UTILITIES COMMISSION MEETING MINUTES Wednesday, September 06, 2023 at 5:30 PM Baxter City Hall, 13190 Memorywood Drive, Baxter, MN “A Growing Community” CALL TO ORDER The regular meeting of the Baxter Utilities Commission was called to order at 5:35 p.m. by Council Liaison Cross. ROLL CALL Members Present: Commissioner John Brenny, Jack Christofferson, Douglas Stenberg, and Council Liaison Mark Cross. Members Absent: Chairman Rock Yliniemi. Staff Present: Public Works Director/City Engineer Trevor Walter, Assistant City Engineer Trevor Thompson, and WSB Engineer Isaiah Escobedo assisting with minutes. Approve the Utilities Commission Minutes from August 2, 2023 MOTION made by Commissioner Stenberg, seconded by Commissioner Brenny to approve the Utilities Commission Minutes from August 2, 2023. BUSINESS ITEMS 2. 2022 Foley Road, Isle Drive, and Forthun Road Improvements Project Update, City Improvement No. 4114 There was no new information or questions from the commission or the public. 3. Approve RL Larson Excavating, Inc. Change Order No. 9 in the Increased Amount of $16,600.00 for the 2022 Foley Road, Isle Drive, and Forthun Road Improvements Project, Municipal Improvement No. 4114 Bolton & Menk Consulting Engineer Drown reviewed the RL Larson Change Order No. 9 in the increased amount of $16,600.00 for the 2022 Foley Road, Isle Drive, and Forthun Road Improvements Project. Change Order No. 9 includes the following item:  Reseeding the turf areas that did not meet the 70% growth coverage by slit seeding. The contractor placed 4,000 pounds of Seed Mix 25-131 at a unit cost pf $4.15 per pound. Approve the RL Larson Excavating, Inc. Partial Pay Estimate No. 9 in the amount of $16,514.83 for the 2022 Foley Road, Isle Drive, and Forthun Road Improvements Project, City Improvement No. 4114 Bolton & Menk Consulting Engineer Drown reviewed Partial Pay Estimate No. 9 in the amount of $16,514.83 for the 2022 Foley Road, Isle Drive, and Forthun Road Improvements Project. The contractor has earned $3,853,305.52 to date which represents 101% of the contract value. In accordance with the agreement, the amount retained has been reduced from 3% to 1.5%. The 1.5% retained equals $57,799.58 and is being held to cover the turf establishment on Foley Road that has not been accepted and punchlist items not completed. Previous payments in the amount of $3,778,991.11 have been made to the Contractor, which results in a payment of $16,514.83. Mr. Drown has no concerns with Partial Pay Estimate No. 9 and recommends approval. MOTION by Commissioner Brenny, seconded by Commissioner Christofferson to approve the RL Larson Excavating, Inc. Partial Pay Estimate No. 9 in the amount of $16,514.83 for the 2022 Foley Road, Isle Drive, and Forthun Road Improvement Project. Motion carried unanimously. 5. 2022 Trunk Highway 210 & Inglewood Drive Railway Crossing Improvements Project Update Commissioner Jack Christofferson said the new striping correction makes the intersection flow better with clearer direction. Mr. Drown said per fire code it needed to be 20’ wide so it was restriped to move the lane off the median for a 4’ shoulder instead of an 8’ shoulder. Commissioner Christofferson witnessed on Foley Road the Westbound turn lane traffic blocks the view of the stop sign for the through traffic movement. This causes some through traffic to continue through the intersection without stopping. Mr. Drown stated that Bolton & Menk have been monitoring it, there are stop bars in place, stop signs, and flags in place, in order to put a stop sign in, a median would need to be placed in the roadway first. Commissioner Christofferson asked if it is possible for a stop sign to be placed in the boulevard next to the eastbound lane facing the Westbound Lane. Public Works Director/City Engineer Walter said the plan was to monitor the intersection and add a median and second stop sign if needed. 6. Approve the BNSF Invoice No. 90255952 in the amount of $64,562.76 for the 2022 TH 210 and Inglewood Drive Improvements Project, City Improvement No. 4121 Bolton & Menk Consulting Engineer Drown reviewed the BNSF Invoice No. 90255952 in the amount of $64,562.76 includes work completed between 6/05/2023 and 7/12/2023 related to the railway signal. Invoice 90255952 includes bill preparation, flagging, labor for installing the crossing gates, and professional services for engineering firm Benesch & Associates. 