BOARD OF APPEALS HEARING NOTICE AND AGENDA APRIL 19, 2017 CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 Call to Order: 1:00pm Roll Call for Board Members: Stan Chubinski, Eric Blair, Robert Whitfield, John Sims Staff Members Present: Jason Francisco, Code Compliance Manager; Don Wilkinson, Building Inspector; Yolanda Johnson, Code Officer; Lisa Silkworth, Secretary Additions/Deletions to the Agenda: Remove 338 Parkway and 106 Lathrop Approval of Minutes: Mr. Blair made a motion to approve the minutes from the March 15, 2017 meeting, seconded by Mr. Sims. Approved Old Business: none Dangerous Buildings Show Cause Hearings: a. 105 Frisbie (House) Issue#EN17-00188 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Inspector, stated the property has been vacant, lacks utilities, and lacks maintenance. Mr. Wilkinson made a recommendation to affirm the property as a Dangerous Building. Mr. Blair made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed. All Yes b. 22 Graves (House) Issue#EN17-00189 Building Inspector: Don Wilkinson Property owner, not present. Mr. Wilkinson, Building Inspector, stated the property has been vacant over 180 days, lacks utilities, Housing Board of Appeals April 19, 2017 Page 2 of 5 lacks property maintenance. Mr. Blair made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed. All Yes c. 18 Hillcrest (House) Issue#EN17-00383 Building Inspector: Don Wilkinson Property owner, Jeana Thurman, representing Northstar Ventures, present. Mr. Wilkinson, Building Inspector, stated the property has been vacant over 180 days, lacks utilities, and lacks property maintenance. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Ms.Thurman representing Northstar Ventures, stated the property is for sale and does not think it is a dangerous building. Mr. Wilkinson explained the process of Dangerous Building Ordinance. Ms. Thurman noted the previous owner had gutted the house. Mr. Whitfield made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed All Yes d. 84 Mosher (House) Issue#EN17-00442 Building Inspector: Don Wilkinson Property owner, Barry Williams for Muriel Bernard, present. Don Wilkinson, Building Inspector, stated the property has been vacant over 180 days, lacks utilities, and lacks property maintenance. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Williams stated the owner wants to give the property to her grandson. Mr. Williams is a contractor she hired to look at her property. Mr. Sims made a motion to affirm the property as a Dangerous Building, seconded by Mr. Whitfield. Affirmed. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Sims made a motion to affirm the property as a Dangerous Building, seconded by Mr. Blair. Affirmed All Yes f. 165 N Woodlawn (House) Issue#EN08-11197 Building Inspector: Don Wilkinson Property owner, John Kenefick for 165 Woodlawn Ave LLC, present. Don Wilkinson, Building Inspector, stated the property has been vacant over 180 days, lacks utilities, and lacks property maintenance. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Kenefick stated Semco Energy is running a new gas line to the property. Mr. Whitfield made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed. All Yes New Business: 1) 124 N Broad Issue#EN16-08943 Code Compliance Officer: Yolanda Johnson Property owner, Mary Jo Amundson-Brinkman, present. Yolanda Johnson, Code Officer, stated the violations were exterior in nature. Ms. Johnson recommended a 90-day extension. Ms. Amundson- Brinkman stated she would like to make the corrections but the weather has not cooperated. Ms. Amundson-Brinkman would like Housing Board of Appeals April 19, 2017 Page 4 of 5 an extension to August. Mr. Whitfield made a motion to grant an extension to July 18, 2017, seconded by Mr. Sims. Extension Granted. All Yes 2) 83 East Ave Issue#EN16-09092 Code Compliance Officer: Yolanda Johnson Property owner, Jessica Deibel, present. Yolanda Johnson, Code Officer, stated the violations were exterior in nature. Ms. Johnson recommended a 60-day extension. Ms. Deibel stated she had to replace a sewer pipe this winter and needs more time to make the repairs. Mr. Blair made a motion to grant an extension to June 20, 2017, seconded by Mr. Whitfield. Extension granted. All Yes 3) 338 Parkway Issue#EN17-00233 Code Compliance Officer: Yolanda Johnson REMOVED 4) 106 Lathrop Issue#EN17-00340 Code Compliance Officer: Tom Engels REMOVED Public Comments: Deputy City Attorney Marcel Stoetzel clarified the person that spoke for 165 Woodlawn was John Kenefick at 234 South Ave, Battle Creek, MI 49014. Board and Staff Members Comments: Mr. Chubinski questioned why some house have been vacant so long. Mr. Wilkinson explained the process. Adjournment: 1:33pm The City of Battle Creek will provide necessary reasonable auxiliary aids and services, such as signers for the hearing impaired and audiotapes of printed materials being considered in the meeting Housing Board of Appeals April 19, 2017 Page 5 of 5 upon reasonable notice to the City of Battle Creek.
