BOARD OF APPEALS HEARING MINUTES FEBRUARY 21, 2018 CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 Call to Order: 1:00pm Roll Call for Board Members: Stan Chubinski, Eric Blair, Kara Werner, Robert Whitfield, John Sims Staff Members Present: Jason Francisco, Code Compliance Manager; Don Wilkinson, Building Official; Tom Engels, Senior Code Officer; Lisa Silkworth, Secretary Additions/Deletions to the Agenda: none Approval of Minutes: Mr. Blair made a motion to approve the minutes from the January 17, 2018 meeting, seconded by Mr. Sims. Approved Election of Officers: Mr. Whitfield made a motion to nominate Mr. Blair for Chair Person, seconded by Mr. Chubinski. The Board voted all yes. Mr. Blair has been elected as Chair. Mr. Whitfield nominates Mr. Sims as Vice Chair, seconded by Mr. Blair. Mr. Sims has been elected as Vice Chair. Old Business: none Dangerous Buildings Show Cause Hearings: a. 125 Clay Issue#EN17-12681 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Official, stated the house has been vacant and is in of several repairs which will require permits. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Whitfield made a motion to affirm the property as a Dangerous Building, seconded by Mr. Chubinski. Affirmed. Don Wilkinson, Building Official, stated the house was damaged by fire. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Sims made a motion to affirm the property as a Dangerous Building, seconded by Mr. Whitfield. Affirmed. All Yes c. 65 Meadowlawn Issue#EN17-12682 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Official, stated the house was damaged by fire. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Sims made a motion to affirm the property as a Dangerous Building, seconded by Mr. Whitfield. Affirmed. All Yes New Business: 1. 231 South Ave Issue#EN17-13079 Code Officer: Thomas Engels Property owner, not present. Jason Francisco. Code Compliance Manager, stated the property ownership was in question. John Kenefick brought in paperwork showing a deed from Mrs. White to John Kenefick. Marcel Stoetzel, City Attorney, attempted to clear up title questions. Mr. Kenefick commented about the definition ownership. Mr. Kenefick stated the window and fence have been repaired. Mr. Kenefick handed photos to the Board. Mr. Kenefick questioned where the pictures were taken from. Mr. Whitfield made a Housing Board of Appeals February 21, 2018 Page 3 of 3 motion to grant an extension to March 20, 2018, seconded by Mr. Sims. Extension granted. All Yes Public Comments: Mr. Kenefick commented and read a statement. Board and Staff Members Comments: Mr. Whitfield commented.
