CITY COUNCIL MEETING MINUTES Tuesday, April 01, 2025 at 7:00 PM Baxter City Hall, 13190 Memorywood Drive, Baxter, MN “A Growing Community” CALL TO ORDER Mayor Olson called the meeting to order at 7:00 p.m. ROLL CALL Mayor Darrel Olson and Council Members Connie Lyscio, Zach Tabatt, Patrick Sundberg, and Mark Cross were present. City Administrator Brad Chapulis, Assistant City Administrator Kelly Steele, Finance Director Jeremy Vacinek, and Public Works Director Trevor Walter were present PLEDGE OF ALLEGIANCE All joined Mayor Olson in reciting the Pledge of Allegiance. PRESENTATIONS None. ADDITIONS OR CHANGES TO THE AGENDA City Administrator Chapulis asked the council to add item 12 Adopting Resolution 2025-040, approve the sale of lots 3 & 5, block 2, Cedar Scenic Second Addition and authorize the mayor to execute all necessary documentation related to the sale and add item 13 appoint election judges for the April 15, 2025 Primary Election and April 29, 2025 Special Election. PUBLIC COMMENTS - Comments received from the public may be placed on a future meeting agenda for consideration. None. CONSENT AGENDA - The following items are considered non-controversial by staff and are recommended to be read and passed in one motion. Any council person, staff, citizen, or meeting attendee can request one or more items be pulled from the Consent Agenda and the item will be pulled and addressed immediately after the passage of the Consent Agenda; otherwise, the following items will be passed in one motion: 1. Approve City Council Minutes from March 18, 2025 2. Approve the Payment of Bills and Finance Report (Addendum A) 3. Approve Temporary Liquor License Amendment to Jack Pine Brewery for three Events to be Held in 2025 4. Approve Permit for Retail Sales of Fireworks for Costco, Cub Foods, Target, and Walmart for the period of May 1, 2025 through April 30, 2026 4/1/2025 City Council Meeting Minutes Page 2 5. Approve Special Event Application for Lakes Area Youth Soccer Association to hold the MNUFC Youth Soccer Camp at Southdale Park Soccer Fields on June 5-6, 2025 6. Accept the 2028 Olivewood Drive Area and Jadewood Drive & Jewelwood Drive Utility and Roadway Improvements Feasibility Report, Municipal Project No. 4142 8. Adopt Resolution 2025-037 Authorizing Advancement of Municipal State Aid Funds for the 2022 TH 210/Inglewood Drive Road Improvement Project and the 2025 Design Road & TH 371 Stormwater Improvements Project 9. Approve the Clearwater Road Dog Park Plans and Specifications and Authorize Advertisement for Bids 10. Adopt City Donation Policy and Dog Park Donation Program 11. Authorize City Staff to Execute and Submit Letter to Crow Wing County Requesting a Delay of the 2026 County Road 170 / Mapleton Road Mill and Overlay Project 12. Adopt Resolution 2025-040 Approving the Sale of Lots 3 & 5, Block 2, Cedar Scenic Second Addition and Authorize the Mayor to Execute All Necessary Documentation Related to the Sale 13. Appoint Election Judges for the April 15, 2025 Primary Election and April 29, 2025, Special Election Council Member Sundberg asked to pull item 3, Approve Temporary Liquor License Amendment to Jack Pine Brewery for three Events to be Held in 2025. MOTION by Council Member Cross, seconded by Council Member Sundberg to approve the consent agenda as amended. Motion carried unanimously. PULLED AGENDA ITEMS Council Member Sundberg asked to pull item 3, Approve Temporary Liquor License Amendment to Jack Pine Brewery for three Events to be Held in 2025, to abstain from voting on the agenda item. MOTION by Council Member Cross, seconded by Council Member Lyscio to approve the Temporary Liquor License Amendment to Jack Pine Brewery for three Events to be Held in 2025. Motion carried with Mayor Olson and Council Members Cross and Tabatt voting yes. Council Member Sundberg abstained. OTHER BUSINESS 14. Adopt Resolution 2025-036 Awarding Contract B in the amount of $1,124,854.10 to Pratt’s Affordable Excavating for Raw Watermain and Electrical Improvements related to the 2025 Water Supply Improvements - Wells 5 & 6, Municipal Project No. 6011-45040 Neil Heinonen, with SEH, explained he has been assisting the city with the 2025 water supply improvements. The project includes three contracts to contractors and suppliers to expedite the construction timeline. Tonight, staff is looking for the council to award contract B for the raw watermain and electrical improvements. SEH and staff recommend awarding the contract to the low bidder, Pratt’s Affordable Excavating, Inc. in the amount of $1,124,854. 4/1/2025 City Council Meeting Minutes Page 3 The recommendation includes awarding both alternates for the project. Alternate 1 includes a credit of $40,000 to utilize butterfly valves instead of gate valves on the 20” raw watermain. Alternate 2 includes a $100,469 addition to the bid to mill and overlay the parking area for the water treatment plant and public works facility. The bids were favorable. City Administrator Chapulis explained the paving is for areas that are currently paved not to pave unpaved areas. Public Works Director Walter explained that awarding bid alternate 2 will require transferring funds from the five departments utilizing the facility. He will reprioritize projects to pay for the paving project. MOTION by Council Member Cross, seconded by Council Member Tabatt to Adopt Resolution 2025-036 Awarding Contract B in the amount of $1,124,854.10 to Pratt’s Affordable Excavating for Raw Watermain and Electrical Improvements related to the 2025 Water Supply Improvements - Wells 5 & 6, Municipal Project No. 6011-45040. Motion carried unanimously. 15. Reschedule April 15, 2025 Council Meeting Due to the Primary Election for Senate District 6 City Administrator Chapulis explained Governor Walz issued a writ of special election to fill a vacancy in Senate District 6. A special election to fill the vacancy will be held on Tuesday, April 29th. If necessary, a special primary election for nomination of candidates will be held on Tuesday, April 15th. Based on the number of individuals that have expressed interest in filling, staff is assuming a primary election on April 15th will be needed. Because of this, the regularly scheduled council meeting on April 15th will need to be rescheduled. MOTION by Council Member Cross, seconded by Council Member Lyscio to move the April 15th council meeting to April 16th due to the primary election being held on April 15th. Motion carried unanimously. COUNCIL COMMENTS 16. Connie Lyscio – No comment. 17. Zach Tabatt – Expressed appreciation to the volunteer firefighters and Baxter police department for responding to a fire. 18. Patrick Sundberg – No comment. 19. Mark Cross – No comment. 20. Darrel Olson – No comment. CITY ADMINISTRATOR'S REPORT City Administrator Chapulis reminded the council of the May 8th Brainerd Lakes Area Economic Development Corporation annual meeting.