9/6/2023 Utilities Commission Meeting Minutes Page 3 Mr. Drown has no concerns with BNSF Invoice No. 90255952 and recommends approval. He also stated that we will be seeing more invoices coming from BNSF for work from the 11th and 12th. Public Works Director/City Engineer Walter asked how the invoices are tracking with the total estimated budget with the railroad. Mr. Drown said that labor was over by about 2%, materials over by 7%, and other costs are significantly lower. Total is about 85% of overall estimate or $68,000 below total estimate price. MOTION by Commissioner Brenny, seconded by Commissioner Christofferson to approve the BNSF Invoice 90255952 in the amount of $64,562.76 for the 2022 TH 210 and Inglewood Drive Improvements Project. Motion carried unanimously. 7. Approve the Anderson Brothers Construction Partial Pay Estimate No. 8 in the amount of $284,126.61 for the 2022 TH 210 and Inglewood Drive Improvements Project, City Improvement No. 4121 Bolton & Menk Consulting Engineer Drown reviewed Partial Pay Estimate No. 8 in the amount of $284,126.61 for the 2022 T.H. 210 and Inglewood Drive Improvements Project. The Contractor has earned $2,148,599.15 to date which represents 97% of the contract value and the city has previously reimbursed the contractor $44,951.46 for storm sewer items purchased in 2022. All storm sewers have been installed and the stored material is zeroed out in this pay estimate. In accordance with the agreement, 5% of the amount earned is being retained, previous payments in the amount of $1,757,042.58 were made to the contractor, which results in a payment of $284,126.61. Mr. Drown has no concerns with Partial Pay Estimate No. 8 and recommends approval. Motion carried unanimously. 8. 2023 Micro Surfacing Project Update There was no new information or questions from the commission or the public. 9. Approve the ASTECH, Inc. Pay Estimate No. 1 in the amount of $397,286.79 for the 2023 Micro Surfacing Project Bolton & Menk Consulting Engineer Drown reviewed Partial Pay Estimate No. 1 in the amount of $397,286.79 for the 2023 Micro Surfacing Project. The contractor has earned $418,196.62 to date and 5% is being held as retainage. Pay Estimate No. 1 is presented in the amount of $397,286.79. The payment includes the cost of unit price work completed through August 19, 2023. Accept the Golf Course Drive and Clearwater Road Intersection Analysis Report and approve the installation of the 4-way stop signs at the intersections of Golf Course Drive and Clearwater Road Intersection. SEH Consulting Engineer Anibas gave a presentation on the findings of the Golf Course Drive and Clearwater Road Intersection Analysis Report. A 4-way stop is recommended for the intersection. MOTION by Commissioner Stenberg, seconded by Commissioner Christofferson to accept the Golf Course Drive and Clearwater Road Intersection Analysis Report and approve the installation of the 4- way stop signs at the intersections of Golf Course Drive and Clearwater Road Intersection. Motion carried unanimously. 11. 2023 Cypress Drive and Douglas Fir Drive Improvements Project Monthly Update SEH Consulting Engineer Hedlund said there will be added costs of seeding and re-mulching along with black dirt because of washouts due to the Tuesday September 5th rain event. It included 1.7 inches of rain in around an hour timeframe and caused multiple erosion issues. The rain intensity is not something that can be planned for with erosion control devices, therefore the contractor is not responsible to pay for the repair as they had everything stabilized for the plans. 12. Approve the Kraemer Trucking & Excavating, Inc Change Order No. 3 in the amount of $11,629.20 for the 2023 Cypress Drive and Douglas Fir Drive Improvements Project SEH Consulting Engineer Hedlund reviewed the Kraemer Trucking & Excavating Inc. Change Order No. 3 in the increased amount of $11,629.20 for the 2023 Cypress Drive and Douglas Fir Drive Improvements Project. Change Order No. 3 includes the following item:  Providing temporary lighting on CSAH 48 and the roundabout necessary to open it back up to traffic before Labor Day Weekend. The Contract with Kramer Trucking and Excavating requires the City to furnish the Contractor light poles for their installation along Cypress Drive and CSAH 48. City Council approved preordering the light poles at the December 20, 2022 City Council meeting, this was recommended due to the long lead times. Due to a manufacturing issue and delay, the poles were not ready by June as originally advised by the City’s supplier JT Services providing poles manufactured by Hapco Inc. Mr. Hedlund has no concerns with Change Order No. 3 and recommends approval. MOTION by Commissioner Christofferson, seconded by Commissioner Brenny to approve the Kraemer Trucking & Excavating, Inc. Change Order No. 4 in the increased amount of $91,603.45 for the 2023 Cypress