BAXTE]R UTILITIES COMMISSION MEETING AiMINUTES Wednesday, September 07, 2022 at 5: 30 PM Baxter City Hall, 13190 Memorywood Drive, Baxter, MN A Growing Community" CALL TO ORDER The regular meeting of the Baxter Utilities Commission was called to order at 5: 30 p. m. by Chairman Rock Yliniemi. ROLL CALL MEMBERS PRESENT: Commissioner John Brenny, Jack Christofferson, Douglas Stenberg, and Chairman Rock Yliniemi. MEMBERS ABSENT: Council Liaison Mark Cross. STAFF PRESENT: Public Works Director/ City Engineer Trevor Walter, Assistant City Engineer Trevor Thompson, and Administrative Assistant Mary Haugen. OTHERS PRESENT: Bolton& Menk Consulting Engineer Bryan Drown, SEH Consulting Engineer Scott Hedlund& Tom Sohrweide, and WiDSETH Consulting Engineer Aric Welch and Alex Bitter. CONSENT AGENDA 1. Approve the Utilities Commission Meeting Minutes of August 4, 2022 MOTION by Commissioner Stenberg, seconded by Commissioner Christofferson to approve the Utilities Commission Minutes of August 4, 2022. Motion carried unanimously. 2. Approve the Special Utilities Commission Meeting Minutes of August 10, 2022 MOTION by Commissioner Brenny, seconded by Commissioner Stenberg to approve the Utilities Commission Minutes of August 10, 2022. Motion carried unanimously. BUSINESS ITEMS 3. Accept the Wings Financial Municipal Improvements as Outlined in the Development Agreement Assistant City Engineer Thompson stated that Wings Financial has completed the municipal improvements in accordance with the Development Agreement. The one- year warranty period starts when the City accepts the municipal improvements. Motion by Commissioner Brenny, seconded by Commissioner Stenberg to accept the Wings Financial Municipal Improvements as outlined in the Development Agreement contingent on receiving surety to cover the one- year warranty and receiving final as- builts. Motion carried unanimously. 4. Accept the Tri- Ven Municipal Improvements as Outlined in the Development Agreement 9/ 7/ 2022 Utilities Commission Meeting Minutes Page 2 Assistant City Engineer Thompson stated that Tri- Ven has completed the Municipal Improvements in accordance with the Development Agreement. The one- year warranty period starts when City Council accepts the Municipal Improvements, the developer will need to provide surety to cover the one- year warranty period. Final as- builts have been submitted and accepted by staff. Motion by Commissioner Stenberg, seconded by Commissioner Christofferson to accept the Tri- Ven Municipal Improvements as outlined in the Development Agreement contingent on receiving surety to cover the one- year warranty period. Motion carried unanimously. 5. Approve the Menard, Inc. Development Agreement Assistant City Engineer Thompson informed the commission that Menards is proposing to expand their lumber yard and construct a parking lot in the northeast corner of Whispering Woods Lane and Pearl Drive. This agreement was referenced in the recommendation from Utilities Commission and approved as a condition prior to issuing a building permit at the August 16, 2022 City Council meeting. The extent of the Development Agreement is not final yet as staff has not received revised civil plans reflecting the modifications from the original August submittal. Motion by Commissioner Christofferson, seconded by Commissioner Brenny to approve the Menard, Inc. Development Agreement. Motion carried unanimously. 6. Approve the Menard, Inc. Limited Use Agreement Assistant City Engineer Thompson reviewed the Menard, Inc. limited use agreement for the stormwater overflow connection into the City' s storm sewer system on Whispering Woods Lane. Mr. Thompson explained the agreement is to protect the City from liability associated with the connection. Motion by Commissioner Stenberg, seconded by Commissioner Christofferson to approve the Menard, Inc. Limited Use Agreement. Motion carried unanimously. 