Call to Order The meeting was called to order by Council President Vargas at 7:00 p.m. Announcements & Upcoming Meetings: Bellingham City Council meets all requirements of the State of Washington Open Public Meetings Act. An Ordinance Relating to the Council Wards of the City, Providing for the Redistricting of Such Wards, and Amending Bellingham Municipal Code Chapter 1.16 which Describes Each Ward by Election Precincts AN ORDINANCE RELATING TO THE COUNCIL WARDS OF THE CITY, PROVIDING FOR THE REDISTRICTING OF SUCH WARDS, AND City of Bellingham Regular City Council Meeting Page 1 of 7 7/25/2016  AMENDING BELLINGHAM MUNICIPAL CODE CHAPTER 1.16 WHICH DESCRIBES EACH WARD BY ELECTION PRECINCTS Council President Vargas opened the public hearing. No citizens spoke and the public hearing was closed. Council President Vargas asked all Council members to remind all of each ward they represent. April Barker represents Ward 1. Gene Knutson represents Ward 2. Dan Hammill represents Ward 3. Pinky Vargas represents Ward 4. Terry Bornemann represents Ward 5. Michael Lilliquist represents Ward 6. Roxanne Murphy represents the City by serving as the At-Large representative. Terry Bornemann / Gene Knutson moved approval for first and second reading. MOTION CARRIED 7-0. 15-Minute Public Comment Period Joseph McDonald, spoke against the religious protestors that attend the Bellingham Farmer's Market. Tim Paxton, warned against the dangers of a gas pipeline under Franklin Street. He urged that the pipeline is under pressure and power lines are near it. Public Works / Public Safety 21313 1. Proposed Ordinance Accepting Donation of South Bay Stormwater Facility AN ORDINANCE ACCEPTING THE DONATION OF REAL PROPERTY AND IMPROVEMENTS KNOWN AS THE SOUTH BAY STORMWATER FACILITY Terry Bornemann / Roxanne Murphy moved approval for first and second reading. Proposed Ordinance Accepting Donation of Trickle Creek Stormwater Facility City of Bellingham Regular City Council Meeting Page 2 of 7 7/25/2016  AN ORDINANCE ACCEPTING THE DONATION OF REAL PROPERTY AND IMPROVEMENTS KNOWN AS THE TRICKLE CREEK STORMWATER FACILITY Terry Bornemann / Roxanne Murphy moved approval for first and second reading. Consideration of a Request by Lydia Place for Comprehensive Plan and Zoning Text Amendments to Allow Construction of up to 11 Studio Apartments Located at 1701 Gladstone Street in the Puget Neighborhood AN ORDINANCE OF THE CITY OF BELLINGHAM RELATING TO BELLINGHAM'S COMPREHENSIVE PLAN, AMENDING AREA 6 OF THE PUGET NEIGHBORHOOD PLAN AND SECTION 20.00.130 OF THE BELLINGHAM MUNICIPAL CODE, TABLE OF ZONING REGULATIONS FOR PUGET AREA 6 Gene Knutson / Roxanne Murphy moved approval for first and second reading. MOTION CARRIED 7-0. Committee Of The Whole 21266 1. Update on Current Jail Operations Staff presented and Council discussed the new booking restrictions imposed by Whatcom County. Additionally, staff presented and Council discussed City of Bellingham jail population numbers. Information only. 21315 2. Appointment of Voter Pamphlet For/Against Statement Committees for Greenways IV Levy The City has identified the following individuals for appointment to the Greenways IV Levy pro/for statement committee: Tim Douglas Rodd Pemble Julie Guy City of Bellingham Regular City Council Meeting Page 3 of 7 7/25/2016  To date, the City has not been able to identify any individuals interested in being appointed to the con/against committee. If anyone volunteers prior to Monday's City Council Meeting, those names will be provided to Council. Pinky Vargas / April Barker moved approval of the committee members to the Pro/For Committee for Greenways IV Levy. MOTION CARRIED 7-0. 