Borough of Beaver, PA Council Meeting April 9, 2019 Minutes • A regular scheduled meeting of Beaver Borough Council was held in the Community Room and called to order on April 9, 2019 at 7:00PM by Council Vice President, Alex Andres. • Pledge of Allegiance • Council Representatives in attendance: Alexander Andres, Michael Deelo, Chris King, Margaret McKean, Jim Perini, Adam Rathbun, Alex Sebastian, Sean Snowden (via phone conference), Jarrod Thomas. Borough officials in attendance: Mayor Tom Hamilton, Chief Dan Madgar and Solicitor Brandon Eberle. • Visitors in attendance (signed in): Midge Sefton, Rick Sprecker, Jim Woolley, George Lindemann, Robert Rice Approval of minutes Motion by Ms. King to accept the March 12, 2019 Council meeting minutes and the March 26, 2019 Work Session minutes. Seconded by Mr. Thomas. Voice vote passed unanimously. Treasurer’s Report • Finance Manager “Notes for March 2019 Financial Reports” enclosed in council packet • March 2019 end of month reports and balances were reviewed • Reports will be filed for annual audit Review invoice and authorization to pay bills Motion by Mr. Rathbun to authorize and pay submitted invoices for the Borough. Seconded by Ms. McKean. Voice vote passed unanimously.  Mr. Deelo requested an Executive Session to discuss a legal issue. No motion will be needed after the Executive Session is adjourned.  Mr. Andres approved the executive session to discuss the legal issue. Public Participation –  Jim Woolley, 343 Park Street – Appreciated the letter that was delivered to the residents notifying them of the paving project. Reports – Commissions / Authorities Council of Governments (COG) – Reported by Mr. Andres  March 2019 minutes enclosed in council packet  Mr. Andres will be attending the 2019 Local government conference July 31 – August 1 April 9, 2019 Page 1 Civil Service Commission – No report Zoning Hearing Board (ZHB) – Reported by Mr. Sprecker  A Zoning Hearing will be held on April 10, 2019 at 7:00PM regarding a variance request at 1701 Third Street relating to the excess of an allowable sign size. Planning Commission – No report Tree Commission –  February 25, 2019 meeting minutes enclosed in council packet Code Enforcement Officer Report – Reported by Mr. Sprecker • March 2019 report enclosed in council packet. Historic Architectural Review Board (HARB) – No report Municipal Authority – No report Council Committee Reports Public Safety/Code Enforcement – No report  Ms. McKean stated a Police Report was provided monthly in past years, would like to know if it could be supplied again o Mr. Snowden stated we could discuss the format at a Work Session Finance – No report Highway – Reported by Mr. Thomas  Access Road will be put out to bid soon. Approximate cost should be $50,000-$60,000. Goal is to have the Access Road completed this year. General Government –  Mr. Deelo – The latest Air Monitor Program from Carnegie Mellon University will be forwarded to all council members. Recreation –  Ms. King would like to meet with the Pool Manager to discuss the activities scheduled at the pool Reports Manager’s/Police Report – Reported by Chief Madgar  Mr. Madgar, Mr. Martone, Mr. Sprecker and Ms. Hindman met with Team Fishel – they will be paving the newer back parking lot at no cost to the Borough. o In lieu of non-satisfactory paving, Folino agreed to perform additional paving for Beaver Borough April 9, 2019 Page 2  Basketball court – Beaver Area School District submitted the grant, should have a response within 60-90 days o The school will not split the cost with the Borough of Beaver if they do not receive the grant  Mr. Thomas stated he would like to discuss at the next Work Session the Borough paying for the basketball courts if the school does not receive the grant.  Ms. Hindman - Rental Registration update o March: Registered 38, Inspected 35, Re-inspection 11 o 2019 Totals: Registered 532, Inspected 98, Re-inspection 23  Chief Madgar, Ms. Hindman, Mayor Hamilton, Mr. Sprecker and Mr. Dioguardi from Rome Monument, met to discuss a War on Terror Memorial. A sketch of the memorial will be brought to council. President’s Report – Reported by Sean Snowden  Thanked Mr. Thomas for keeping Council informed with the road construction and Mr. Sebastian for getting the Rental Registration program started o Mr. Sebastian thanked Ms. Hindman and Chief Madgar for their help with the Rental Registration program Mayor Hamilton –  Beaver qualified for Tree City USA again this year o Arbor Day is scheduled for Saturday, April 27th at 10:00AM o Thanked the Tree Commission and Council for their support Fire Department – No report Emergency Management Coordinator – No report Borough Engineer and Borough Municipal Authority Engineer –  March 2019 Borough Engineer monthly reports enclosed in council packet