UTILITIES COMMISSION MEETING MINUTES Wednesday, October 05, 2022 at 5:30 PM Baxter City Hall, 13190 Memorywood Drive, Baxter, MN “A Growing Community” CALL TO ORDER The regular meeting of the Baxter Utilities Commission was called to order at 5:30 p.m. by Chairman Rock Yliniemi. ROLL CALL MEMBERS PRESENT: Commissioners Jack Christofferson, Douglas Stenberg, Chairman Rock Yliniemi, and Council Liaison Mark Cross. MEMBERS ABSENT: Commissioner John Brenny. STAFF PRESENT: Public Works Director/City Engineer Trevor Walter and Administrative Assistant Mary Haugen. OTHERS PRESENT: Bolton & Menk Consulting Engineer Bryan Drown, SEH Consulting Engineer Scott Hedlund and WiDSETH Consulting Engineer Alex Bitter. CONSENT AGENDA 1. Approve the Utilities Commission Meeting Minutes of September 7, 2022 MOTION by Commissioner Stenberg, seconded by Commissioner Christofferson to approve the Utilities Commission Minutes of September 7, 2022. Motion carried unanimously. BUSINESS ITEMS 2. Accept the Blaze Pizza Municipal Improvements as Outlined in the Development Agreement Public Works Director/City Engineer Walter informed the commission that Blaze Pizza has completed the Municipal Improvements in accordance with the Development Agreement for their project they started in 2021and just recently completed. As-built drawings have been completed and submitted to the city. Blaze Pizza’s Municipal Improvements included connecting a sanitary sewer service to the sewer main on Dellwood Drive, the installation of a fire hydrant for fire protection, and reconstructing Dellwood Drive after the utilities were complete. MOTION by Commissioner Stenberg, seconded by Commissioner Christofferson to accept the Blaze Pizza Municipal Improvements as outlined in the Development Agreement. Motion carried unanimously. 3. Approve the HR Green, Inc Professional Services Agreement Amendment No. 2 in the amount of $7,380.00 for the Whiskey Creek Stormwater Project Phase 1: Predesign Site Investigation 10/5/2022 Utilities Commission Meeting Minutes Page 2 Public Works Director/City Engineer Walter gave a brief update on the project. The second amendment to the current contract is to address the additional sampling needs of the MPCA and project management tasks. Results of sampling completed with the original contract and first amendment have driven the need for elements of expanded services beyond the Phase 1 and the first amendment scope therefore amendment number 2 is needed. HR Green is requesting an additional $7,380 for services in amendment number 2. MOTION by Commissioner Stenberg, seconded by Commissioner Christofferson to approve the HR Green, Inc Professional Services Agreement Amendment No. 2 in the amount of $7,380.00 for the Whiskey Creek Stormwater Project Phase 1: Predesign Site Investigation. Motion carried unanimously. 4. 2022 Foley Road, Isle Drive, and Forthun Road Improvements Project Update Bolton & Menk Consulting Engineer Drown informed the commission the first lift of bituminous is being done on October 6 and 7. Paving will continue Thursday, Friday, and Saturday with wear course a few weeks out. Council Liaison Cross inquired how did the project go overall since the city has been receiving complaints. Mr. Drown stated nothing really stood out of the normal but the project duration was longer than anticipated with some weather and material delays. 5. Approve the RL Larson Excavating, Inc. Change Order No. 4 in the increased amount of $77,710.00 for the 2022 Foley Road, Isle Drive, and Forthun Road Improvements Project Bolton & Menk Consulting Engineer Drown reviewed the RL Larson Excavating Change Order No. 4 in the increased amount of $77,710.00 for the 2022 Foley Road, Isle Drive and Forthun Road Improvements Project. Change Order No. 4 includes the following items:  Sod at commercial properties.  Irrigation repair and reinstallation at Isle Drive roundabout.  Revised Contract Completion Dates. Mr. Drown has no concerns with Change Order No. 4 and recommended approval. MOTION by Commissioner Christofferson, seconded by Commissioner Stenberg to approve the RL Larson Excavating Change Order No. 4 in the increased amount of $77,710.00 for the 2022 Foley Road, Isle Drive and Forthun Road Improvements Project. Motion carried unanimously. 