BOARD OF APPEALS HEARING MINUTES OCTOBER 18, 2017 CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 Call to Order: 1:05pm Roll Call for Board Members: John Sims, Eric Blair, Robert Whitfield Staff Members Present: Jason Francisco, Code Compliance Manager; Don Wilkinson, Building Official; Eric Morris, Senior Code Officer; Yolanda Johnson, Senior Code Officer; Lisa Silkworth, Secretary; Richard Bolek, Chief Building Official Additions/Deletions to the Agenda: Remove 131 Spring and 247 N Bedford Approval of Minutes: Mr. Sims made a motion to approve the minutes from the September 20, 2017 meeting, seconded by Mr. Blair. Approved Old Business: none Dangerous Buildings Show Cause Hearings: a. 125 Hubbard (Garage Only) Issue#EN17-07025 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Official, stated the owner had pulled a permit to take the garage down. Mr. Wilkinson recommended granting until November 14, 2017. Mr. Blair made a motion to grant an extension to November 14, 2017, seconded by Mr. Sims. Extension granted. All Yes b. 105 Maryland Dr (House) Issue#EN17-07024 Building Inspector: Don Wilkinson Housing Board of Appeals October 18, 2017 Page 2 of 5 Property owner, not present. Don Wilkinson, Building Official, stated the property was damaged by fire. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Sims made a motion to affirm the property as a Dangerous Building, seconded by Mr. Blair. Affirmed. All Yes c. 125 Post Ave (House) Issue#EN17-07137 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Official, stated the property has been vacant, lacks utilities and lacks maintenance. Mr. Wilkinson recommended affirming the property Dangerous Building. Mr. Blair made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Affirmed. All Yes d. 201 Post Ave (House) Issue#EN17-07016 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Official, stated the property was severley damaged when an automobile ran into it. Mr. Wilkinson noted the owner has applied for a demolition permit and is waiting for cut and cap confirmation. Mr. Wilkinson recommended affirming the property Dangerous Building. Mr. Sims made a motion to grant an extension to November 14, 2017, seconded by Mr. Blair. Extension granted. All Yes e. 131 Spring Issue#EN17-07019 Building Inspector: Don Wilkinson Housing Board of Appeals October 18, 2017 Page 3 of 5 REMOVED f. 59 E Territorial (House) Issue#EN17-07020 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Official, stated the property was damaged by fire and has been vacant for over 180 days. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Blair made a motion to affirm the property as a Dangerous Building, seconded by Mr. Sims. Extension granted. All Yes g. 50/52 Willow (House) Issue#EN17-07017 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Official, stated the property was damaged by fire. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Sims made a motion to affirm the property as a Dangerous Building, seconded by Mr. Blair. Affirmed. All Yes New Business: 1. 84 S Cedar Issue#EN17-07847 Code Compliance Officer: Yolanda Johnson Property Owner, Michael Phelps, present. Yolanda Johnson, Senior Code Officer, noted that the violations were exterior in nature and some work had been completed. Ms. Johnson stated the owner was applying for the Paint Program. Mr. Phelps stated he needed more time. Mr. Blair made a motion to grant an extension to April 17, 2018, seconded by Mr. Sims. Extension Granted. Housing Board of Appeals October 18, 2017 Page 4 of 5 All Yes 2. 47 Grand Trunk Ave Issue#EN16-11559 Code Compliance Officer: JR Belmore Property owner, Ron Vanderwall, present. Eric Morris, Senior Code Officer, stated the violations were exterior in nature. Mr. Morris recommended affirming the order as written. Mr. Vanderwall stated he intends to side the building next year. Mr. Francisco pointed out that our records show Behnke Warehousing as the owner. Mr. Vanderwall stated he is intending to put up metal siding. Mr. Blair made a motion to grant an extension to July 17, 2018, seconded by Mr. Sims. Extension granted. Sims-Y Blair-Y Whitfield-N 3. 142 Morgan Ave Issue#EN17-07450 Code Compliance Officer: Eric Morris Property owner, Linda Lang, present. Eric Morris, Senior Compliance Officer, stated the violations were exterior and small in nature. Mrs. Lang stated she would like to apply for the Paint Program and is seeking help to do the work. Mrs. Lang intends to paint the garage door and some other areas around her house. Mr. Morris recommended affirming the order as written. Mr. Francisco stated he would assist Mrs. Lang in getting the paint. Mr. Blair made a motion to grant an extension to October 30, 2017, seconded by Mr. Sims. Extension granted. All Yes 4. 247 N Bedford Issue#EN17-05941 Code Compliance Officer: Eric Morris REMOVED Housing Board of Appeals October 18, 2017 Page 5 of 5 Public Comments: none Board and Staff Members Comments: Mr. Whitfield made a comment about keeping the extensions uniform. Mr. Blair made a comment about the Board using judgement. Mr. Wilkinson introduced Richard Bolek, Chief Building Official.