7. Recommend Approval of the Preliminary& Final Plat of The Lofts at Novotny Assistant City Engineer Thompson reviewed the Corner Lot Development' s Planned Unit Development PUD) request to construct a 64 residential unit development on the corner of Edgewood Drive and Novotny Road. Included with the development will be the extension of Novotny Road west of Edgewood Drive. Novotny Road will be a public road constructed by the Developer. Short Elliott Hendrickson, Inc. ( SEH) was hired by the City on behalf of the Developer to complete a Traffic Impact Study to determine the appropriate build on Novotny Road to ensure it can support future growth to the west. Incorporated into the plat are the utility easements required to install the watermain improvements. The plat includes the required 5' drainage and utility easements on all interior lot lines and 10' on all lot lines adjacent to the road. Public Works Director/ City Engineer Walter stated there is a triangle piece, shown on the plat as 1A, on the north end that is currently owned by the City of Baxter for a stormwater pond. This will be deeded to Corner Lot and the City will have a drainage and utility easement over the area and will be used as a regional pond. 9/ 7/ 2022 Utilities Commission Meeting Minutes Page 3 Motion by Commissioner Stenberg, seconded by Commissioner Christofferson to recommend Planning& Zoning approve the Preliminary Plat contingent on the following conditions: Enter into a Development Agreement with the City for the Municipal Improvements on Lot 1, Block 1, and the for the 2023 Novotny Road Improvements Project. Enter into a Stormwater Facilities Maintenance Agreement with the City prior to issuing a building permit. Enter into a Limited Use Agreement for connecting into the City' s storm sewer system prior to issuing a building permit. Motion carried unanimously. 8. Approve the Corner Lot Development Group Land VI, LLC Development Agreement Assistant City Engineer Thompson informed the commission the Corner Lot Development Agreement addresses watermain and sanitary sewer main improvements, stormwater improvements connecting to the City' s storm sewer system, and the construction of a new road with sewer main, watermain, storm sewer, roadway, and trail improvements. Motion by Commissioner Stenberg, seconded by Commissioner Brenny to approve the Corner Lot Development Group Land VI, LLC Development Agreement. Motion carried unanimously. 9. Approve the Corner Lot Development Group Land VI, LLC Stormwater Facilities Maintenance Agreement Assistant City Engineer Thompson reviewed the Stormwater Facilities Maintenance Agreement for Corner Lot Development. The developer is proposing to build a 64- Unit apartment complex located in the northwest corner of Edgewood Drive and Novotny Road. This is the standard stormwater facilities maintenance agreement the City uses with all development. The stormwater agreement is a requirement of MCM 5 under section 20. 3 of the 2020 Municipal Separate Storm Sewer System Permit. Motion by Commissioner Brenny, seconded by Commissioner Christofferson to approve the Corner Lot Development Group Land VI, LLC Stormwater Facilities Maintenance Agreement. Motion carried unanimously. 10. Approve the Corner Lot Development Group Land VI, LLC Limited Use Agreement Assistant City Engineer Thompson stated the proposed development site improvements include a stormwater overflow structure connecting into the storm sewer system on Edgewood Drive. The Limited Use Agreement is used to protect the City from the liability associated with the storm sewer connection. The agreement is strictly for the storm sewer connection only. Motion by Commissioner Brenny, seconded by Commissioner Stenberg to approve the Corner Lot Development Group Land VI, LLC Limited Use Agreement. Motion carried unanimously. 11. Accept the Novotny Road and Edgewood Drive Traffic Impact Study& Monthly Update Public Works Director/ City Engineer Walter stated that Corner Lot Development Representative had reviewed all of the documents and were in agreement with all the documents, so no representatives were present for the meeting. 9/ 7/ 2022 Utilities Commission Minutes Page 4 Meeting SEH Consulting Engineer Sohrweide reviewed the Novotny Road and Edgewood Drive Traffic Impact The consisted of the conditions, traffic operations, Study. study project overview, existing comprehensive plan and bike & pedestrian plan, future traffic operations and considerations. Mr. Sohrweide explained that a 64- unit apartment complex is proposed to be constructed in the northwest quadrant of Novotny Road and Edgewood Drive. Construction is anticipated to begin in the fall. The primary focus of this traffic impact study is to analyze the existing and future traffic conditions with and without the development conditions to determine the traffic impacts of the development on the following three intersections. Pine Beach Road & Edgewood Drive ( 2- Way Stop on Edgewood Drive) Novotny Road & Edgewood Drive ( Existing 2- Way Stop on Edgewood Drive & 3- Way Stop on Extension when built with WB Free) Woida Road & Edgewood Drive ( 3- Way Stop on Edgewood Drive and Eastbound Woida Road) The