Call to Order The meeting was called to order by Council President Murphy at 7:00 p.m. Announcements & Upcoming Meetings: Bellingham City Council meets all requirements of the State of Washington Open Public Meetings Act. A Resolution Commending Todd Ramsay for His Service to the City of Bellingham Council Member Dan Hammill honored Todd Ramsay for his service with the Bellingham Police Department. He unexpectedly passed away earlier this month. He was a champion of community policing and an advocate for youth and low income residents of Bellingham. The City of Bellingham passed a Resolution honoring him for his years of service with the Police Department as well as the Bellingham community. Public Hearing for Consideration of Application for Bureau of Justice Grant in the Amount of $22,557 Flo Simon, Deputy Police Chief, presented an overview on the grant the Police Department applied for from the Bureau of Justice Assistance. Funds from the grant will replace an outdated piece of equipment from their Crime Lab. The equipment is used to detect evidence such as fibers, bodily fluids and fingerprints. Council President Murphy opened the Public Hearing. No citizens spoke, the Public Hearing was closed. The written record will remain open until a final decision, per Resolution #2013-09. 15-Minute Public Comment Period Garey Vodopich, voiced concern about a house in his neighbor that he called a public nuisance. He would like speed bumps installed to slow down the traffic in the area. Everett Barton, declared we are in an economic crises because of the high cost of housing and high rent. Michael Berres, member of the Whatcom Human Rights Task Force, discussed his concern about the first assignment of the Safe Spaces contract with the Whatcom Dispute Resolution Center. {AB #22012} Theresa Meurs, spoke in support of the Drop-in Center and relayed the services they provide. {AB# 22012} Lynne Oulman, a member of the Whatcom Human Rights Task Force, thanked Council for putting in time and effort to look at the complaint process. She also urged Council not to put off the goal of an ombudsman type service. {AB #22012} Bob Johnston, member of the Whatcom Human Rights Task Force, reported that he was hearted by the steps the City is taking to address complaints. He added that the Whatcom Dispute Resolution Center, specifically the pilot program, should involve an ombudsman's office, and to review the City's existing processes to make them more funtional and effective. {AB #22012} Doug Revelle, honored a fallen officer, by carrying on their work, and declared that the homeless persons are part of our system. We are neglecting them. Also discussed sex addiction. City of Bellingham Regular City Council Meeting Page 2 of 7 8/20/2018 Minutes  Amy Glasser, complained about her experience at the Lighthouse Mission and Drop-In Center and how it affects Homes Now. She called on the Council to call the Mission to complain about the lack of safety for those staying there. Bridget Reeves, employee of the Lighthouse Mission, addressed the concerns about the Mission and expressed reassurance that concerns for safety are being taken seriously. Council Standing Committee Meetings: Planning and Community Development Michael Lilliquist, Chair April Barker; Daniel Hammill 22025 1. Review Potential Approaches to Preserving Manufactured Home Parks in Bellingham Presentation during Committee. Staff report included 5 recommendations and Committee agreed to have staff pursue those suggestions. Additions or changes will be brought forward at a later meeting. Information only. 21982 2. Consideration of a Draft Ordinance Establishing Short-Term Rental Regulations Work session during Committee. Committee organized the discussion around 5 questions that are oulined in the packet and gave direction to staff. The ordinance will come before the full Council at a later meeting for consideration. Public Works and Natural Resources Gene Knutson, Chair Terry Bornemann; Michael Lilliquist 22026 1. Washington Conservation Corps End-of-Year Presentation Presentation during Committee. Information only. 22027 2. Bid Award for the Cordata/Stuart Roundabout, Bid 49B-2018 Gene Knutson / Dan Hammill moved to award Bid No. ES-0530 for Cordata Parkway/Stuart Roundabout to Ram Construction of Bellingham, WA as the lowest responsive, responsible bidder and to authorize the Mayor to