The Board of Trustees of the Village of Bellport shall hold a public hearing on the tentative budget on April 08, 2024 at 6:00pm at the Bellport Community Center located at 4 Bell Street, Bellport NY, followed by the regular scheduled Work Session. At such hearing, any person may be heard in favor of or against the tentative budget as compiled, or for or against any item or items therein contained. Michael Young – Zoning Board of Appeals, Architectural Review Board, Beautification Committee, Planning Board, Historical Preservation, Yacht Club/Sailing Foundation • Update on review of Zoning Codes Open To the Public: 1) RESOLUTION PURSUANT TO VILLAGE LAW 3-302, CHANGING THE TERMS OF OFFICE OF MAYOR AND TRUSTEES FROM TWO TO FOUR YEARS WHEREAS the term of office of the Mayor and the Trustees of the Village of Bellport is currently two (2) years Page | 2  DRAFT APRIL 22, 2024 WHEREAS, New York State Village Law (“Village Law”) § 3-302(5)(a) provides that the term of office of the Mayor and Village Trustees shall be two years, unless by resolution or local law subject to permissive referendum the Board of Trustees adopts four-year terms for the Mayor and the Village Trustees; and WHEREAS it appears to be in the best interest of the Village to exercise the authority conferred by Village Law § 3-302(5)(a) at this time and extend to four (4) years the term of office of Mayor and Trustees of the Village of Bellport; NOW THEREFORE, BE IT RESOLVED that Board of Trustees of the Village of Bellport, pursuant to the authority conferred upon it by Village Law § 3-302(5)(a) does hereby find, determine and resolve as follows: 1. That the term of the office of Mayor of the Village of Bellport shall be four (4) years. 2. That the term of the office of Trustee of the Village of Bellport shall be four (4) years. 3. That such four-year terms shall commence for each Village Trustee position and for the Village Mayor position at 12 noon on the First Monday following the next general election at which the office of said Trustee of the Village of Bellport or Mayor of the Village of Bellport is to be filed. 4. That in accordance with the provisions of the Village Law, this resolution shall not become operative or effective until and unless thirty (30) days have elapsed after it adoption and no petition protesting against this Resolution, signed and authenticated as required by Village Law § 9-902(1) has been filed with the Village clerk of the Village of Bellport, or if such petition is so filed, a proposition for the approval of this Resolution has been submitted at the next general election or a special election for that purpose pursuant to said Section and received the affirmative vote of a majority of the voters voting thereon (Exhibit #1) Resolution: Approve the change of term of Mayor and Trustees from two (2) years to four (4) years. Discussion for changing term limits for Mayor and Trustees from ten years to twelve years and set Public Hearing (Exhibit 1). RESOLUTION OF THE VILLAGE OF BELLPORT BOARD OF TRUSTEES TO HOLD A PUBLIC HEARING TO CONSIDER AMENDMENTS TO VILLAGE CODE SECTIONS 2-302 AND 2-310 SO AS TO CHANGE TERM LIMITS FOR THE MAYOR AND VILLAGE TRUSTEES WHEREAS, it is in the interest of the residents of the Village of Bellport to limit the overall number of consecutive terms a mayor or trustee may serve in the same office; and Page | 3  DRAFT APRIL 22, 2024 WHEREAS, the Board of Trustees believes that term limits are beneficial as they create predictable vacancies allowing for the opportunity for new leadership with new ideas, while at the same time promoting and maintaining policy stability and sufficient continuity and accountability enabling the oversight for and accomplishment of long-term Village goals; and WHEREAS, the Village Code at §§ 2-302 and 2-310 already provides for an overall term limit of ten (10) consecutive years for the mayor and the trustees; and WHEREAS, the Board of Trustees believes it to be in the best interest of the Village to change the existing ten-year overall term limit to a twelve-year overall term limit; and WHEREAS, New York State Municipal Home Rule Law §§ 10(1)(i) and (ii)(a)(1) permit local government to enact and amend laws relating to the powers, duties, qualifications, number, mode of selection and removal, and terms of office of its officers; NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the Village of Bellport will hold a public hearing on May 13, 2024 at 6:00 pm at Bellport, New York, to consider the amendment of the Village Code to provide for a twelve year term limit for the mayor and Village trustees instead and in place of a ten year term limit, as set forth in the proposed amendments to Village Code §§ 2-302 and 2-310, included herewith, and to hear all person that are interested in the adoption of such tax exemption. PROPOSED AMENDMENTS Sec. 2-302. - Term limits. (a) After the effective date of this section, Neither the mayor nor any member of the board of trustees shall serve in excess of five (5) three (3) consecutive four-year terms in office or ten (10) a total of twelve (12) consecutive years after the effective date of this section in such position. (b) In the event any such person has served five (5) three (3) consecutive four-year terms in office or a total of ten (10) twelve (12) consecutive years in the same position, that person shall not be qualified to serve, or be elected to serve for a period of four (4) years thereafter for said position. (c) No person shall serve in excess of three (3) consecutive terms or twelve (12) consecutive years after the effective date of this section in the office of village justice. Page | 4  DRAFT APRIL 22, 