recommendations for the study are listed below: Traffic impacts of the development on the three study intersections are negligible in the existing year and 2035. The Edgewood Drive/ Novotny Road intersection in the immediate development site is anticipated to operate well at acceptable LOS A. A 3- lane cross section on an 80' right of way is recommended for Novotny Road Extension with a shared use path on the north side of the road for bicycles and pedestrians. The primary access of the development is on Novotny Road Extension. A second access on Edgewood Drive is recommended as an alternative entrance for not just the residents but also the emergency vehicles when the primary access becomes unavailable due to maintenance, etc. The Edgewood Drive entrance shall be aligned with the Book World driveway on the east side. A short offset alignment would potentially cause safety issues. At this point, the Novotny Road extension is built to provide the primary access to the development. Extend Novotny Road and Lake Forest Road to their intersection when the remainder of the existing site develops. The Edgewood Drive/ Woida Road intersection is anticipated to operate at unacceptable LOS E when all other planned land uses in the study area are developed. Novotny Road should be extended to Inglewood Drive and Lake Forest Road should be extended to Woida Road as development occurs in the immediate area. Keeping in mind that these extensions will positively impact the traffic operations at Edgewood Drive/ Woida Road. The future roadway extensions should be 3- lane as recommended now for Novotny Road. This is due to the forecast traffic volumes and the potential for future development direct access. However, it is recommended that the extension of Novotny Road west of Lake Forest Road be evaluated at the time of future development, since the potential for residential development exists in that area, and a 2- lane road may be sufficient. 9/ 7/ 2022 Utilities Commission Meeting Minutes Page 5 Motion by Commissioner Stenberg, seconded by Commissioner Brenny to accept the Novotny Road and Edgewood Drive Traffic Impact Study. Motion carried unanimously. 12. Approve SEH Contract for Quiet Zone Design, Implementation, and Notification SEH Consulting Engineer Hedlund reviewed the Contract for Quiet Zone Design, Implementation, and Notification. The Scope of Work includes the following tasks: Task 1— Design: Incorporate the previously completed Quiet Zone Feasibility Report into the currently being developed FDR Feasibility Report. Topographic survey of the project area using 3d scanner. Develop construction drawings to complete the recommendations in the Quiet Zone Feasibility Report: o Including Timberwood Drive. o Excluding removal of Knollwood. o Excluding improvements at Inglewood Dr and MN TH 371. o Including signage upgrades on MN TH 210. Draft permits for work within MNDOT and Crow Wing County right of way. Develop technical specifications ( front end documents developed under other proposal). Develop estimated quantities and cost estimate. Answer bidding questions. Review bids and provide recommendation. Task 2— Construction Administration & Resident Project Representative: Hold and document preconstruction meeting. Weekly construction meetings onsite. Develop and review monthly pay applications. Review submittals. Provide Resident Project Representative ( RPR) services ( up to 200 hours budgeted). Task 3— Notice of Intent( NOI)/ Notice of Establishment( NOE): Draft NO1 and distribute to required authorities for comments. Respond to one round of comments from authorities. Draft NOE and distribute to required authorities. Assumptions: Design, Bidding, and Construction will be completed with 2023 FDR project. Construction duration of the quiet zone elements of the project will be up to 6 weeks with approximately 50% RPR coverage needed during that time. Exclusions: Construction materials sampling and testing. Construction staking. Permit application fees ( it is assumed these fees would be paid directly by the City). Railroad fees( it is assumed these fees would be paid directly by the City). 9/ 7/ 2022 Utilities Commission Meeting Minutes Page 6 Schedule: Bidding is planned for February 2023. Construction planned for Summer 2023. NOI to be submitted in January 2023. NOE to be submitted December 2023. Public Works Director/ City Engineer Walter informed the commission that City Council at the August 16th work session directed staff to proceed with the Quiet Zone implementation for 2023. Mr. Walter noted that the trail crossing on Timberlane will be removed. Motion by Commissioner Stenberg, seconded by Commissioner Brenny to approve the SEH Contract for Quiet Zone Design, Implementation, and Notification in the not to exceed amount of$ 81, 000. 