BOROUGH OF BARRINGTON MINUTES OF MONTHLY COUNCIL MEETING March 21, 2017, at 6:00 PM (rescheduled from March 14 due to snowstorm) COUNCIL ROOM AT MUNICIPAL BUILDING A regular monthly Council Meeting of the Borough of Barrington was held with Council President Popiolek presiding. Mayor Klaus was absent. This meeting followed the unearthing of the Time Capsule from the 75th Anniversary Celebration of the Borough. CALL TO ORDER Council President Popiolek called the meeting to order with the following statement: "This meeting is held in compliance with Chapter 231 of the open public meetings act of 1975 and appropriate notice has been given. Notice of the meeting was filed with the Retrospect and Courier Post and is also posted in the main office of the Borough Clerk where notices are primarily kept. He then led the salute to the flag of our country. ROLL CALL The Municipal Clerk called roll of Council and with the following in attendance: Councilwoman Harris, Councilman Ludwig, Councilman Robenolt, Council President Popiolek and Councilman Beach. Councilwoman Fawley was absent. Also on dais: Municipal Clerk Terry Shannon and Borough Solicitor, Timothy Higgins, Esq. APPROVAL OF MINUTES Council President Popiolek noted that Council was provided with a copy of the printed minutes of the February 7, 2017, caucus meeting and the February 14, 2017, council meeting and asked if there were any corrections. Seeing none, on a Motion by Nicholson (Harris) and Beach, the caucus and council minutes were approved by all members of Council present. COMMITTEE REPORTS The Municipal Clerk read a summary of the February 2017, monthly reports as submitted by Chief David Uron for Police, Chief Barbara Willson for the EMS/Ambulance, Fire Official Steve DePierri for Regional Fire Alliance, Construction Department, Superintendent Michael J. Ciocco for Recycling, Tax Collector Kristy Emmett for Tax and Sewer Collections and Court Administrator Catherine Lawson for Municipal Court. On a Motion by Harris and Robenolt the monthly reports were approved as submitted by all members of Council present. PROCLAMATIONS: April as Child Abuse Prevention Month as read by Councilman Ludwig and presented to Harvey Lermack of the Kiwanis Club of the Haddons by Councilman Ludwig and Council President Popiolek. Also read was a proclamation for April in Support of the 2017 UDrive-Utext-Upay Distracted Driving Crackdown as read by Councilman Robenolt. PUBLIC HEARING ON COMCAST APPLICATION FOR RENEWAL OF MUNICIPAL CONSENT TO OPERATE A CABLE COMMUNICATIONS SYSTEM IN THE BOROUGH OF BARRINGTON Clerk Shannon explained that Comcast has filed an application to renew their agreement with the Borough. Kathy Farinaccio from Comcast is present for this public hearing. On a motion by Ludwig and Harris the Public Hearing was opened. Council President Popiolek asked that you please state your name and address for the record. Comments are limited to five minutes. Farinaccio announced she has a statement to read first. She explained that Comcast filed an application to renew their franchise agreement with the Borough. Today’s hearing is another step in the process. They want to hear the public’s needs and concerns so they can take them into consideration. Comcast has met their obligations under the original franchise agreement. They have expanded their operations and service to their customers. They are offering more self-help options. They have better service regarding technical support. They have a proven track record for investment in customer service. They believe the products they offer have met and exceeded customer demands. They are also offering more services and support for customers with disabilities. After Farinaccio finished reading her statement, she took questions. Councilman Ludwig asked about Netflix and Farinaccio confirmed Netflix is now offered as part of their platform so you don’t need a separate device. Councilman Robenolt asked if their marketing people are Comcast employees or if they use subcontractors. Farinaccio said everyone she works with are Comcast employees. She was not sure if they use subcontractors or not but she can look into it. Diane Schreyer, 212 Nassau Drive, asked why Comcast offers a cafeteria type of selection rather than having to take the bundles they offer. Farinaccio said there are some bundles that don’t include sports and she can provide more information. Schreyer asked why they offer special deals to new customers but the regular customers prices go up and up year after year. She has a lot of issues with Comcast that she would like to discuss. Farinaccio said she would give her a business card and hopefully can help address her concerns. Seeing no further questions, on a Motion by Ludwig and Robenolt the public hearing was closed and approved by all members of Council present. ORDINANCES FOR PUBLIC HEARING AND ADOPTION: Ord. 1065 Amending Chapter 58, Fees, in the Borough Code (traffic control fees) Ord. 1066 Amending Chapter 101, Sewers, in the Borough Code (waives sewer fees for military members deployed overseas) Ord. 1067 Amending Chapter 58, Fees, in the Borough Code (amends hall rental fees) On a motion by Ludwig, second by Harris, the second reading was approved with the following poll vote: Ludwig-yes, Harris-yes, Robenolt-yes, Popiolek-yes, Beach-yes, Fawley-absent. On a motion by Harris, second and Beach, the public hearing was opened. Seeing no public comment, on a motion by Beach and