The meeting was called to order at 6:30 p.m. by Chairman Dan Nollman. Roll was called and a quorum declared. Chairman Nollman noted that all Zoning Board cases heard at this meeting would be considered at the October 21, 2019 City Council meeting. Chairman Nollman explained the emergency procedures. Chairman Nollman asked if there were any corrections to be noted for the September 26, 2019 Zoning Board of Appeals meeting minutes. With no corrections, the minutes were approved by the Board. ------------------------------------------------------------------------------------------------------------------------------------------------------------------ 62 - OCT19 – James and Carolyn Needles – A request for an Area/Bulk Variance to permit a fence 1 foot in height above the allowed maximum of 6 feet at 405 Garden Boulevard (Parcel number 08-23.0-307-046) located in an “A-1” Single-Family Residence District. (Applicable sections of the Zoning Code: 162.392 (F), 162.570) Ward 7 Applicant James Needles explained his request to install a seven-foot fence which is one foot above the allowable maximum of six feet at 405 Garden Boulevard. Chairman Nollman asked what materials will be used. Mr. Needles stated the fence would be vinyl. Paul Storment, abutting neighbor of subject property, spoke in opposition of the fence. Mr. Storment stated he believes the fence will be an eyesore, will reduce property value and decrease his view. Additionally, Mr. Storment read into the record an affidavit from Alice Gyerman, abutting neighbor at 401 Garden Blvd(see attached). Annissa McCaskill, Interim Residential and Commercial Development Services Director clarified the allowable height is six feet. Applicant Carolyn Needles gave photos to the Zoning Board of Appeals to show the current view of the backyard without the fence (photos attached). Steve Zimmerman asked where the fence will be located. Mr. Needles stated the fence will be located seven feet off the property line. 62-OCT19: A motion was made to APPROVE by Rebecca Boyer. It was seconded by Don Rockwell. The motion carried 4-0-1. Tim Price abstained.  63 - OCT19 – Golden Orchard, LLC – A request for an Area/Bulk Variance for parcel number 08-36.0-403-032 (649 Lake Mead Court) to permit a principal building lot coverage 3% over the allowed 30% maximum percentage of lot building coverage in an “A-1(H)” Single-Family Residence District. (Applicable sections of the Zoning Code: 162.122, 162.570) Ward 6 Applicant Steve Goldenberg explained his request for an Area/Bulk Variance to permit a building with a 33% lot coverage which is 3% over the maximum allowed 30% of lot coverage. Don Rockwell asked if all other setbacks and requirements are being met. Mr. Goldberg stated yes. Steve Zimmerman asked if Mr. Goldberg expects this to be an ongoing issue with upcoming new construction. Mr. Goldberg stated it’s difficult to anticipate what types of homes will sell and lot coverage may be an issue when custom homes are requested. Mr. Rockwell asked what is planned to address this issue going forward. Mr. Goldberg stated he planned to work with the City staff on the issue. Annissa McCaskill, Interim Residential and Commercial Development Services Director clarified City staff was working with Mr. Goldberg on a solution; although, in this instance there is someone wanting to purchase and they do not have the time to go through an extended process to make changes. Tim Price asked if this 3% increase will cause a water run off issue. Ms. McCaskill verified if there is a PUD put in place the effect of increase for all lots would be reviewed at that time. 63-OCT19: A motion was made to APPROVE by Steve Zimmerman. It was seconded by Rebecca Boyer. The motion carried 5-0.  64 – OCT19 – Kingdom Life Christian Ministries – A request for a Use Variance to operate a church at 10400 West Main Street (Parcel number 02-26.0-425-027) located in a “C-2” Heavy Commercial District. (Applicable section of the Zoning Code 162.570) Ward 8 Applicant Karen Jethroe explained her request to relocate Kingdom of Life Ministries from 2901 West Main to 10400 West Main Street. Don Rockwell asked if the entire building will be utilized as a church. Ms. Jethroe verified the entire location will be used for their congregation. Alderman Ovian stated his concerns with safety and lighting and if there will be a need for security. Ms. Jethroe stated security will be in place as needed. Rebecca Boyer asked if the property has lighting. Ms. Jethroe stated the building had not been utilized in some time and they have recently had all lighting on the property reconnected and the sight is now well lit. 64-OCT19: A motion was made to APPROVE by Rebecca Boyer. It was seconded by Tim Price. The motion carried 5-0. Rebecca Boyer made a motion to ADJOURN, which was seconded by Don Rockwell. All members present voted in the affirmative.