enter into a contract with them for the amount of their bid, which is $1,328,996.30, which includes any applicable WSST. Approval to Enter into Loan Agreement for Roeder Sewer Lift Station Improvements with the Department of Ecology Gene Knutson / Michael Lilliquist moved final approval of Resolution #2018-20 that authorizes a loan agreement between the City of Bellingham and the State of Washington Department of Ecology for the Roeder Lift Station improvements project. Governors Point Wholesale Water Service Agreement Gene Knutson / Pinky Vargas moved to authorize the Mayor to enter into an agreement for wholesale water with Governors Point Land LP. Inter-Agency Agreement with Washington State Department of Ecology to Sponsor Two Washington Conservation Corps Crews for Natural Resource Projects Gene Knutson / Dan Hammill moved to authorize the Mayor to enter into an inter- agency agreement with Washington Department of Ecology to sponsor two Washington Conservation Crews for Natural Resource Projects. City of Bellingham Regular City Council Meeting Page 4 of 7 8/20/2018 Minutes  2. Old/New Business Michael Lilliquist reported that Homes Now! has had a working shower truck for several weeks. They need places to park/store the truck when not in use. They have locations for this month and next, and have requested the City's help for the month of October. Mayor Linville expressed she is happy to provide a place, but we must consider the City's liability if services are offered rather than just parking. She also clarified that, at an earlier meeting, she stated that the Lighthouse Mission will be building a shower truck too. April Barker commented about the Albertson's grocery site. She explained that the deed restriction includes a restriction for a new grocery store to go into the old Albertson's space. April Barker / Michael Lilliquist moved to add an agenda bill item to a Planning Committee meeting to discuss non-compete agreements. MOTION CARRIED 6-0. Terry Bornemann excused. Executive Session – Report and Action only. 1. Potential Property Acquisition Staff provided information on a potential property acquisition. Gene Knutson / Dan Hammill moved to authorize the purchase of 24.17 acres, wetland mitigation parcel from Lowell G. Radder, Nancy Radder, William E. Kramer and Estate of Jerelyn J. Kramer for $290,000, tax parcel number 380202 209221 0000, with an estimated closing date of August 22, 2018. The purchase price will be paid by the Greenways Fund. MOTION CARRIED 6-0. Terry Bornemann excused. 2. Potential Litigation Staff provided information on a potential litigation matter, claim No. 2018-34. Pinky Vargas / Dan Hammill moved to authorize the Mayor into a settlement agreement with the following terms: resolution of claim number 2018-34 for the payment of $24,708.95 to the claimant for damages related to sewer back ups. City of Bellingham and Washington State Department of Labor & Industries, Whatcom County Superior Court Cause No. 16-2-01427-1: Staff provided information on a litigation matter. Mayor Linville announced that she has appointed Andy Asbjornsen as the Interim Finance Director during the transition period and will conduct a nationwide search for a permanent Finance Director. The search will also include internal applicants. 22030 1. Mayor's Reappointment of Lori Clough to the Museum Foundation Board (Approval) Gene Knutson / April Barker moved to authorize the Mayor to reappoint Lori Clough to her second term, which will expire on July 27, 2021, at which time she may be reappointed. Mayor's Reappointment of Angela Nelson and Appointment of Olin Anderson to the Lake Whatcom Watershed Advisory Board (Approval) Michael Lilliquist / Dan Hammill move to authorize the Mayor to reappoint Angela Nelson and Olin Anderson to the Lake Whatcom Watershed Advisory Board. Angela Nelson will serve her second term, which will expire on July 6, 2021, at which time she may be reappointed. Olin Anderson will serve his first term, which will expire on August 20, 2021, at which time he may be reappointed. MOTION CARRIED 6-0. Terry Bornemann excused. 22032 3. Mayor's Appointment of Greg Arnold to the Community Development Advisory Board (Information) The Mayor appoints Greg Arnold to his first partial term on the Community Development Advisory Board which will expire on November 1, 2020, at which time he may be reappointed.
