BOARD OF APPEALS HEARING MINUTES JUNE 20, 2018 CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 Call to Order: 1:02pm Roll Call for Board Members: Kara Werner, Stan Chubinski, Robert Whitfield, John Sims Staff Members Present: Eric Morris, Senior Code Officer; James Belmore, Code Officer; Yolanda Johnson, Senior Code Officer; Don Wilkinson, Building Official; Jason Francisco, Code Compliance Manager; Lisa Silkworth, Secretary Additions/Deletions to the Agenda: none Approval of Minutes: Mr. Chubinski made a motion to approve the minutes from the May 16, 2018, seconded by Mr. Whitfield. Approved Dangerous Buildings Show Cause Hearings: a. 517 Lakeview (House) Issue#EN18-04429 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Official, stated the house has been vacant for over 180 days, lacks utilities, and lacks maintenance. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Ms. Werner made a motion to affirm the property as a Dangerous Building, seconded by Mr. Chubinski. Affirmed. All Yes b. 122 North Ave (House) Issue#EN18-04440 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Official, stated the house has been vacant for over 180 days, lacks utilities, and lacks maintenance. Mr. Wilkinson recommended affirming the property as a Housing Board of Appeals June 20, 2018 Page 2 of 5 Dangerous Building. . Mr. Chubinski made a motion to affirm the property as a Dangerous Building, seconded by Mr. Whitfield. Affirmed. Don Wilkinson, Building Official, stated the house has been vacant for over 180 days, lacks utilities, and lacks maintenance. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Whitfield made a motion to affirm the property as a Dangerous Building, seconded by Ms. Werner. Affirmed. Don Wilkinson, Building Official, stated the house has been vacant for over 180 days, lacks utilities, and lacks maintenance. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Whitfield made a motion to affirm the property as a Dangerous Building, seconded by Mr. Chubinski. Affirmed. All Yes g. 73 Fremont Issue#EN18-04544 Building Inspector: Don Wilkinson Property owner, not present. Don Wilkinson, Building Official, stated the house was damaged by fire and repairs have not been completed. Mr. Wilkinson recommended affirming the property as a Dangerous Building. Mr. Rogers stated the property was sold on an unrecorded land contract in 2017. Mr. Rogers stated some work has been done but all repairs have not been completed. Mr. Rogers stated he would like to convert it into a single family home. Ms. Werner noted Mr. Rogers has recorded the land contract now. Mr. Chubinski made a motion to affirm the property as a Dangerous Building, seconded by Mr. Whitfield. Affirmed. All Yes New Business: 1. 9 Summer Issue#EN18-03496 Code Officer: Eric Morris Property owner, Steve Jenkins, present. Eric Morris, Senior Code Officer, stated the repairs were exterior in nature. Mr. Jenkins stated he needed more time to complete the repairs. All Yes 2. 28 Ferndale Ct Issue#EN18-05167 Code Officer: James Belmore Property owner, Michael Lyle Correll, present. James Belmore, Code Officer, stated the violations were exterior in nature and have been 90% complete. Mr. Correll noted he can have the repairs done by the original date. Ms. Werner made a motion to affirm the order as written, seconded by Mr. Whitfield. Affirmed. All Yes 3. 133 Harris IssueEN#18-01821 Code Officer: James Belmore Property owner, Vera Small, present. James Belmore, Code Officer, stated the violations were exterior in nature. Ms. Small stated he son would be helping her but needed more time. Ms. Werner made a motion to grant an extension to August 14, 2018, seconded by Mr. Whitfield. Extension granted. All Yes 4. 369 Capital Ave SW Issue#EN18-02978 Code Officer: Yolanda Johnson Property owner, not present. Yolanda Johnson, Senior Code Officer, stated the violations were exterior in nature. Ms. Johnson noted some progress has been made. Mr. Whitfield made a motion to affirm the order as written due to no owner present, seconded by Ms. Werner. Affirmed. Housing Board of Appeals June 20, 2018 Page 5 of 5 All Yes 5. 31 Eldred Issue#EN18-04060 Code Officer: Yolanda Johnson Property owner, Valante Mejia, present. Yolanda Johnson, Senior Code Officer, noted the violations were exterior in nature. Ms. Johnson stated work had not been completed. Ms. Mejia stated they were unsure of the work to be done. Mr. Mejia requested more time. Ms. Werner made a motion to grant an extension to July 17, 2018, seconded by Mr. Chubinski. Extension granted. All Yes Public Comments: none Board and Staff Members Comments: Ms. Werner had a question about 73 Fremont. Mr. Wilkinson explained.