Solicitor Report –  The injunction hearing between Beaver Borough and Bridgewater is scheduled for April 23, 2019 Old Business Motion – Approve the 2019 Paving Project bid Motion by Mr. Thomas, I move that Beaver Borough Council approve the bid of Youngblood Paving for the 2019 Road Paving Project in the amount of $323,844.64 in accordance with the Borough Engineer letter to council dated April 4, 2019. Pending review and approval by Borough Solicitor. Seconded by Mr. Rathbun. Council had discussions regarding the motion. Voice vote passed unanimously. April 9, 2019 Page 3 Motion – Highway Department Promotions Motion by Mr. Thomas, I move that Beaver Borough Council approve the promotions of Brian Grove and Chris Trent to the level of Apprentice 2 effective May 1, 2019. Seconded by Mr. Deelo. Council had discussions regarding the motion. Voice vote passed unanimously. Motion – Hire Highway Department vacancy Motion by Mr. Thomas, I move that Beaver Borough Council hire Michael Bitcko in the position of Laborer in the Highway Department effective May 1, 2019. Seconded by Mr. Rathbun. Council had discussions regarding the motion. Voice vote passed unanimously. Motion – Amend Chapter 15, Motor Vehicles and Traffic Ordinance Motion by Mr. Thomas, I move that Beaver Borough Council authorize our Solicitor to amend and advertise Chapter 15, Part 306, 309 and 310 of the Code of Ordinances relating to Motor Vehicles and Traffic. Remove all current parking meters in Beaver Borough and establish in place a 2-hour parking restriction except those spots designated in front of the Post Office as 15 minute parking on weekdays and 2-hour parking on weekends. Adjust violation from $10 to $25. Seconded by Ms. King. o After Council discussion, the motion was amended Motion by Mr. Thomas, I move that Beaver Borough Council authorize our Solicitor to amend Chapter 15, Part 306, 309 and 310 of the Code of Ordinances relating to Motor Vehicles and Traffic. Motion – BOOM Fireworks Sponsorship Motion by Mr. Andres, I move that Beaver Borough Council support Beaver County BOOM at the rate of $1,250, Silver Sponsorship, for the annual fireworks display. Seconded by Mr. Perini. Council had discussions regarding the motion. Voice vote passed unanimously. (Mr. Sebastian abstained from the vote) New Business Motion – Permission to place a donated National Register of Historic Places Marker Motion by Mr. Thomas that Beaver Borough Council approve the attached letter to the William G. Pomeroy Foundation, granting permission to place a donated historic plaque at the Fort McIntosh Site on River Road (Tax Parcel 15-001-0700). Council had discussions regarding the motion. Seconded by Ms. King. Voice vote passed unanimously. Motion – Advertise Public Meeting Motion by Mr. Thomas, I move that Beaver Borough Council authorize the Solicitor to advertise a public meeting to be held on Tuesday, April 23, 2019 at 6:30PM regarding the Beaver Borough 2019 Paving Project. Seconded by Ms. King. Council had discussions regarding the motion. Voice vote passed unanimously. April 9, 2019 Page 4 Motion – Purchase 2012 F350 Truck Motion by Mr. Thomas, I move that Beaver Borough Council approve the purchase of a 2012 F350 Truck (64,000 miles) including plow and stainless steel insert salt spreader in the amount of $23,000 from Brighton Township Municipal Authority. Seconded by Mr. Sebastian. Council had discussions regarding the motion. Voice vote passed unanimously. Motion – Collective Bargaining Agreement Motion by Mr. Sebastian, I move that Beaver Borough Council authorize the Solicitor to continue negotiating with the Police Union in an attempt to resolve the sick day buy back provision of the Collective Bargaining Agreement with the Police. Seconded by Mr. Thomas. Council had discussions regarding the motion. 8:35PM Entered into Executive Session to discuss Collective Bargaining Agreement and a Municipal Authority legal issue  Mr. Madgar attended the Executive Session to answer any direct questions and then left since the discussion will be regarding the police contract 9:15PM Executive Session ended Motion by Mr. Sebastian, I move that Beaver Borough Council authorize the Solicitor to continue negotiating with the Police Union in an attempt to resolve the sick day buy back provision of the Collective Bargaining Agreement with the Police. Seconded by Mr. Thomas. Roll Call Vote: Mr. Thomas – No, Ms. McKean – No, Mr. Andres – Yes, Ms. King – Yes, Mr. Sebastian – Yes, Mr. Perini – No, Mr. Rathbun – No, Mr. Deelo – No, Mr. Snowden – Yes. Motion failed, 4-5. Motion by Mr. Rathbun, I move that Beaver Borough Council authorize the Solicitor to engage in communications with the Police Union in an attempt to resolve the sick day buy back provision of the Collective Bargaining Agreement with the Police.