Drive and Douglas Fir Drive Improvements Project. Change Order No. 4 includes the following item:  Covers eliminating planned sodding from the contract due to the drought conditions this construction season and anticipated into the fall. The change order covers corresponding increases and decreases in contract quantities, and creates new items for bonded fiber matrix, hydraulic organic matrix in some areas, and another seed mixture. Mr. Hedlund has no concerns with Change Order No. 4 and recommends approval. MOTION by Commissioner Brenny, seconded by Commissioner Stenberg to approve the Kraemer Trucking & Excavating, Inc. Approve the Kraemer Trucking & Excavating, Inc Partial Pay Estimate No. 4 in the amount of $810,716.15 for the 2023 Cypress Drive and Douglas Fir Drive Improvements Project SEH Consulting Engineer Hedlund reviewed Partial Pay Estimate No. 4 in the amount of $810,716.15 for the 2023 Cypress Drive and Douglas Fir Drive Improvements Project. The pay estimate is for work accomplished through August 18th and covers grading, paving, concrete curb & gutter and flat work, underground pipe and structures, and work items for Change Order Nos. 1, 2, and 3. Mr. Hedlund has no concerns with Partial Pay Estimate No. 4 and recommends approval. Motion carried unanimously. 15. 2023 Commercial and Residential Full Depth Reclamation and Quiet Zone Improvements Project Monthly Update There was no new information or questions from the commission or the public. 16. Approve the Anderson Brothers Construction Change Order No. 2 in the increased amount of $82,719.40 for the 2023 Commercial and Residential Full Depth Reclamation and Quiet Zone Improvements Project SEH Consulting Engineer Voit reviewed the Kraemer Trucking & Excavating Inc. Change Order No. 2 in the increased amount of $82,719.40 for the 2023 Cypress Drive and Douglas Fir Drive Improvements Project. Change Order No. 2 includes the following items:  Part 1 covers an added detour for Clearwater Road.  Part 2 covers calcium chloride treatment applied to Cedar Scenic Road and Deerwood Road for dust control. 9/6/2023 Utilities Commission Meeting Minutes Page 6  Part 3 addresses extending two existing culverts to maintain drainage beyond the new trail on Clearwater Road.  Part 4 adds a valve requested by City staff to the intersection of Clearwater Road and Green Briar Drive to provide greater watermain isolation flexibility on Clearwater Road.  Part 5 covers added costs for differences in existing conditions encountered during the relocation of three hydrants near the Pine Grove Estates apartments on Clearwater Road  Part 6 covers the added cost for seven sewer services at six locations that needed to be upsized from 4” to 6” to match existing conditions.  Part 7 involves extending three 8” watermain stubs beyond the trail on empty lots on Clearwater Road west of Forest Drive.  Part 8 covers re-excavating the water service at Baxter Medical Center to verify that the service was not leaking.  Part 9 covers added crew time searching for a sewer service which was not shown correctly in record drawings.  Part 10 involves the purchase and use of a freeze kit to speed up water service extensions and remove older flared fittings.  Part 11 adds a concrete anti-buoyancy collar to a deep sanitary structure to reduce the risk of upheaval from high groundwater.  Part 12 relocates a flagpole that was in conflict with the new trail on Clearwater Road.  Part 13 covers televising storm and sanitary mains on Clearwater Road to investigate a sinkhole that was discovered on Clearwater Road before construction began.  Part 14 adds additional quantities to the contract to cover work on Oakwood Drive north of Cedar Scenic Road that was part of a bid alternate which was not awarded.  Part 15 extends the completion date to allow additional time for the contractor to complete added work outside the contractor’s control. Mr. Voit has no concerns with Change Order No. 2 and recommends approval. Approve the Anderson Brothers Construction Partial Pay Estimate No. 2 in the amount of $346,984.16 for the 2023 Commercial and Residential Full Depth Reclamation and Quiet Zone Improvements Project SEH Consulting Engineer Voit reviewed Partial Pay Estimate No. 2 in the amount of $346,984.16 for the 2023 Commercial and Residential Full Depth Reclamation and Quiet Zone Improvements Project. Partial Pay Estimate No. 2 is for work accomplished through August 18th and covers removals, reclaiming, grading, underground pipe work, concrete curb installation and work items for Change Order #2. Mr. Voit has no concerns with Partial Pay Estimate No. 2 and recommends approval. Approve