00. Motion carried unanimously. 13. Foley Road, Isle Drive, and Forthun Road Improvements Project Update, City Improvement No. 4114 Bolton & Menk Consulting Engineer Drown informed the commission the project recently had a schedule change and are approximately one week behind schedule. 14. Approve the RL Larson Excavating, Inc. Change Order No. 3 in the increased amount of$ 1, 732. 50 for the 2022 Foley Road, Isle Drive, and Forthun Road Improvements Project, City Improvement No. 4114 Bolton & Menk Consulting Engineer Drown reviewed the RL Larson Excavating Change Order No. 3 in the increased amount of $ 1, 732. 50 for the 2022 Foley Road, Isle Drive and Forthun Road Improvements Project. Change Order No. 3 includes the following items: Irrigation system repairs. Mr. Drown has no concerns with Change Order No. 3 and recommended approval. MOTION by Commissioner Brenny, seconded by Commissioner Stenberg to approve the RL Larson Excavating Change Order No. 3 in the increased amount of $ 1, 732. 50 for the 2022 Foley Road, Isle Drive and Forthun Road Improvements Project. Motion carried unanimously. 15. Approve the RL Larson Excavating, Inc. Partial Pay Estimate No. 3 in the amount of$ 853, 742. 27 for the 2022 Foley Road, Isle Drive, and Forthun Road Improvements Project, City Improvement No. 4114 Bolton & Menk Consulting Engineer Drown reviewed the RL Larson Excavating Partial Pay Estimate No. 3 in the amount of$ 853, 742. 27 for the 2022 Foley Road, Isle Drive and Forthun Road Improvements Project. The Contractor has earned $ 2, 054, 066 to date which represents 57% of the contract value. In accordance with the agreement, 5% of the amount earned is being retained and previous payments in the amount of $ 1, 097, 620. 06 have been made to the Contractor, which results in a payment of 853, 742. 77. Approve the ASTECH, Inc. Partial Pay Estimate No. 1 ( Final) in the amount of$ 244, 508. 56 for the 2022 Micro Surfacing Project Bolton & Menk Consulting Engineer Drown reviewed the ASTECH Corporation Final Pay Estimate No. 1 in the amount of$ 244, 508. 56 for the 2022 Micro Surfacing Project. The Contractor has earned $ 244, 508. 56 to date which represents 100% of the contract work. All project work has been completed and the project is ready for final payment. Mr. Drown had no concerns with Final Pay Estimate No. 1 and recommended approval. Motion by Commissioner Stenberg, seconded by Commissioner Brenny to approve the ASTECH Corporation Final Pay Estimate No. 1 in the amount of $ 244, 508. 56 for the 2022 Micro Surfacing Project contingent upon the City receiving IC- 134 forms. Motion carried unanimously. 17. Approve the Knife River Corporation North Central Final Pay Estimate No. 6 in the amount of 22, 610. 86 for the 2021 Mill & Overlay and Full Depth Reclamation Improvements Project WiDSETH Consulting Engineer Bitter reviewed the Knife River Corporation Final Pay Estimate No. 6 in the amount of $ 22, 610. 28 for the 2021 Mill & Overlay and Full Depth Reclamation Improvements Project. The Contractor has earned $ 1, 753, 281. 23 to date which represents 104. 7% of the revised contract value of $ 1, 674, 114. 69. The amount earned exceeds the revised contract value because of unit bid item overruns. The final payment includes the work completed under Change Order 4 during the last pay period and release of all remaining retainage. This results in a final payment of$ 22, 610. 86. The total project budget was $ 2, 221, 756. 36. The total estimated project cost, with the final construction cost outlined above, is$ 2, 196, 377. 09 or$ 25, 379. 27 under budget. Mr. Bitter had no concerns with Final Pay Estimate No. 6 and recommended approval. Motion by Commissioner Stenberg, seconded by Commissioner Brenny to approve the Knife River Corporation Final Pay Estimate No. 6 in the amount of$ 22, 610. 28 for the 2021 Mill & Overlay and Full Depth Reclamation Improvements Project contingent upon the City receiving IC- 134 forms. Motion carried unanimously. 18. 2022 Street Improvements Project Monthly Update There was no new information or questions from the commission or the public. 19. Approve the Anderson Brother Construction Company Change Order No. 4 in the increased amount of$ 29, 619. 