ZONING BOARD OF ADJUSTMENT SPECIAL MEETING MINUTES FEBRUARY 21, 2018 A SPECIAL MEETING of the Zoning Board of Adjustment was held on Wednesday, February 21, 2018 in the Dorothy E. Harrington Municipal Council Chambers, 630 Avenue C, Bayonne, New Jersey. Chairman Urban called the meeting to order at 6:00 p.m. Commissioner Egan called the roll. Present at the meeting were Chairman Urban, Commissioners Egan, Pelliteri, LeFante, Adams, Lombari, Pineiro and DiLullo. Commissioners Dorans, De Ros and Simmons were absent. Also present was Richard N. Campisano, Esq., Board Counsel, Eric Nemeth, Esq. and Anthony P. Seijas, Esq. attorneys for the City’s insurance carrier NJIIF and Lillian Glazewski, Land Use Administrator, After the Pledge of Allegiance to the Flag, Chairman Urban declared a quorum and advised that the Board had complied with the Open Public Meetings Act/Sunshine Law. CLOSED SESSION: At 6:02 p.m. Chairman Urban announced that the Board will enter into closed session to discuss litigation between the Bayonne Muslims, et al v. The City of Bayonne bearing Docket No. 2:17-v-03731 (MCA) (LDW) and how to conduct a “Whispering Woods Hearing” to be held on February 26, 2018. The meeting resumed at 7:23 p. m. and the roll was called. It was noted that Commissioner De Rose was present at that time. Zoning Board of Adjustment February 21, 2018 Special Meeting Minutes Page 2 Adoption of Resolutions: • Z-17-031 – MAJID MIRZA – Site: 104 West 44th Street in City Block 88, Lot 48 o Commissioner Adams made a motion to adopt the resolution and Commissioner Pineiro seconded the motion. A unanimous vote followed. • Z-17-034 – NADINE SMITH – Site: 584 Avenue E in City Block 405, Lot 7 o Commissioner Adams made a motion to adopt the resolution and Commissioner Urban seconded the motion. A unanimous vote followed. • Z-18-001 – THE ESTATE OF MICHELINA ORLANDINI (STEPHEN KOWALSKI) – Site: 159 West 21st Street in City Block 207, Lot 5 o Commissioner Egan made a motion to adopt the resolution and Commissioner Adams seconded the motion. A unanimous vote followed. A motion was made to close the meeting at 7:26 p.m. BayTV took a video of the meeting. /lg  ZONING BOARD OF ADJUSTMENT CLOSED SESSION MEETING MINUTES FEBRUARY 21, 2018 A CLOSED SESSION of the Zoning Board of Adjustment was held on Wednesday, February 21, 2018 in the Municipal Council Conference Room, 630 Avenue C, Bayonne, New Jersey. The Board entered into the closed session at 6:02 p.m. with the following Commissioners present: • Chairman Urban called • Commissioner Egan • Commissioner Pelliteri • Commissioner LeFante • Commissioner Adams • Commissioner Lombari • Commissioner Pineiro • Commissioner DiLullo. Also present at the closed session were Richard N. Campisano, Esq., Board Counsel, Anthony P. Seijas, Esq. and Eric Nemeth, Esq., attorneys for NJIIF (NJ Intergovernmental Insurance Fund) and Lillian Glazewski, Land Use Administrator, CLOSED SESSION: The closed session was called so that Eric Nemeth, Esq. and Anthony P. Seijas, Esq. attorneys for the City’s insurance carrier NJIIF could explain to the Commissioners how a Whispering Woods Hearing scheduled for February 26, 2018 is to be held. They discussed the settlement agreement with regard to the litigation filed by the Bayonne Muslims, et al v. The City of Bayonne, et al. During the explanation, Commissioners asked questions of counsel regarding the Zoning Board of Adjustment February 21, 2018 Closed Session Minutes Page 2 agreement and the conduct of the hearing. In addition, Commissioners were given an update as to the DOJ investigation still ongoing. The closed session ended at 7:20 p. m. and the Commissioners returned to the open meeting portion. /lg
