BOARD OF APPEALS HEARING MINUTES July 19, 2017 CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 Call to Order: 1:00pm Roll Call for Board Members: Eric Blair, John Sims, Robert Whitfield Staff Members Present: Jason Francisco, Code Compliance Manager; Don Wilkinson, Building Inspector; Todd Nowicki, Senior Code Officer; Tom Engels, Senior Code Officer Additions/Deletions to the Agenda: Remove 151 Ann Ave, 135 Oaklawn Ave, 285 Parish, 136 Roseneath Approval of Minutes: Mr. Blair made a motion to approve the minutes from the June 21, 2017 meeting, seconded by Mr. Sims. Approved. Old Business: none Dangerous Buildings Show Cause Hearings: a. 35 Elm (House) Issue#EN17-00349 Building Inspector: Don Wilkinson Property Owner, Jennifer Smith, present. Don Wilkinson, Building Inspector, noted the violations were noted during a police call and the property has no utilities. Ms. Smith had an engineer come through the property but it the engineer raised the fee. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Ms. Smith stated she did tried to pull the permit but it was denied due to no plans. Ms. Smith noted she is not living in the house at this time. Mr. Blair made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed. All Yes b. 91 Frisbie (House) Issue#EN17-03456 Building Inspector: Don Wilkinson Housing Board of Appeals July 19, 2017 Page 2 of 5 Property owner, Susan Hale. Don Wilkinson, Building Inspector noted the house was heavily damaged by fire. Mr. Wilkinson also stated the owner does intend to demolish and rebuild. A building permit has been pulled. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Ms. Hale stated she has hired a contractor. Mr. Blair made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed. All Yes c. 28 Seedorf (House) Issue#EN17-03384 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Inspector, stated the property has been vacant, lacks maintenance, and lacks utilities. Mr. Blair made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed. All Yes d. 225 South Ave (House) Issue#EN17-03460 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Inspector, stated the property has been vacant, lacks maintenance, and lacks utilities. Mr. Blair made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed. Don Wilkinson, Building Inspector, stated the property has been vacant, lacks maintenance, and lacks utilities. Mr. Blair made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed. Mr. Blair made a motion to dismiss the order due to the property being in compliance, seconded by Mr. Sims. Dismissed. All Yes 4. 46 Ann Ave Issue#EN17-01146 Code Compliance Officer: Tom Engels Property owner, Robert Garcia, present. Tom Engels, Senior Code Officer, stated the violations were exterior in nature and some work had been completed. Mr. Garcia stated he needed more time. Mr. Blair made a motion to grant a thirty day extension to August 15, 2017, seconded by Mr. Sims. Extension granted. All Yes 5. 52 Ann Ave Issue#EN17-01147 Code Compliance Officer: Tom Engels Property owner, Yvonne Lee, present. Tom Engels, Senior Code Officer, stated the violations were exterior in nature and some work had been completed. Ms. Lee stated she needs more time due to financial reasons. Mr. Blair made a motion to grant a sixty day extension to September 19, 2017, seconded by Mr. Sims. Extension granted. Tom Engels, Senior Code Officer, stated the violations were exterior in nature and some work had been completed. Mr. Edwards needs more time due to his work schedule. Mr. Blair made a motion to grant a sixty day extension to September 19, 2017, seconded by Mr. Sims. Extension granted. All Yes 8. 143 Jordan Issue#EN17-01566 Code Compliance Officer: Tom Engels Property owner, Monica Dixon, present. Tom Engels, Senior Code Officer, stated the violations were exterior in nature and some work had been completed. Ms. Dixon stated she needs more time due to health issues. Mr. Blair made a motion to grant a thirty day extension to August 15, 2017, seconded by Mr. Sims. Extension granted. All Yes 9. 135 Oakawn Ave Issue#EN17-01657 Code Compliance Officer: Tom Engels REMOVED 10. 145 Oaklawn Ave Issue#EN17-01659 Code Compliance Officer: Tom Engels Property owner, Jeffrey Orr, present. Tom Engels, Senior Code Officer, stated the violations were exterior in nature and some work had been completed. Mr. Orr noted he wanted to side the house but has to go through the Historic District Commission first. Tom Engels, Senior Code Officer, stated the violations were exterior in nature and some work had been completed. Mr. Sims made a motion to grant an extension to August 15, 2017, seconded by Mr. Blair. Extension granted.
