DANGEROUS BUILDINGS HEARING NOTICE AND AGENDA Minutes April 11, 2012 1:00 P.M. CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 1. Call to Order: Carman Hamilton, Hearing Officer, called the meeting to order at 1:08pm. 2. Roll Call: Carman Hamilton 3. Staff Members Present: Dennis McKinley, Code Compliance Administrator and Lisa Silkworth 4. Additions/Deletions to the Agenda: none 5. New Business: none a. 1860 W. Columbia Ave Issue #EN12-02155 Code Compliance Administrator: Dennis McKinley Owner Gary Robbins was present. He is waiting for the insurance check to come. He plans on repairing the building. Carman Hamilton asked if there were any comments. Hearing none, Mr. Hamilton stated this property is affirmed as a Dangerous Building and represents a hazardous condition in the neighborhood and the community as a whole; therefore, the Board will grant the property owner (30) thirty days to bring it into compliance and/or demolish the structure. b. 31 W. Fountain Issue #EN11-21972 Code Compliance Administrator: Dennis McKinley Owner not present Dennis McKinley, Code Compliance Administrator, reported an inspection was conducted and the following violations were identified per the City of Battle Creek’s, Chapter 1454, Codified Ordinances. Dangerous Buildings Hearing April 11, 2012 Page 2 of 4 1454.01(2) . . . A portion of the building or structure is damaged by fire, wind, flood, or other cause so that the structural strength or stability is appreciably less than it was before the act and the building code of the city for a new building or structure, purpose or location. 1454.01(6) . . . The building, structure, or a part of the building or structure is manifestly unsafe for the purpose for which it is used. 1454.01(7). . . The building or structure is damaged by fire, wind or flood, or is dilapidated or deteriorated and becomes an attractive nuisance to children who might play in the building or structure to their danger, or becomes a harbor for vagrants, criminal, or immoral persons, or enables persons to resort to the building or structure for committing a nuisance or an unlawful or immoral act. Carman Hamilton asked if there were any comments. Hearing none, Mr. Hamilton stated this property is affirmed as a Dangerous Building and represents a hazardous condition in the neighborhood and the community as a whole; therefore, the Board will grant the property owner (30) thirty days to bring it into compliance and/or demolish the structure. c. 89 Frelinghuysen Issue #EN12-021341860 Code Compliance Administrator: Dennis McKinley Home Owner was not present but a neighbor was present. They would like to see the house taken care of because it is open for entry. The owner is trying to sell it and gives the lock box code out. Carman Hamilton asked if there were any comments. Hearing none, Mr. Hamilton stated this property is affirmed as a Dangerous Building and represents a hazardous condition in the neighborhood and the community as a whole; therefore, the Board will grant the property owner (30) thirty days to bring it into compliance and/or demolish the structure. d. 246 Greenwood Ave Issue#EN12-02246 Code Compliance Administrator: Dennis McKinley Carman Hamilton asked if there were any comments. Hearing none, Mr. Hamilton stated this property is affirmed as a Dangerous Building and represents a hazardous condition in the neighborhood and the community as a whole; therefore, the Board will grant the property owner (30) thirty days to bring it into compliance and/or demolish the structure. Hearing none, Mr. Hamilton stated this property is affirmed as a Dangerous Building and represents a hazardous condition in the neighborhood and the community as a whole; therefore, the Board will grant the property owner (30) thirty days to bring it into compliance and/or demolish the structure. 6.
