Standing Committee Members receive reports and information, ask questions and, when appropriate, vote on a recommended action for consideration by the full Council at the Regular Meeting. The notice of Committee Meetings identified below also serves as notice of Special Meetings of the City Council at the times identified as Council Members who are not members of the committee routinely attend and participate in the Committee Meetings. A Resolution Authorizing the Mayor to Enter into a Development p. 3 Agreement, a Lease Agreement and an Assignment & Assumption Agreement with Urban Strategies, LLC to Purchase and Redevelop 1314 Cornwall Avenue Tara Sundin, Economic Development Manager, provided a follow up to the September 24 presentation. The City must acquire the property, enter into a development agreement and enter into a lease agreement all at the same time. Action is sought prior to due dilegence period which ends on October 22. An Ordinance Amending the 2017-2018 Biennial Budget, Increasing p. 102 Appropriations in the General Fund to Purchase the Property at 1314 Cornwall Avenue Tara Sundin, Economic Development Manager, presented the total purchase cost for the land at 1314 Cornwall Avenue, including closing, which is $2,141,936. Discussion of 2019 Legislative Agenda p. 106 Gene Knutson / April Barker moved to recommend approval. MOTION CARRIED 6-0. Abstained: Terry Bornemann Brian Heinrich, Deputy Administrator, presented the 2019 Legislative Agenda, which is in partnership with the Port of Bellingham and Whatcom County and advocates for a shared agenda when the State Leislature convenes. 21982 4. Consideration of a Draft Ordinance Establishing Short-Term Rental p. 108 Regulations Lisa Pool, Senior Planner, presented an update on the key questions discussed during the last work session. Questions included: Q1. Will STRs in primary residences be allowed in residential zones? Yes. Administrative approval (Type I or Type II permit); Unit must serve as primary residence of applicant for no less than 270 days/year; No limit on number of rental days for individual bedrooms; Whole unit could be rented up to 95 days/year; No more than one STR permit per operator; In urban villages and commercial zones, Type I permit for all STRs (including those in primary residences). Q2. Will STRs in non-primary residences be allowed in residential zones? No. This prohibition would be reassessed when the Citywide housing vacancy rate reaches 4%. In urban villages and commercial zones, Type I permit for all STRs (including those in non-primary residences). Q3. Will STRs in accessory dwelling units be allowed? Committee Of The Whole Minutes Page 2 October 8, 2018  Yes and no. STRs would be allowed in legally-established attached ADUs citywide. STRs would be allowed in legally-established detached ADUs citywide, except for those in single-family zones. This prohibition would be reassessed when the Citywide housing vacancy rate reaches 4%. Q4. Will multi-family buildings include a cap on STRs in residential zones? Yes. STRs in condominiums would be limited to 1 unit or 25% of units, whichever is greater. A specific cap for other multi-family buildings is not needed, as operators in these zones may have no more than one STR. A long-term renter’s STR counts as the one permitted STR for both the long-term renter and owner. No caps in urban villages or commercial zones Q5. Will long-term renters be allowed to be STR operators? Yes. A tenant with at least a 270-day lease may be an STR operator during the lease period with the property owner’s permission. The renter is to attest that he/she is not acting as an agent of the property owner. Michael Lilliquist / Gene Knutson moved to recommend approval. MOTION CARRIED 7-0. 22067 5. A Work Session to Consider a Draft Ordinance Establishing p. 141 Regulations for Temporary Homeless Shelters Lisa Pool, Senior Planner, presented the draft ordinance, which establishes regulations for temporary homeless shelters, i.e. temporary building encampments, temporary safe parking areas, temporary tent encampments and temporary tiny house encampments. Michael Lilliquist / April Barker moved, subject to final drafting of the language, that two factors are added to the maximum are size determination in section C of Chapter 20.15.020: characteristics of the population to be served and necessary services provided. MOTION CARRIED 6-0-1. Terry Bornemann excused. Michael Lilliquist / Pinky Vargas moved to amend Chapter 20.15.020, section E to say "Fencing adequate to limit access to the site for safety and security reasons must be installed around the perimeter of the shelter site, provided that the fencing does not create a sight obstruction at the street or street intersections or curbs as determined by the City engineer. Fence material may include chain link or other temporary fencing materials up to six feet in height. The director may waive this requirement if there is sufficient vegetation, topographic variation, or other site conditions such that fencing would not be needed." MOTION CARRIED 6-0-1. Work Session on the Proposed 2019-2020 City Budget p. 194 Mayor Kelli presented an overview of the proposed 2019-2020 City Budget. The work session then moved into the Mayor's Boardroom for departmental presentations from Human Resources, Finance, Planning and the Whatcom Museum. Michael Lilliquist said we recently went through the process of appointing someone to the City Council vacancy. Michael Lilliquist / Gene Knutson moved to adopt a voting process ahead of time. MOTION CARRIED 6-0-1. Terry Bornemann excused Pinky Vargas said we have looking at the application process on our docket as well. Pinky Vargas / Gene Knutson moved to have the voting process and application process come forward together. MOTION CARRIED 6-0-1. Terry Bornemann excused. Mayor Kelli said she asked City Attorney Peter Ruffatto to do this for Council, so please communicate with the Legal Department. April Barker asked for an update on the Lummi Water Contract. Public Works Director Ted Carlson gave an update: the City has sent communication to the Lummi Nation and would like to meet at the staff level but has not had the chance to do so. The City is treating the request like any other wholesale water request. Dan Hammill announced that the City Council has appointed Councilmember Hannah Stone to the at-large position and congratulated her. Hammill needs to have Stone serve on his assigned committees.