the Knife River Corporation – North Central Change Order No. 4 in the Decreased Amount of $99,954.76 for the 2023 Knollwood Drive Improvements Project, Municipal Project Number 4132 WiDSETH Consulting Engineer Bitter reviewed Change Order No. 4 in the deduct amount of $99,954.76 for the 2023 Knollwood Drive Improvements Project. Change Order No. 4 includes the following items:  The City has set a standard to sod residential projects in lieu of seeding for turf establishment. In order to get the project budget back down to the original contracted price, the City has elected to seed the project area. To complete seeding on this project, a Seeding line item must be added. There is approximately 1.72 acres of seeding required for this project and the cost of seeding per acre is $997.50 bringing the total cost of Seeding to approximately $1,715.70.  A requirement for adding seeding per acre to the project is to also include a Soil Bed Preparation line item to the project. This line item includes conditioning and finishing of the top layer of topsoil, so it is ready for seeding. This quantity is also approximately 1.72 acres at a cost of $997.50 per acre bringing the total cost of Soil Bed Preparation to $1,715.70.  One of the reasons the City has chosen to use sod in residential areas is because it can take up to 30 days to establish growth with traditional seedings. In conversation with the Seeding Contractor, they brought up a product they have started to use more often that has helped establish growth at a faster rate than typical fertilizer. This product is an organic matrix, and it is applied in addition to the standard fertilizer. This product is applied at 3500 pounds per acre, and it costs $10,106.25 per acre. With approximately 1.72 acres of seeding area on the project, this brings the total cost to $17,382.75.  Part of the project was to complete exploratory excavations on the watermain to determine if the tees were plastic or ductile iron. There were 3 watermain tees at the intersection of Knollwood Drive and Highland Scenic Road. These tees were in close proximity to the stoplight foundations. In the planning phase of the project, WiDSETH was unsure if the stoplights would need to be taken down or simply held in place. In the weekly construction meetings, the safety of the excavation was reviewed with the contractor and Holden Electric. It was agreed that Holden Electric can attach the boom truck to the stoplight and hold it in place so if the excavation does fail, the stoplight won’t fall and be damaged. The excavation went well, and the stoplight foundation was not disturbed. This excavation needed to happen twice, once for the exploratory excavation and once for a valve replacement. The total for this invoice is $3,753.75.  With this project being a full depth reclamation project, the goal is to use the extra reclaim material for the base material of the trail. There should have been enough extra reclaim material for the trail, so additional base material was not included in the project. There were adjustments made in the field to the curb and gutter that caused the roadway to need additional reclaim material. As the contractor was grading the trail, they ran out of on-site base material. Class 5 aggregate base and some millings from a stockpile were brought in to finish building the trail. A total of 512 tons of gravel were brought in at $14 a ton and a $600 additional cost for trucking the millings back to the site brings the total cost to $7,765.34.  This item removes sod from the project and revises the total contract value. The $99,954.76 change order decreases the total contract price from $1,857,477.99 to$1,757,523.23. 9/6/2023 Utilities Commission Meeting Minutes Page 8 Mr. Bitter has no concerns with Change Order No. 4 and recommends approval. Council Liaison Cross inquired if this was presented at the open house as sod. Public Works Director/City Engineer Walter Indicated that it was presented that way, and this is the only project he is worried about it being seeded rather than sodded. The reason an early notice was sent about the switch is to help the residents understand why the change has been made. MOTION by Commissioner Brenny, seconded by Commissioner Stenberg to approve the Knife River Corporation – North Central Change Order No. 4 in the Decreased Amount of $99,954.76 for the 2023 Knollwood Drive Improvements Project. Motion carried unanimously. 