2024 (d) In the event that any such person has served three (3) consecutive terms or twelve (12) consecutive years in the office of village justice, that person shall not be qualified to be elected to serve in such capacity for a period of four (4) years thereafter. Sec. 2-310. - Term limits. (a) No person shall serve on the board of trustees in excess of five (5) three (3) consecutive four-year terms in office or a total of ten (10) twelve (12) consecutive years. (b) In the event a person has served five (5) three (3) consecutive terms or ten (10) a total of twelve (12) consecutive years as a member of the board of trustees, that person shall not be qualified to serve as a member of the board of trustees for a period of four (4) years thereafter. (c) No person shall serve in excess of three (3) consecutive terms of twelve (12) consecutive years in the office of village justice. (d) In the event that a person has served three (3) consecutive terms or twelve (12) consecutive years in the office of village justice, that person shall not be qualified to serve in such capacity for a period of four (4) years subsequent thereto. (e) No person shall be qualified to serve, not be qualified to be elected to serve, in any elective position unless that person shall be capable of serving the complete term of office in accordance with the term limit provisions provided herein.Sec. 2-311. - Service limits. No person shall be qualified to run for, be elected to, or serve in, any elective office of the village if that person has more than twenty-five (25) years of service in elective office in the village. Sec. 2-312. - Intent. It is the intent of this division that in calculating terms of service and years of elective service for any person, that such elective service occurring before the date of passage of this division shall be included in determining the qualification of any person to serve as an elected official of the village. It is further intended that no person presently serving in an elective office shall be disqualified from serving the complete term of office as a result of any provision of this local law. Sec. 2-313. - Intent/supersession. Page | 5  DRAFT APRIL 22, 2024 It is the intent of this division to supersede the provisions of Village Law §§ 3- 300(1), 3-300(2), 3-300(4), 3-312(4), 3-312(5) pursuant to § 10 of the Municipal Home Rule Law to the extent necessary to carry out the provisions of this division. Resolution: Approve the General Fund Checking Abstract Report #1, consisting of 73 vendors totaling: $168,453.38. Resolution: Approve the Enterprise Fund Checking Abstract Report #2, consisting of 32 vendors totaling: $182,290.50. Resolution: Approve the Capital Browns & Dock Checking Abstract Report #3, consisting of 3 vendors totaling: $2,895.81. Resolution: Approve the Board Meeting minutes of March 25, 2024 as presented. Special Events: Resolution: Approve the request by Meaghan Shannon to conduct paddleboarding lessons (Individual and Group Sessions) during the summer season, use of Row Boat Beach and Mothers Beach ($800.00 for the season). Resolution: Approve the request by Rotary Club of Bellport hold a Blood Drive on May 21, 2023, 11:00 am to 9:00 pm at the Community Center. Resolution: Approve the request by VFW Post 8300 to conduct the Memorial Day Parade on May 27, 2024 starting at 10:00 am. Resolution: Approve the request by Bellport Garden Club hold their Annual Plant Sale May 27, 2024 from 8:00 am to 1:00 pm at the Village Green in front of CVS. Resolution: Approve the request by Jules Radino hold a Drum Recital at the Bellport Bandshell on June 9th (rain date June 15th) from 11:00 am to 1:00 pm. Resolution: Approve the request by South Country Education Foundation Inc. hold the Annual Auction and Cocktail Party, July 13th at 40 Academy Lane from 10:00 am to 10:00 pm. Resolution: Approve the request by the Bellport Village Program Fund place a seasonal event sign on the green swale at CVS. Resolution: Approve the 2024 Bellport Village Election of Village Justice and two (2) Trustee seats to be held on Tuesday, June 18, 2024 from 7:00 am – 9:00 pm at the Bellport Community Center, located at 4 Bell Street, Bellport, New York 11713. Resolution: Approve Registration Day on June 8, 2024 from 12:00 pm – 5:00 pm in Village Hall. All registrants must have a valid resident ID card. ID cards will not be printed after 12:00 pm on Saturday June 8, 2024. Village Hall will be opened on Saturday’s starting May 4 th through July 6th, 2024 from 9:00 am – 12:00 pm Resolution: Approve Lorraine Crowley as Chief Election Inspector for the 2024 Election, as well as 4 additional inspectors (individuals to be determined). Resolution: Approve the donation from Bellport Village Program Fund Inc. in the amount of $1,656.00 for the 2024 beach raking (Saturdays). Resolution: Approve the Compensated Absences Payout for Kyle Geraghty (resigned March 28, 2024) in the amount of $7,589.79. Resolution: Approve $4,000 from anonymous donors to cover the speaker’s fee and expenses for the Tallamy event on May 25, 2024. Resolution: Approve the purchase of an excavating machine at a cost of $35,300.00 for DPW. Resolution: Approve a “Boater Safety” course sponsored by Senator Dean Murray at the Community Center on July 13, 2024 or July 14, 2024 from 8:30 am – 4:30 pm. Resolution: Approve the hiring of Steve Williams as a seasonal employee, to complete work on Village Hall, effective May 13, 2024, at a rate of $60.00 per hour. Resolution: Approve C & G Cleaning Solutions for cleaning services, at a yearly rate of $19,140.00, effective May 1, 2024 to include Village Hall, Community Center, Marina Bathrooms and DPW.