Ludwig the public hearing was closed. On a motion by Harris, second by Robenolt, the ordinances were adopted with the following poll vote: Ludwig-yes, Harris-yes, Robenolt-yes, Popiolek-yes, Beach-yes, Fawley-absent. ORDINANCES FOR INTRODUCTION ON FIRST READING: Ord. 1068 Calendar Year 2017 Ordinance to Exceed Municipal Budget Appropriation Limits and Establish a CAP Bank Ord. 1069 Adding Article IX, Community Cats, to Chapter 48, Animals, in the Borough Code Ord. 1070 Adding Article IV, Registration of Defaulted Mortgage Property, to Chapter 95 in the Borough Code On a motion by Ludwig, second by Harris, the first reading of the ordinances was approved with the following poll vote: Ludwig-yes, Harris-yes, Robenolt-yes, Popiolek-yes, Beach-yes, Fawley-absent. Council President Popiolek announced these ordinances will be considered for adoption following proper notice and a public hearing to be held at the April 11 council meeting. RESOLUTIONS: The Municipal Clerk advised that she would read the following resolutions by title, one after another, and Council will have the opportunity to vote as Consent Agenda at the end of the reading. 3-2017-37 Authorizing a Shared Services Agreement with Merchantville for Finance Officer Svcs. 3-2017-38 Authorizing a Shared Services Agreement with Merchantville for Tax Collector Svcs. 3-2017-39 Authorizing Verizon Wireless to Locate and Operate Equipment in the Right-of-Way 3-2017-40 Authorizing an Application for CDBG Year 39 Funding 3-2017-41 Authorizing an Application for CDBG Supplemental Funding 3-2017-42 Authorizing an Application for Camden Co. Open Space Funding 3-2017-43 Authorizing Submission of an Application for a NJDEP Tonnage Grant 3-2017-44 Authorizing an agreement with Community Champions through Camden County 3-2017-45 Approving Governing Body Committee Assignments 3-2017-46 Authorizing Purchase of a New ODB Trailer Mounted Vacuum Debris Collector 3-2017-47 Approving the March Bill List in the Total Amount of: $553,531.97 On a motion by Harris and Beach, the resolutions consent agenda as read was approved with the following poll vote: Ludwig-yes, Nicholson-yes, Robenolt-yes, Popiolek-yes, Beach-yes, Fawley- absent. RESOLUTIONS APPROVED COMMENTS FROM MEMBERS OF THE GOVERNING BODY COUNCILWOMAN HARRIS – it was great watching the opening of the time capsule. Our new Councilperson Candice Fawley apologizes that she is not here but when the council meeting was changed because of the snow last week she already had made arrangements to be out of town. Easter Egg Hunt is April 6 at the Little League field and at VFW Memorial Senior Center if it rains; April 1 is Little League opening day; April 8 is Softball opening day, May 20 is Barrington Day with a rain date of May 21, May 29 is our Memorial day celebration and July 3 is our parade beginning at 6:30 pm with fireworks at dark; We have a rain date this year of July 7 for both the parade and the fireworks; our parade and fireworks are always great. This Saturday, March 25 is sold out for the Barrington Centennial celebration dinner which is being held at the Avon School. COUNCILMAN LUDWIG – good job to all the departments in handling of the snow last week, it’s always a lot of work, Police, Ambulance, Fire and DPW do an awesome job. COUNCILMAN ROBENOLT – good evening and thanks for coming out. Public Safety is doing well; all the departments are functioning properly and doing a good job. COUNCILMAN BEACH – said DPW, Police and all departments did a great job with the snow and bad weather and you can tell all really put a lot of effort in to what they do, great job. Glad Eileen Holcombe is back and her surgery went well; we will work together with the seniors. Hope to see a lot of you on Saturday night at the party. COUNCIL PRESIDENT POPIOLEK— thanked Public Safety and DPW, we were supposed to get lots of snow and we got ice. Thanks to the residents and their cooperation with Police and DPW. It is very important if you live on a snow route to move your car off the street the night before so Police and DPW can do their job. Great to go through the time capsule and see cassette tapes and VHS tapes. All of these things were at the pinnacle of technology then and to see the handwritten notes from residents. It’s heartwarming to see how many people have taken care of this community and nurtured it throughout the years and it’s an honor that they are passing that baton off to us. Looking forward to Saturday for the Centennial dinner. Thanks to all. Councilwoman Harris did contact Congressman Norcross’ about the flag and we will have one that hung over the Capitol Building to put in our upcoming time capsule. Budget meetings coming up and the CFO Denise Moules has not advised of any major problems. Comcast has been very responsive to our needs and we look forward to a continued partnership. As for the White Horse Pike there have been no significant delays with the Wild Wing Café and they hope to open by mid to late spring and we look forward to that. COUNCILWPMAN FAWLEY— ABSENT MAYOR KLAUS- ABSENT PUBLIC PORTION: On a motion by Ludwig and Robenolt, the public portion of the meeting was opened. Council President Popiolek advised that if you have comments or questions to come forward and state your name and address for the record. Public comment is limited to five minutes per person. Seeing no comments from the public, on a motion by Ludwig and Harris, the public portion of the meeting was closed.
