DANGEROUS BUILDINGS MINUTES January 9, 2013 1:00 P.M. CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 1. Call to Order: 1:00pm 2. Roll Call: Carman Hamilton 3. Staff Members Present: Dennis McKinley, Code Compliance Administrator and Lisa Silkworth, Secretary 4. Additions/Deletions to the Agenda: n/a 5. Approval of Minutes: approved 6. New Business: a. 32 Battle Creek Ave (House/Apt Bldg) Issue #EN12-08389 Code Compliance Administrator: Dennis McKinley Property Owner, not present. Dennis McKinley, Code Compliance Administrator, noted the building has been vacant, has no water service and lacks property maintenance. Mr. McKinley has not been in contact with the building owner. Mr. McKinley recommended affirming it as a dangerous building. Mr. Hamilton affirmed it as a dangerous building and granted 30 days to bring it into compliance. b. 38 Battle Creek Ave (House/Apt Bldg) Issue#EN12-08387 Code Compliance Administrator: Dennis McKinley Dangerous Buildings Hearing January 9, 2013 Page 2 of 4 Property Owner, not present. Dennis McKinley, Code Compliance Administrator, noted the building has been vacant, has no water service and lacks property maintenance. Mr. McKinley has not been in contact with the building owner. Mr. McKinley recommended affirming it as a dangerous building. Mr. Hamilton affirmed it as a dangerous building and granted 30 days to bring it into compliance. c. 111 Battle Creek Ave (House Only) Issue #EN12-08370 Code Compliance Administrator: Dennis McKinley Property Owner, Gaby Fernandez, present. Dennis McKinley, Code Compliance Administrator, reported the house sustained extensive damage from a fire on November 8, 2012. The city has been inside the structure and all four permits need to be pulled. Mr. McKinley has been in contact with the home owner and they plan on repairing the house. Mr. McKinley recommended affirming it as a dangerous building and granting 60 days to bring it into compliance. Ms. Fernandez stated she has been in contact with some contractors and the electrician has already pulled a permit. Ms. Fernandez has also been working with her insurance company and they are aware she is repairing the property. She is requesting more time due to some personal issues. Mr. Hamilton affirmed it as a dangerous building and granted 60 days to bring it into compliance. d. 23 Bernardo Pl (House Only) Issue#EN12-08271 Code Compliance Administrator: Dennis McKinley Property Owner, not present. Dennis McKinley, Code Compliance Administrator, noted the building has been vacant, has no water service and lacks property maintenance. Mr. McKinley has not been in contact with the building owner. Mr. McKinley recommended affirming it as a dangerous building. Mr. Hamilton affirmed it as a dangerous building and granted 30 days to bring it into compliance. e. 610 Capital Ave SW (Commercial Structure) Issue#EN08-05165 Code Compliance Administrator: Dennis McKinley Dangerous Buildings Hearing January 9, 2013 Page 3 of 4 Property Owner, Harpal Singh, present. Dennis McKinley, Code Compliance Administrator, noted the building has been vacant, has no water service and lacks property maintenance. Mr. McKinley recommends affirming as a dangerous building and granting 30 days to bring it into compliance. Mr. Singh stated he is currently trying to rent the property and get a business in there. He maintains the property and makes sure it is secured. He works across the street so he can watch it every day. He stated it is not dangerous or in disrepair and requested atleast 60 days to bring it into compliance. Mr. McKinley explained the dangerous building ordinance and changed his recommendation to 60 days. Mr. Hamilton affirmed it as a dangerous building and granted 60 days to bring it into compliance. f. 154 Harris Ave (House & Shed) Issue#EN12-08391 Code Compliance Administrator: Dennis McKinley Property Owner, not present. Dennis McKinley, Code Compliance Administrator, noted the building has been vacant, has no water service and lacks property maintenance. Mr. McKinley has not been in contact with the building owner. Mr. McKinley recommended affirming it as a dangerous building. Mr. Hamilton affirmed it as a dangerous building and granted 30 days to bring it into compliance. g. 797 E Michigan Ave (House) Issue#EN11-10146 Code Compliance Administrator: Dennis McKinley Porperty Owner, Tammy Reed, present. Dennis McKinley, Code Compliance Administrator, noted the building has been vacant, has no water service and lacks property maintenance. Mr. McKinley recommends affirming as a dangerous building and granting 60 days to bring it into compliance since the owner has been in contact with him. Ms. Reed stated she bought the property from the Calhoun County Land Bank Tax Sale and did not know about the condition of the property. Ms. Reed plans on taking care of the trees that are down and finding a buyer that will fix the property up and live in the home. Ms. Reed noted she would bring the property into compliance if she cannot find a buyer. Mr. Hamilton affirmed it as a dangerous building and granted 60 days to bring it into compliance. h. 52 Riverview Ave (House & Detached Garage) Dangerous Buildings Hearing January 9, 2013 Page 4 of 4 Issue#EN12-02945 Code Compliance Administrator: Dennis McKinley Property Owner, not present. Dennis McKinley, Code Compliance Administrator, noted the building has been vacant, has no water service and lacks property maintenance. Mr. McKinley has not been in contact with the building owner. Mr. McKinley recommended affirming it as a dangerous building. Mr. Hamilton affirmed it as a dangerous building and granted 30 days to bring it into compliance. 7. Public Comments: Ms. Fernandez questioned what happens to the properties once they have been through the DB process and the vacant lots where houses have been torn down. Lisa Silkworth explained that the property owners retain the ownership rights. Ms. Silkworth stated she could contact the Calhoun County Land Bank on the vacant lots. 8. Board and Staff Members Comments: Mr. McKinley explained why he recommended 60 days for three properties. 9. Adjournment: 1:50pm The City of Battle Creek will provide necessary reasonable auxiliary aids and services, such as signers for the hearing impaired and audiotapes of printed materials being considered in the meeting upon reasonable notice to the City of Battle Creek.