35 for the 2022 Full Depth Reclamation& Reconstruction Improvements Project 9/ 7/ 2022 Utilities Commission Meeting Minutes Page 8 WiDSETH Consulting Engineer Bitter reviewed Change Order No. 4 in the increased amount of 29, 619. 35 for the 2022 Full Depth Reclamation & Reconstruction Improvements Project. Change Order No. 4 includes the following items: The location of the storm structures needed to be adjusted to better fit the alignment of the curb & gutter. Additionally, the existing storm structures were in very poor condition and required replacement. Mr. Bitter had no concerns with Change Order No. 4 and recommended approval. MOTION by Commissioner Christofferson, seconded by Commissioner Stenberg to approve the Anderson Brother Construction Company Change Order No. 4 in the increased amount of$ 29, 619. 35 for the 2022 Full Depth Reclamation & Reconstruction Improvements Project. Motion carried unanimously. 20. Approve the Anderson Brother Construction Company Partial Pay Estimate No. 4 in the amount of 34, 317. 17 for the 2022 Full Depth Reclamation & Reconstruction Improvements Project, Municipal Project Number 4422 WiDSETH Consulting Engineer Bitter reviewed Partial Pay Estimate No. 4 in the amount of$ 34, 317. 17 for the 2022 Full Depth Reclamation & Reconstruction Improvements Project. The Contractor has earned $ 788, 465. 22 to date which represents 72. 4% of the contract value. In accordance with the agreement, 10% of the amount earned is being retained which results in a payment of$ 34, 317. 17. Mr. Bitter has no concerns with Partial Pay Estimate No. 4 and recommended approval. MOTION by Commissioner Stenberg, seconded by Commissioner Brenny to approve the Anderson Brother Construction Company Partial Pay Estimate No. 4 in the amount of$ 34, 317. 17 for the 2022 Full Depth Reclamation & Reconstruction Improvements Project. Motion carried unanimously. 21. Section 6 Area Al Outlet Improvements Project Monthly Update There was no new information or questions from the commission or the public. 22. Approve the Burski Excavating, Inc. Change Order No. 2 in the increased amount of$ 7, 584. 09 and increase the project budget from$ 185, 238. 31 to$ 203, 181. 52 for the Section 6 Area A- 1 Stormwater Outlet Project WiDSETH Consulting Engineer Welch gave a brief overview of the project. The City had not yet obtained the remaining easement and the notice to proceed was not issued until this spring. The City obtained the last easement on May 9, 2022 and issued payment on June 2, 2022. The Contractor was given the notice to proceed but had other work to complete before they could begin the project. WiDSETH met with the Contractor on July 26, 2022, to walk the project and review the project status. At that time, the Contractor notified WiDSETH they were unable to schedule the work until late September. The contractor also notified WiDSETH they would require a change in contract price to cover increased fuel and material costs. 9/ 7/ 2022 Utilities Commission Meeting Minutes Page 9 Mr. Welch explained that other options for the project were considered which included including terminating the construction contract and negotiating with the second low bidder, Pratt' s Affordable Excavating, Inc. The City had the construction materials delivered to the North Water Tower site and begin negotiations with Pratt' s Affordable Excavating, Inc. Pratt' s Affordable Excavating, Inc. was available to do the work but would require a price adjustment of approximately $ 20, 000 to cover increased costs since the project was bid last year. Re- bidding the project was discussed; however, it would likely not result in lower construction costs as contractors have indicated costs have increased significantly since last fall. Re- bidding would also result in increased engineering and advertising fees. Re- bidding would also take additional time to complete, and it would likely be mid- October before another construction contract could be issued. With Burski Excavating Inc.' s revised bid pricing, the total estimated project cost is $ 203, 181. 52 or 17, 943. 21 over the prior approved project budget of $ 185, 238. 31. Burski Excavating, Inc. has indicated they can start the project in late September. Mr. Welch stated that Change Order 2 increases the contract price from $ 100, 552. 65 to $ 108, 136. 74 with the City paying directly for the $ 18, 189. 