFranco requested that Chief Jones get a vote from the police association for the change. 5. Mayor DeFranco commented that she talked with Rinaldo who represents the East Penn Raiders Football Team. Rinaldo is requesting to attend the June 12, 2023 Council Meeting along with the owner of the league to discuss using the Bangor Memorial Park Stadium for their home games again this year. Council tabled this until June. 6. Council President Kresge stated that a letter of interest was received from MaKayla Adams to serve on the Park Board. Ms. Adams was present to address council as to why she would like to serve on the Park Board. A MOTION was made by Donnelly, seconded by Capone to appoint MaKayla Adams to the Park Board pending a background investigation. All were in favor. MOTION carried. 7. A MOTION was made by Schweitzer, seconded by Goffredo to approve the resignation of James Kresge with regret, from his seats on the Civil Service Commission and Bangor Borough Authority. All were in favor. MOTION carried.  8. Manager Reider stated that a Resolution is needed to include with the CDBG grant application. This will be for the road paving on Fairview and Division Street. A MOTION was made by Capone, seconded by Goffredo to approve the Resolution and the Borough Manager applying for the grant and the execution of the necessary documents. All were in favor. MOTION carried. 9. Attorney Joe Piperato was present on behalf of TMS Real Estate Investments to discuss with Council the preliminary subdivision and land development plans for the Quarry Ridge Road Townhome development. David Bennett from Bohler Engineering, Theresa Calantoni from TMS Real Estate and Jeffrey Ott were present to review the land development plans with Council and answer questions. A MOTION was made by Goffredo, seconded by Augustine to approve the plan waivers as per the recommendation of the Bangor Borough Planning Commission and Jeff Ott’s recommendations. Vote, 6-1- Paulson-Nay. MOTION carried. A MOTION was made by Augustine, seconded by Capone to grant conditional preliminary plan approval, as per the May 22, 2023 preliminary plan form created by Ott Consulting. Vote, 6-1-Paulson Abstain. MOTION carried. COUNCIL COMMENTS: 1. Council Member Schweitzer gave a brief history of the dirt that was dumped at the Ridge Road Property in November, 2010. 2. Council Member Capone stated that the next Park Board meeting will be held on June 5th. 3. Manager Reider stated that the borough received an LSA Grant for a portion of the cost of a salt shed. Reider advised Council that the borough was flagged during the recent liquid fuels audit. He will keep Council updated on the status. Reider thanked the Bangor High School Horticulture Club for donating flowers to the borough and Council Member Donnelly and family for planting the flowers. Reider thanked Public Works for their efforts on addressing recent pool issues. 4. Council President Kresge thanked Council Member Donnelly and her family for planting the flowers. EXECUTIVE SESSION: A MOTION to go into Executive Session at 7:49 P.M. to discuss police personnel matters with potential action to follow was made by Donnelly, seconded by Augustine. All were in favor. MOTION carried. Open session was re-entered at 8:04 P.M. Council President Kresge stated that personnel matters regarding the police department were discussed. No action was taken. ADJOURNMENT: A MOTION to adjourn was made by Capone, seconded by Donnelly. All were in favor. MOTION carried. The Bangor Borough Council Meeting adjourned at 8:05 P.M.