6. Approve the RL Larson Excavating, Inc. Partial Pay Estimate No. 4 in the amount of $633,971.80 for the 2022 Foley Road, Isle Drive, and Forthun Road Improvements Project, City Improvement No. 4114 Bolton & Menk Consulting Engineer Drown reviewed the RL Larson Excavating Partial Pay Estimate No. 4 in the amount of $633,971.80 for the 2022 Foley Road, Isle Drive and Forthun Road Improvements Project. The Contractor has earned $2,721,404.35 to date which represents 74% of the contract value. In accordance with the agreement, 5% of the amount earned is being retained and previous payments in 10/5/2022 Utilities Commission Meeting Minutes Page 3 the amount of $1,951,362.33 have been made to the Contractor, which results in a payment of $633,971.80. Mr. Drown had no concerns with Partial Pay Estimate No. 4 and recommended approval. MOTION by Commissioner Stenberg, seconded by Commissioner Christofferson to approve the RL Larson Excavating, Inc. Partial Pay Estimate No. 4 in the amount of $633,971.80 for the 2022 Foley Road, Isle Drive, and Forthun Road Improvement Project, City Improvement No. 4114. Motion carried unanimously. 7. 2022 Trunk Highway 210 & Inglewood Drive Railway Crossing Improvements Project Update Bolton & Menk Consulting Engineer Drown informed the commission that BNSF will be onsite on Monday to install the concrete planks at the Inglewood Drive crossing. 8. Approve the Anderson Brothers Construction Partial Pay Estimate No. 1 in the amount of $173,228.35 for the 2022 TH 210 and Inglewood Drive Improvements Project, City Improvement No. 4121 Bolton & Menk Consulting Engineer Drown reviewed the Anderson Brothers Construction Partial Pay Estimate No. 1 in the amount of $173,228.35 for the 2022 TH 210 and Inglewood Drive Improvements Project. The Contractor has earned $182,345.63 to date which represents 8% of the contract value. In accordance with the agreement, 5% of the amount earned is being retained, which results in a payment of $173,228.35. Mr. Drown had no concerns with Partial Pay Estimate No. 1 and recommended approval. MOTION by Commissioner Christofferson, seconded by Commissioner Stenberg to approve the Anderson Brothers Construction Partial Pay Estimate No. 1 in the amount of $173,228.35 for the 2022 TH 210 and Inglewood Drive Improvements Project, City Improvement No. 4121. Motion carried unanimously. 9. 2023 Commercial and Residential Full Depth Reclamation Improvements Project Monthly Update SEH Consulting Engineer Hedlund informed the commission the project informational meeting has been set for October 20th at 6 p.m. 10. Approve the Nelson Sanitation Quote in the amount of $26,481.52 for Sanitary and Storm Sewer Jetting & Televising for the 2023 Commercial and Residential Full Depth Reclamation Improvements Project SEH Consulting Engineer Hedlund reviewed the quotes obtained for the 2023 Commercial and Residential Full Depth Reclamation Improvements Project. The City’s policy is to clean and televise the existing sanitary sewer and storm sewer pipes within the project area during preliminary design to assess their condition, and if necessary, include repairs or replacement when the streets are under construction. MOTION by Commissioner Stenberg, seconded by Commissioner Christofferson to approve the Nelson Sanitation Quote for Sanitary and Storm Sewer Jetting & Televising in the amount of $26,481.52 for 10/5/2022 Utilities Commission Meeting Minutes Page 4 the 2023 Commercial and Residential Full Depth Reclamation Improvements Project. Motion carried unanimously. 11. 2022 Full Depth Reclamation & Reconstruction Improvements Project Widseth Consulting Engineer Bitter informed the commission that seeding has been completed and sign work will be installed on Friday and final paving on Saturday. 