78 in construction materials that were delivered to the North Tower Site. The Change Order would also change the Substantial and Final Completion dates to October 21, 2022. Burski Excavating has been made aware the October 21, 2022 completion dates cannot be changed and if work is not completed by this date the City will impose liquidated damages of$ 2, 000 per day. Mr. Walter requested that Mr. Welch contact the contractor to see if they would consider a deduct on the sales tax and profit margin on materials since the City had paid for the materials so they would be on hand when the project started. MOTION by Commissioner Stenberg, seconded by Commissioner Brenny to approve the Burski Excavating, Inc. Change Order No. 2 in the increased amount of$ 7, 584. 09, increase the project budget from $ 185, 238. 31 to $ 203, 181. 52 and change the Substantial and Final Completion dates to October 21, 2022, and contact the contractor to see if they would consider a deduct on the sales tax and profit margin on the materials for the Section 6 Area A- 1 Stormwater Outlet Project. Motion carried unanimously. 23. Approve 20- Year Maintenance Plan Update ( 2022— 2042) for Sanitary Sewer and Stormwater Lift Stations WiDSETH Consulting Engineer Welch informed the commission the plan was updated to reflect the current pricing after bids were opened for the Lift Station 16 Reconstruction Project. MOTION by Commissioner Stenberg, seconded by Commissioner Christofferson to approve 20- Year Maintenance Plan Update ( 2022— 2042) for Sanitary Sewer and Stormwater Lift Stations. Motion carried unanimously. INFORMATIONAL ITEMS 24. 2019 Inglewood Drive Drainage Improvements Project Monthly Update There was no new information or questions from the commission or the public. 25. 2022 TH 210& Inglewood Drive Improvements Project Monthly Update 9/ 7/ 2022 Utilities Commission Meeting Minutes Page 10 There was no new information or questions from the commission or the public. 26. 2023 Commercial and Residential Full Depth Reclamation Improvements Project Monthly Update Draft Feasibility Report Presentation SEH Consulting Engineer gave a brief update on the project area, scope, and timeline for the 2023 Commercial & Residential Full Depth Reclamation Improvements. The commission reviewed the plan sheets, and an extensive discussion was held on the Cedar Scenic portion of the project. There are two different options for the trail on Cedar Scenic as it relates to the segment west of Oakwood. One option would follow Cedar Scenic all the way up to Brownsville Circle and the other one would come up the backside of the City property. Commissioner Stenberg expressed concern on the curve on Cedar Scenic since drivers are always cutting the corner. He walks the area all the time and it can get a little dicey due to the sight lines. Chairman Yliniemi inquired if a road and trail design like Memorywood Drive would work, which could be cost effective as it eliminates easement acquisition, it would be plowed without additional maintenance vehicles and reduces trail maintenance. Commissioner Stenberg stated something is needed on Cedar Scenic near Oakwood Drive but does not have to be a grade separated trail. Residents are walking on the edge of the road at this time so a marked area along the road would be fine. Chairman Yliniemi inquired if it is necessary to widen both sides of the road if the road was widened to allow pedestrian use on the shoulder. Mr. Walter stated it is a recommendation to have a pedestrian/ bike trail on both sides. Commissioner Stenberg inquired on if it is a necessity to put a trail down Brownsville Circle when there are only four houses in the cul- de- sac and residents could walk along the road to get to the trail. The following is the anticipated schedule moving forward: SEH will be presenting the draft feasibility study to City Council at the next work session in September to review the studied project scope, initial findings, costs with and without the contemplated trail alternates, project preliminary right of way impacts, and schedule ahead of and in preparation for a neighborhood informational meeting ( open house) tentatively planned for early October, 2022. SEH will also continue to work on topographic design survey, preliminary design, sanitary and storm sewer televising, and geotechnical work in September. October— December 2022: The goal is to finalize the report after the open house and present it to the City Council at the 2nd meeting in October at which time the Council would consider accepting the report and calling for a hearing on the improvement ( public hearing). Said hearing is envisioned to be held in November. The subsequent step would be for the City Council to decide whether to order the improvement ( December).