20. Approve the Knife River Corporation – North Central Pay Estimate 4 in the amount of $457,131.52 for the 2023 Knollwood Drive Improvements Project, Municipal Project Number 4132 WiDSETH Consulting Engineer Bitter reviewed Partial Pay Estimate No. 4 in the amount of $457,131.52 for the 2023 Knollwood Drive Improvements Project. The Contractor has earned $1,194,989.76 to date which represents 68.0% of the revised contract value. In accordance with the agreement, 5% of the contract value ($87,876.16) is being retained which results in a total payment of $457,131.52. Mr. Bitter has no concerns with Partial Pay Estimate No. 4 and recommends approval. MOTION by Commissioner Christofferson, seconded by Commissioner Stenberg to approve the Knife River Corporation – North Central Pay Estimate 4 in the amount of $457,131.52 for the 2023 Knollwood Drive Improvements Project. Motion carried unanimously. 21. Lift Station 16 Reconstruction Project Monthly Update There was no new information or questions from the commission or the public. 22. Approve the Tom’s Backhoe Service, Inc. Final Pay Estimate 3 in the amount of $5,000.00 for the Lift Station 16 Reconstruction Project WiDSETH Consulting Engineer Bitter reviewed Final Pay Estimate No. 3 in the amount of $5,000.00 for the Lift Station 16 Reconstruction Project. The Contractor has earned $140,000.00 to date which represents 100% of the contract value. In accordance with the agreement, $5,000.00 of retainage is being released at project close out. MOTION by Commissioner Stenberg, seconded by Commissioner Brenny to approve the Tom’s Backhoe Service, Inc. Final Pay Estimate 3 in the amount of $5,000.00 for the Lift Station 16 Reconstruction Project. Motion carried unanimously. 23. Section 6 Area A1 Outlet Project Monthly Update WiDSETH Consulting Engineer Bitter informed the Utilities Commission the erosion control had been removed from site last week. 24. Approve the Burski Excavating, Inc. Final Pay Estimate No. 2 in the amount of $4,967.20 for the Section 6 Area A-1 Stormwater Outlet Project 9/6/2023 Utilities Commission Meeting Minutes Page 9 WiDSETH Consulting Engineer Bitter reviewed Final Pay Estimate No. 2 in the amount of $4,967.20 for the Section 6 Area A-1 Stormwater Outlet Project. The Contractor has earned $99,344.05 to date. The final construction cost came in $8,792.69 lower than the revised contract value of 108,136.74. In accordance with the agreement, $4,967.20 of retainage is being released at project close out. Mr. Bitter had no concerns and recommended approval. Public Works Director/City Engineer Walter wanted to make clear that the turf establishment necessary to close out the project was not reviewed with the city and was just reviewed by Consulting Engineer Welch unlike the Lift Station 16 Project. MOTION by Commissioner Christofferson, seconded by Commissioner Stenberg to approve the Burski Excavating, Inc. Final Pay Estimate 2 in the amount of $4,967.20 for the Section 6 Area A-1 Stormwater Outlet Project. Motion carried unanimously. 25. 2024 Mill & Over and Full Depth Reclamation Improvements Project Monthly Update There was no new information or questions from the commission or the public. 26. Approve Resolution No. 2023-060 Receiving Feasibility Report and Calling the Improvement Hearing for the 2024 Mill & Overlay and Full Depth Reclamation Improvements Project Municipal Project No. 4424 Consulting Engineer Bitter explained the Feasibility report and the review from last meeting. Commissioner Jack Christofferson asked about micro-surfacing and why that was not included in this Feasibility Report. Mr. Bitter said that city staff indicated that Mill and Overlay and FDR is the focus of this feasibility Report. Public Works Director/City Engineer Walter stated that micro-surfacing has not been tested for the areas this report looked at, mainly stripping of the road surface after chip sealing. Council Liaison Cross asked for a finding on how micro-surfacing extends the life of pavement where a mill and overlay is needed. Commissioner Christofferson asked about assessments and how they were chosen and what the costs would be. Mr. Bitter explained how it will be assessed based on address and ERU’s and the costs are going to be, per residential lot, $4,700 for Mill and Overlays and $13,000 for FDR projects. Mr. Walter indicated that the ERU should be based on lots of 120-130 ft as the city does not have 100- foot lots. Council Liaison Cross asked if the assessment was based on a certain side for corner lots. Mr. Bitter said that the R1 assessments will be based on address and what street their address says they are on. Mr. Bitter is going to review the Land of Life Church Assessment. Motion carried unanimously. 27. Whiskey Creek Stormwater Improvements Project Public Works Director/City Engineer Walter updated the commission on the project.