21247 3. Review of the Draft 2016 Comprehensive Plan, Specifically the Economic Development Chapter and Environment Chapter Council directed staff to add a policy that refers to limiting upzones and rejecting increases in the density of development in the Watershed. Council directed staff to come forth with specific policy language relevant to limiting urban sprawl. 4. Approval of Minutes Gene Knutson / Roxanne Murphy moved approval of the July 11, 2016 minutes of the regular City Council meeting as submitted. MOTION CARRIED 7-0. 5. Old/New Business Roxanne Murphy praised the Tour De Whatcom event. Council President Vargas reminded all to vote in the State Primary. Ballots are due August 2, 2016. Executive Session - Report and Action only. 1. Potential Real Estate Sale or Lease Staff provided information on a potential real estate sale or lease. For information and discussion only. No action taken. 2. Potential Litigation: Claim No. 2015-50 Staff provided information on a potential litigation matter. Action: Gene Knutson / Terry Bornemann moved to authorize the Mayor to enter into a settlement agreement with the following terms: The City will agree to pay reasonable City of Bellingham Regular City Council Meeting Page 4 of 7 7/25/2016  and necessary expenses to fix and repair a driveway for damages that stem from a City project in the abutting right of way. MOTION CARRIED 7-0. 3. Potential Property Acquisition Staff provided information on a potential property acquisition. Action: Roxanne Murphy / April Barker moved to authorize the purchase of 20 acres in the Lake Whatcom watershed from Kenneth and Susan Morrill for $200,000, with an anticipated closing date of August 17, 2016. An Ordinance Amending the 2016 Fire Department Budget Relating to the City of Bellingham and Whatcom County Fire District 8 Interlocal Agreement (ILA) AN ORDINANCE AMENDING THE 2015/2016 ADOPTED BUDGET INCREASING REVENUE BY $840,553.00 AND EXPENDITURES BY $672,792.00 IN THE FIRE DEPARTMENT GENERAL FUND AS A RESULT OF AN INTERLOCAL AGREEMENT FOR STAFF TRANSFER FROM FIRE DISTRICT 8 TO THE CITY OF BELLINGHAM FIRE DEPARTMENT, WITH $167,761.00 BEING PLACED IN ESTIMATED ENDING RESERVES. An Ordinance Establishing an Independent Salary Commission To Review and Set the Salaries for the Elected Officials of the City of Bellingham AN ORDINANCE ESTABLISHING AN INDEPENDENT SALARY COMMISSION TO REVIEW AND FIX THE SALARIES FOR THE ELECTED OFFICIALS OF THE CITY OF BELLINGHAM. Pinky Vargas / Terry Bornemann moved to postpone 3rd and Final reading of the ordinance to the second meeting in January 2017 and to hold a Committee of the Whole meeting on that day to discuss the ordinance. MOTION CARRIED 6-1. Michael Lilliquist opposed. 21296 3. Ordinance Amending the 2015/2016 Adopted Budget to Account for Additional Funding in the Amount of $474,128 from the Department of Ecology for the Bioretention Hydrologic Performance Study, EV- 0133 AN ORDINANCE AMENDING THE 2015/2016 ADOPTED BUDGET INCREASING REVENUE IN THE PUBLIC WORKS STORM AND SURFACE City of Bellingham Regular City Council Meeting Page 6 of 7 7/25/2016  WATER FUND BY $474,128.00 AS A RESULT OF ADDITIONAL FUNDING FROM THE DEPARTMENT OF ECOLOGY FOR AN EXISTING INTERLOCAL SERVICES AGREEMENT, AND APPROPRIATING $474,128.00 IN RELATED EXPENDITURES. An Ordinance Amending the 2016 Budget, Transferring $52,413 from the Street Fund to the Governmental Debt Fund for Debt Service AN ORDINANCE AMENDING THE 2015/2016 BIENNIAL BUDGET TRANSFERRING $52,413.00 FROM THE STREET FUND TO THE GOVERNMENTAL DEBT FUND AND APPROPRIATING THOSE FUNDS FOR EXPENDITURE ON DEBT SERVICES COSTS.
