CITY COUNCIL MEETING MINUTES Tuesday, May 06, 2025 at 7:00 PM Baxter City Hall, 13190 Memorywood Drive, Baxter, MN “A Growing Community” CALL TO ORDER Mayor Olson called the meeting to order at 7:00 p.m. ROLL CALL Mayor Darrel Olson and Council Members Connie Lyscio, Zach Tabatt, Patrick Sundberg, and Mark Cross were present. City Administrator Brad Chapulis, Assistant City Administrator Kelly Steele, Finance Director Jeremy Vacinek, Community Development Director Josh Doty, Police Chief Matt Maier, and Public Works Director Trevor Walter were present. PLEDGE OF ALLEGIANCE All joined Mayor Olson in reciting the Pledge of Allegiance. PRESENTATIONS None. ADDITIONS OR CHANGES TO THE AGENDA City Administrator Chapulis explained item 9 should be pulled due to not having time to discuss during the work session and the item will be added to a future work session. Consent item 17 notes the incorrect project number on the agenda. The correct project number 4135. PUBLIC COMMENTS - Comments received from the public may be placed on a future meeting agenda for consideration. Dave Lange, 13838 Cherrywood Drive, explained he stopped at city hall to get a building permit for a shed, and he was told by staff that he is unable to build the shed due to its size. Mr. Lange asked the council if there is a way he can build the shed. Mr. Lange also explained that he is still being charged a storm water fee, and he does not have storm water. Joan Schut, 12563 Savannah Oak, explained her neighbors learned a home on Second Street has recently sold and will be used as a safe house. The neighbors are concerned if people will be sleeping overnight and if there will be increased traffic. CONSENT AGENDA - The following items are considered non-controversial by staff and are recommended to be read and passed in one motion. Any council person, staff, citizen, or meeting attendee can request one or more items be pulled from the Consent Agenda and the item will be pulled and addressed immediately after the passage of the Consent Agenda; otherwise, the following items will be passed in one motion: 1. Approve the Payment of Bills and Finance Report (Addendum A) 4. Appoint Mr. Kolbie Bernu to the Position of Engineering Intern 5. Approve Appointment to the Seasonal Position of Park Attendant 6. Approve a Peddler License for Renewal by Anderson 7. Approve Special Event Application for Brainerd Family YMCA Kids Triathlon to be held on August 23, 2025 at Whipple Beach Recreation Area 8. Approve Special Event Application for Brainerd Baxter Baseball Association for their Battle at the Lakes Baseball Tournament on June 6-8, June 13-15, and June 20-22 at Oscar Kristofferson Park Ball Fields 9. Accept the 2030 Welton Road, Ashley Road, Baywood Road, Black Oak Road and Springwood Drive Area Utility and Roadway Improvements, Municipal Project CPF 4143 Feasibility Report 10. Accept the Cypress Drive and Greenwood Road – Bus Stop Red Flashing Lights Stop Compliance Memo and installation of both types of traffic signs 11. Accept the Cemetery Commission Minutes from April 21, 2025 12. Approve the revised cemetery regulations 13. Approve the Baxter Cemetery Second Addition Preliminary & Final Plat 14. Accept the Special Utilities Commission Minutes from April 23, 2025 15. Approve Amendment to the Cooperative Agreement with Great River Greening to allow a Controlled Burn of the Jack Pine Savanna at Mississippi River Overlook Park 16. Accept Donation from the Greater Lakes Association of Realtors for a Community Entrance Kiosk Map on Paris Road and Forestivew Drive 17. Adopt Resolution 2025-044 to enter into the Cooperative Construction Agreement with MNDOT and the City of Baxter for SP 1810-120 & SP 230-080-002 for the 2024 Design Road & T.H. 371 Stormwater Improvements Project, Municipal Project No. 4312 18. Approve Renewal of Joint Powers Agreement with the Minnesota Human Trafficking Task Force 19. Adopt Ordinance 2025-005 approving amendments to the Curfew Ordinance 20. Approve the Astech Corporation Street Crack Sealing Contract in the Not-to-Exceed Amount of $140,000 21. Schedule the Annual Storm Water Public Informational Meeting for Tuesday, June 3, 2025, at 7:00 p.m. or shortly thereafter 22. Approve Temporary Liquor License for the Brainerd Jaycees Special Event at Mills GMC 5/6/2025 City Council Meeting Minutes Page 3 23. Approve $15,000 Police Department Facility Improvements from Existing Budget Remaining for Furniture Replacement MOTION by Council Member Cross, seconded by Council Member Tabatt to approve the consent agenda as amended. Motion carried unanimously. PULLED AGENDA ITEMS Council Member Cross asked to pull item 9 due to not having time during the work session to discuss the topic. MOTION by Council Member Cross, seconded by Council Member Lyscio to table item 9 until a future council work session. Motion carried unanimously. Council Member Tabatt explained the council has not discussed item 10 and he would like to pull the item for discussion. Council Member Cross explained the sign is a printed sign which notifies motorists to stop for school buses. MOTION by Council Member Tabatt, seconded by Council Member Cross to Accept the Cypress Drive and Greenwood Road – Bus Stop Red Flashing Lights Stop Compliance Memo and installation of both types of traffic signs. Motion carried unanimously. OTHER BUSINESS 24. Approve the Clearwater Road Dog Park Budget of $374,973.00 and Award the Construction Contract to Tretter Trucking & Excavating, Inc. for the Unit Price Bid of $165,612.84 Aric Welch, with Widseth, explained six bids for the dog park were received. The bids were conforming to the plans, specifications and advertisements. If the council wishes to continue with the project, Widseth is recommending awarding the construction contact to Tetter Trucking and Excavating, Inc. of Brainerd for their unit price bid of $165,612.84. The current project cost estimate, with the low bid unit prices obtained from competitive bidding, shows the project is on budget with approximately $9,200 remaining in contingencies. MOTION by Council Member Lyscio, seconded by Council Member Sundberg to Approve the Clearwater Road Dog Park Budget of $374,973.00 and Award the Construction Contract to Tretter Trucking & Excavating, Inc. for the Unit Price Bid of $165,612.84. Motion carried unanimously. COUNCIL COMMENTS 25. Connie Lyscio – Invited council members to attend the retirement party for the executive director of The Center on May 29th and wished everyone a happy Mother’s Day. 26. Zach Tabatt – No report. 27. Patrick Sundberg – Explained the Northland Arboretum’s new bike track is open for use and has already been very popular. 28. Mark Cross – Reminded motorists to watch out for motorcycles. 29. Darrel Olson -Reminded the council of the special council meeting scheduled for May 8th at 6 p.m. 5/6/2025 City Council Meeting Minutes Page 4 CITY ADMINISTRATOR'S REPORT City Administrator Chapulis explained there is a potential need to hold a special council meeting, but staff is waiting on MnDOT. Should staff not hear back timely from MnDOT, the agenda item will be placed on the May 20th council agenda. CITY ATTORNEY'S REPORT No Report.