12. Approve the Anderson Brother Construction Partial Pay Estimate No. 5 in the amount of $106,378.49 for the 2022 Full Depth Reclamation & Reconstruction Improvements Project, Municipal Project Number 4422. WiDSETH Consulting Engineer Bitter reviewed Partial Pay Estimate No. 5 in the amount of $106,378.49 for the 2022 Full Depth Reclamation & Reconstruction Improvements Project. The Contractor has earned $906,158.95 to date which represents 83.3% of the contract value. Retainage in the amount of $59,524.41 is being withheld in accordance with the agreement (retainage varies between 5% and 10% of the amount earned to date depending on the project area). The resulting payment to the Contractor this period is $106,378.49. Mr. Bitter has no concerns with Partial Pay Estimate No. 5 and recommended approval. MOTION by Commissioner Christofferson, seconded by Commissioner Stenberg to approve the Anderson Brother Construction Company Partial Pay Estimate No. 5 in the amount of $106,378.49 for the 2022 Full Depth Reclamation & Reconstruction Improvements Project. Motion carried unanimously. 13. 2023 Cypress Drive and Douglas Fir Drive Improvements Project Monthly Update There was no new information or questions from the commission or the public. 14. Accept the Nelson Sanitation & Rental, Inc. Sewer Cleaning and Televising Quote in the Amount of $11,625.00 for the 2023 Cypress Drive and Douglas Fir Drive Improvements Project WiDSETH Consulting Engineer Bitter reviewed the quotes obtained for the 2023 Cypress Drive and Douglas Fir Drive Improvements Project. The City’s policy is to clean and televise the existing sanitary sewer and storm sewer pipes within the project area during preliminary design to assess their condition, and if necessary, include repairs or replacement when the streets are under construction. MOTION by Commissioner Stenberg, seconded by Commissioner Christofferson to approve the Nelson Sanitation Quote for Sanitary and Storm Sewer Jetting & Televising in the amount of $11,625.00 for the 2023 Cypress Drive and Douglas Fir Drive Improvements Project. Motion carried unanimously. 15. 2023 Knollwood Drive Improvements Project Monthly Update There was no new information or questions from the commission or the public. 16. Accept Nelson Sanitation & Rental, Inc. Sewer Cleaning and Televising Quote in the Amount of $24,685.00 for the 2023 Knollwood Drive Improvements Project 10/5/2022 Utilities Commission Meeting Minutes Page 5 WiDSETH Consulting Engineer Bitter reviewed the quotes obtained for the 2023 Knollwood Drive Improvements Project. The City’s policy is to clean and televise the existing sanitary sewer and storm sewer pipes within the project area during preliminary design to assess their condition, and if necessary, include repairs or replacement when the streets are under construction. MOTION by Commissioner Christofferson, seconded by Commissioner Stenberg to approve the Nelson Sanitation Quote for Sanitary and Storm Sewer Jetting & Televising in the amount of $24,685.00 for the 2023 Knollwood Drive Improvements Project. Motion carried unanimously. 17. Approve the Widseth Agreement for Professional Engineering Services in the Not to Exceed Amount of $13,500.00 for the 2023 Lift Station 13 Reconstruction. WiDSETH Consulting Engineer Bitter reviewed the WiDSETH Agreement for Professional Engineering Services for the 2023 Lift Station No. 13 Reconstruction. Scheduled improvements for Liftstation 13 includes the following:  Salvage existing control panel to the City   Install a new stainless-steel control panel  Replace transducer  Replace floats  Replace base elbows  Replace pump guide rails  Replace pumps  Wet well cleaning and concrete spot repair  Replace concrete cover and aluminum hatch  Valve vault and piping replacement Public Works Director/City Engineer Walter informed the commission that in the past the contracts waited until January of that construction year but due to the material shortages the project needs to bid in December in order to have the materials on hand by October of the following year to complete the project. MOTION by Commissioner Christofferson, seconded by Commissioner Stenberg to approve the Widseth Agreement for Professional Engineering Services in the Not to Exceed Amount of $13,500.00 for the 2023 Lift Station 13 Reconstruction.
