BOARD OF APPEALS HEARING NOTICE AND AGENDA August 16, 2017, 2017 CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 Call to Order: 1:00pm Roll Call for Board Members: Stan Chubinski, Kara Werner, Robert Whitfield Staff Members Present: Jason Francisco, Code Compliance Manager; Don Wilkinson, Building Inspector; Todd Nowicki, Senior Code Officer; Yolanda Johnson, Code Officer Additions/Deletions to the Agenda: Remove 1200 W Michigan Approval of Minutes: Mr. Whitfield made a motion to approve the minutes from the July 19, 2017, seconded by Ms. Werner. Approved. All Yes Old Business: none Dangerous Buildings Show Cause Hearings: a. 48 New England (House) Issue#EN17-04977 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Inspector, stated the house has been vacant over 180 days, lacks utilities and lack property maintenance. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Whitfield made a motion to affirm the property as a Dangerous Building, seconded by Ms. Werner. Affirmed. All Yes b. 93 W Northside (House) Issue#EN17-04978 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Inspector, stated the house has been vacant over 180 days, lacks utilities and lack property maintenance. Ms. Werner made a motion to affirm the property as a Dangerous Building, seconded by Mr. Whitfield. Affirmed. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Whitfield made a motion to affirm the property as a Dangerous Building, seconded by Ms. Werner. Affirmed. All Yes. New Business: 1. 223 Capital Ave NE Issue#EN17-04776 Code Compliance Officer: Todd Nowicki Property owner, not present. Todd Nowicki, Senior Code Officer, stated the violations were noted during a rental inspection. Mr. Whitfield made a motion to affirm the order as written, seconded by Ms. Werner. Affirmed. All Yes. 2. 864 W Michigan Ave Issue#EN17-06117 Code Compliance Officer: Todd Nowicki Property owner, June Sims, present. Todd Nowicki, Senior Code Officer, stated the violations were exterior in nature. Mr. Nowicki recommended granting a 60-day extension. Ms. Sims stated some work had been completed including power washing. MR. Whitfield made a motion to grant an extension to October 17, 2017, seconded by Ms. Werner. Extension granted. All Yes. 3. 1200 W Michigan Issue#EN17-06133 Code Compliance Officer: Todd Nowicki REMOVED 4. 130 W Manchester Issue#EN14-22667 Code Compliance Officer: Yolanda Johnson Housing Board of Appeals August 16, 2017 Page 4 of 5 Property owner, Nina Lagrand, present and Jennifer Lagrand speaking on her behalf. Yolanda Johnson, Code Officer, stated the violations were noted during a rental inspection. Ms. Johnson noted the violations have not been corrected. Ms. Johnson recommended granting a possible 30 day extension. Ms. Jennifer Lagrand stated Ms. Johnson spoke with her brother but he is not responsible for the corrections. Ms. Lagrand stated the screens were fixed in 2015. Ms. Lagrand stated the tenants are destructive. Ms. Lagrand stated the steps have been fixed. Mr. Francisco noted the appeal is for the Order to Vacate. Mr. Whitfield made a motion to grant an extension to October 17, 2017, seconded by Ms. Werner. Extension granted. All Yes. 5. 15 Seedorf Issue#EN17-02071 Code Compliance Officer: Yolanda Johnson Property owner, Helen Anderson, present. Yolanda Johnson, Code Officer, stated the violations were exterior in nature. Ms. Johnson recommended a 30-day extension. Ms. Anderson stated a thirty- day extension would work for her. Mr. Whitfield made a motion to grant an extension to September 19, 2017, seconded by Ms. Werner. Extension granted. All Yes. 6. 133 Seedorf Issue#EN17-02081 Code Compliance Officer: Yolanda Johnson Property owner, Stephen Jenkins, not present. Yolanda Johnson, Code Officer, stated the violations were exterior in nature. Ms. Werner made a motion to affirm the order as written, seconded by Mr. Chubinski. Affirmed. All Yes.
