BOARD OF APPEALS HEARING MINUTES MARCH 15, 2017 CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 Call to Order: Roll Call for Board Members: Stan Chubinski, John Sims, Robert Whitfield, Kara Werner Staff Members Present: Jason Francisco, Code Compliance Manager; Don Wilkinson, Building Inspector; Jaqueline Slaby, Code Officer; Lisa Silkworth, Secretary Additions/Deletions to the Agenda: none Approval of Minutes: Mr. Whitfield made a motion to approve the minutes from February 15, 2017, seconded by Mr. Sims. Approved Old Business: 1. 175 Sherman Rd – 2nd Appeal Issue#EN16-09845 Code Compliance Officer: Jacqueline Slaby Property Owner, not present. Jaqueline Slaby, Code Officer, stated this was a second appeal for more time but she has not heard from the owner. The owner, Rose Sims, did send in two estimates and has sought help for repairs. Mr. Sims made a motion to affirm the order as written due to no owner present, seconded by Mr. Whitfield. Affirmed. All yes Dangerous Buildings Show Cause Hearings: a. 54 Hancock Ct (House) Issue#EN16-12431 Building Inspector: Don Wilkinson Property Owner, not present. Don Wilkinson, Building Inspector, stated the property was vacant, lacked utilities and lacked maintenance. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Ms. Werner made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed. Mr. Sims made a motion to affirm the property as a Dangerous Building, seconded by Ms. Werner. Affirmed. c. 299 N Kendall (House) Issue#EN16-012433 Building Inspector: Don Wilkinson Property Owner, not present. Don Wilkinson, Building Inspector, stated the property was vacant, lacked utilities and lacked maintenance. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Sims made a motion to affirm the property as a Dangerous Building, seconded by Mr. Whitfield. Affirmed. Don Wilkinson, Building Inspector, stated the property was vacant, lacked utilities and lacked maintenance. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Ms. Werner made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed. All yes g. 272 W Manchester (House) Issue#EN16-12438 Building Inspector: Don Wilkinson Property owner, Gurmukh Singh, present. Don Wilkinson, Building Inspector, stated the property has been vacant but there have been permits pulled. Mr. Singh stated that the inspections are done and he has pulled a permit to demo the garage. Mr. Wilkinson recommended granting an extension of thirty days. Mr. Sims made a motion to grant an extension to April 18, 2017, seconded by Ms. Werner. Extension granted. Don Wilkinson, Building Inspector, stated the property was vacant, lacked utilities and lacked maintenance. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Sims made a motion to affirm the property as a Dangerous Building, seconded by Ms. Werner. Affirmed. All yes i. 37 S Mason (House) Issue#EN16-12440 Building Inspector: Don Wilkinson Property Owner, not present. Don Wilkinson, Building Inspector, stated the property was vacant, lacked utilities and lacked maintenance. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Ms. Werner made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed. All yes New Business: 1. 80 Carl Ave Issue#EN17-00532 Code Compliance Officer: Jacqueline Slaby Property owner, Allen Ebert, present. Jaqueline Slaby, Code Officer, stated the violations noted were on the exterior and the property was put into the vacant process. Mr. Ebert stated he plans to take care of the shed and that they are trying to sell the property at this time. Mr. Francisco, Code Compliance Manager, stated the issues before the Board were the steps, shed, and missing siding. Mr. Ebert stated he had fixed the siding, and he would put the steps out front. Mr. Ebert stated the shed was temporary. Mr. Ebert is requesting until the end of April. Mr. Whitfield Housing Board of Appeals March 15, 2017 Page 5 of 5 made a motion to grant extension to April 18, 2017, seconded by Mr. Sims. Extension granted. All yes 2. 298 Meachem Ave Issue#EN17-00087 Code Compliance Officer: Jacqueline Slaby Property owner, not present. Jaqueline Slaby, Code Officer, stated the violations stemmed from a rental complaint. Ms. Slaby recommended affirming the order as written due to no owner present. Mr. Sims made a motion to affirm the order as written, seconded by Ms. Werner. Affirmed.
