SPECIAL MEETING
OF THE MUNICIPAL COUNCIL OF THE CITY OF BAYONNE, IN THE COUNTY OF
HUDSON, NEW JERSEY, HELD IN THE COUNCIL CHAMBER, MUNICIPAL BUILDING,
630 AVENUE C, ON WEDNESDAY, JULY 26, 2023
The Council met at 11:00 A.M.
The Council President LaPelusa announced: “I would like to advise all those present
that notice of this special meeting of the Municipal Council of the City of Bayonne of
July 26, 2023 has been provided to the public in accordance with the provisions of the
Open Public Meetings Act of the State of New Jersey. An additional Notice of time and
place was posted and filed with the City Clerk and was forwarded to the Jersey Journal
and the Star Ledger by on July 21, 2023.”
The Special Meeting of the Municipal Council of the City of Bayonne is now in session.
The Clerk called the roll.
Present were: Council Members Booker, Carroll, Perez, Weimmer, and President
LaPelusa.
The Council President led the Pledge of Allegiance.

Dear Ms. Medina:
Please be advised that it is necessary to call a special meeting of the Municipal Council
on Wednesday, July 26, 2023 at 11:00 A.M, in the Dorothy E. Harrington Municipal
Council Chambers.
The purpose of this special meeting is as follows:
1. Resolution approving the (1) submission of a grant application to and (2)
execution of a grant contract with the New Jersey Department of Transportation
for the Improvements to Broadway - Phase II.
2. Resolution authorizing the Purchasing Agent to solicit bids and/or requests for
proposals for the conversion, implementation and maintenance of the law
enforcement e-mail system.
3. Resolution amending Resolution 23-05-17-050 (authorizing a preliminary
investigation for an area in need for 28-34 East 22nd Street, Block 212, Lots 30,
31) to include Block 212, Lot 32.
Please ensure that the appropriate Open Public Meeting Act notice is effectuated.

Resolution: Approval to submit a grant application and execute a grant contract with
the New Jersey Department of Transportation for the Improvements to
Broadway – Phase II.
NOW, THEREFORE, BE IT RESOLVED that Council of the City of Bayonne formally
approves the grant application for the above stated project.
BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to submit
an electronic grant application identified as MA-2024-Improvements to Broadway –
Phase II-00201 to the New Jersey Department of Transportation on behalf of the City of
Bayonne.
BE IT FURTHER RESOLVED that Mayor and Clerk are hereby authorized to sign the
grant agreement on behalf of the City of Bayonne and that their signature constitutes
acceptance of the terms and conditions of the grant agreement and approves the execution
of the grant agreement.

COUNTY OF HUDSON, NEW JERSEY, (1) CORRECTING RESOLUTION NO. 23-
05-17-050 AND (2) AUTHORIZING AND DIRECTING THE PLANNING BOARD OF
THE CITY OF BAYONNE TO CONDUCT A PRELIMINARY INVESTIGATION TO
DETERMINE WHETHER CERTAIN PROPERTY LOCATED AT 28-34 EAST 22nd
STREET AND DESIGNATED AS BLOCK 212, LOTS 30, 31 & 32 WITHIN THE CITY
CONSTITUTE A NON-CONDEMNATION AREA IN NEED OF REDEVELOPMENT
PURSUANT TO THE LOCAL REDEVELOPMENT AND HOUSING LAW, N.J.S.A.
40A:12A-1 ET SEQ. AND AUTHORIZING THE PREPARATION OF A
REDEVELOPMENT PLAN FOR THE PROPERTY
WHEREAS, the City of Bayonne, in the County of Hudson, New Jersey (the
“City”), a public body corporate and politic of the State of New Jersey (the “State”), is
authorized pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1
et seq. (the “Redevelopment Law”), to determine whether certain parcels of land within
the City constitute an area in need of rehabilitation and/or an area in need of
redevelopment; and
WHEREAS, pursuant to the Redevelopment Law, the City Council adopted
Resolution No. 98-02-04-040, designating the entire City as an area in need of
rehabilitation in accordance with N.J.S.A. 40A:12A-14; and
WHEREAS, N.J.S.A. 40A:12A-6 authorizes the governing body of any
municipality, by resolution, to have its Planning Board conduct a preliminary
investigation to determine whether an area of the municipality is a non-condemnation
“area in need of redevelopment” pursuant to the criteria contained in N.J.S.A. 40A:12A-
5; and
WHEREAS, the Mayor and Municipal Council consider it to be in the best
interest of the City to have the Planning Board of the City (the “Planning Board”)
conduct such an investigation to determine if a certain property located at 28-34 East
22nd Street, which property is identified as Block 212, Lots 30, 31 & 32 as shown on
the official Tax Map of the City (the “Property”), constitute a non-condemnation “area in
need of redevelopment”; and

WHEREAS, the City believes the Property is potentially valuable for contributing
to, serving, and protecting the public health safety and welfare and for the promotion of
smart growth within the City; and
WHEREAS, the preliminary investigation will be designed to evaluate the area to
determine whether designation of the Property as a non-condemnation “area in need of
redevelopment” is appropriate and in conformance with the statutory criteria contained
in N.J.S.A. 40A:12A-5; and
WHEREAS, the City Council further desires that to the extent that the Planning
Board determines that the Property constitutes an area in need of redevelopment, that
the Planning Board prepare a redevelopment plan for the Property (the “Redevelopment
Plan”); and
WHEREAS, on May 17, 2023, this Municipal Council passed Resolution #23-05-
17-050 which authorized a preliminary investigation for this site but, due to a
scrivener’s error, only included Lots 30 and 31; and
WHEREAS, it is the purpose of this resolution to correct that scrivener’s error;
NOW THERE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY
OF BAYONNE, COUNTY OF HUDSON, NEW JERSEY AS FOLLOWS:
Section 1. Resolution No. 23-05-17-050 is hereby corrected to reflect that the
Planning Board is hereby directed to conduct a preliminary investigation to determine
whether the aforementioned Property, specifically Block 212, Lots 30, 31 & 32 (A/K/A
28-34 East 22nd Street), or any portions thereof, constitute a non-condemnation “area
in need of redevelopment” according to the criteria set forth in N.J.S.A. 40A:12A-5.
Section 2. Resolution No. 23-05-17-050 is hereby further corrected to reflect
that the Planning Board is hereby directed to study the area known as Block 212, Lots
30, 31 & 32 (A/K/A 28-34 East 22nd Street) to develop a map reflecting the boundaries
of the proposed non-condemnation redevelopment area; to provide public notice and
conduct public hearings pursuant to N.J.S.A. 40A:12A-6; and to draft a
report/Resolution to the Municipal Council containing its findings.
Section 3. The results of such preliminary investigation shall be submitted to
the Mayor and City Council for review and approval in accordance with the provisions of
the Redevelopment Law.
Section 4. To the extent that the preliminary investigation determines that the
subject Property meets the statutory criteria to be deemed a non-condemnation area in
need of redevelopment, the Planning Board is further directed to prepare a
Redevelopment Plan for the subject Property.
Section 5. This Resolution shall take effect immediately.
