DANGEROUS BUILDINGS HEARING MINUTES February 13, 2013 1:00 P.M. CITY HALL 10 N. DIVISION STREET COMMISSION CHAMBERS 3RD FLOOR – ROOM 301 BATTLE CREEK MI 49014 1. Call to Order: 1:00pm 2. Roll Call: Carman Hamilton 3. Staff Members Present: Dennis McKinley, Code Compliance Administrator and Lisa Silkworth, Secretary 4. Additions/Deletions to the Agenda: 485 Parkway 5. Approval of Minutes: January Minutes - Approved 6. New Business: a. 66 S 22nd St (House) Issue#EN12-05603 Code Compliance Administrator: Dennis McKinley Property Owner, Mary McLean, present. Mr. McKinley, Code Compliance Administrator, gave his report and stated the house was severely damaged by fire in 2012. The City is holding fire escrow funds. Mr. McKinley has spoken with the property owner and one permit has been pulled in 2013. Mr. McKinley recommended affirming it as a dangerous building and grant 90 days to bring it into compliance. Ms. McLean states she has been going around with the mortgage company about doing the repairs. She is in regular contact with her mortgage company. Ms. McLean noted the clean-up has been completed. Ms. McLean stated only one unit sustained damage in the fire. Mr. McKinley amends the recommendation to 30 days to hurry the mortgage along. Mr. Hamilton affirms it as a dangerous building and grants 30 days to bring it into compliance. Dangerous Buildings Hearing February 13, 2013 Page 2 of 4 b. 285 Capital Ave SW (Commercial) Issue#EN11-15635 Code Compliance Administrator: Dennis McKinley Property Owner, not present. Mr. McKinley gave his report and noted the property has been vacant, has no water service, and lacks property maintenance. Mr. McKinley also noted there are broken windows. Mr. McKinley recommends affirming it as a dangerous building and grant 30 days to bring it into compliance. Mr. Hamilton affirms it as a dangerous building and granted 30 days to bring it into compliance. c. 45 Liberty (Commercial) Issue #EN12-05908 Code Compliance Administrator: Dennis McKinley Property Owner, Ken Lane as Representative, present. Mr. Lane stated the property is for sale and the owner, West Michigan Investment Properties LLC, is trying to keep up on the maintenance. Dennis McKinley, Code Compliance Administrator, gave his report. The Building Inspector has been inside and did a safety inspection. The property is currently in need of repair. Mr. McKinley recommended affirming it as a dangerous building and grant 30 days to bring it into compliance. Mr. Lane states they will keep paying the taxes and maintain the outside of the building. Mr. Hamilton affirms it as a dangerous building and granted 30 days to bring it into compliance. d. 123 W. Manchester (House) Issue#EN13-00007 Code Compliance Administrator: Dennis McKinley Property Owner, not present. Mr. McKinley gave his report and noted the property has been vacant, has no water service, and lacks property maintenance. Mr. McKinley has been in contact with the owner who stated the property is for sale as is. Mr. McKinley recommends affirming it as a dangerous building and grant 30 days to bring it into compliance. Michigan Ave (Commercial) Issue#EN12-06700 Code Compliance Administrator: Dennis McKinley Property Owner, Parker Fields, Partner for the LLC, present. Mr. McKinley, Code Compliance Administrator, gave his report and noted the property has been vacant for more than 180 days and lacks property maintenance. Mr. McKinley stated he has been in contact with the owner and recommends affirming it as a dangerous building and grant 60 days to bring it into compliance. Mr. Fields stated there were tenants in the building one year ago. He has added a security lights, alarm system and some other cosmetic upgrades. There are 24 units upstairs and the tenants had let people stay there. In 1991 he put about $335,000 into that building. Mr. Fields stated the building is for sale and there is an offer for the building. Mr. Hamilton affirms it as a dangerous building and granted 60 days to bring it into compliance. f. 17 Young (House) Issue#EN12-08622 Code Compliance Administrator: Dennis McKinley Property Owner, not present. Mr. McKinley gave his report and noted the property has been severely damaged by fire on November 29, 2012. Mr. McKinley recommends affirming it as a dangerous building and grant 30 days to bring it into compliance. Mr. Hamilton affirms it as a dangerous building and granted 30 days to bring it into compliance. 7. Public Comments: n/a 8.
