Belton City Council Meeting December 10, 2019 - 5:30 P.M. The Belton City Council met in regular session in the Wright Room at the Harris Community Center with the following members present: Mayor Marion Grayson, Mayor Pro Tern Wayne Carpenter and Councilmembers David K. Leigh, John R. Holmes, Sr. , Craig Pearson, Guy O'Banion and Dan Kirkley. Staff present included Sam Listi, Gene Ellis, John Messer, Michelle Garcia, Mike Rodgers, Susan Allamon, Charlotte Walker, Cheryl Maxwell, Matt Bates, Wes Gilbreath, Paul Romer, Chris Brown, Angellia Points, Cynthia Hernandez, Bob van Til and Kim Kroll. The Pledge of Allegiance to the U.S. Flag was led by Councilmember Craig Pearson and the Pledge of Allegiance to the Texas Flag was led by Director of Parks and Recreation Matt Bates. The Invocation was given by Dr. Claudette Morgan-Scott, Pastor of Shiloh Worship Center. Mayor Grayson thanked Matt Bates, Director of Parks and Recreation, and his staff, as well as Judy Garrett, CVB and Retail Coordinator, for the amazing Christmas on the Chisholm Trail event that was held on December 6th and 7th . 1. Call to order. Mayor Grayson called the meeting to order at 5:30 p.m . 2. Public Comments. (Audio 2:54) Mayor Grayson introduced the City's new Director of Finance, Mike Rodgers. He thanked Council for the opportunity to work in Belton. Shannon Wittmer, 1105 Steamboat Drive, Hewitt, Texas, explained operations of Goodwill in the Heart of Texas area. She explained that the closure of the Temple store would not adversely affect services in the area, and no other closures are planned . 3. Receive Child Safety Fee funds in the amount of $23,014.65 from Bell County. (Audio 7:32) Bell County Tax Assessor-Collector, Shay Luedecke, presented the City with a check for $23,014.65 which will be passed along to the Belton ISO for their Crossing Guard program. 4. Recognize the Finance Department for receipt of the Certificate of Achieve- ment for Excellence in Financial Reporting for Fiscal Year 2018. (Audio 10:23) City Manager Sam Listi recognized the Finance Department for receiving this prestigious award for the 33 rd consecutive year. He thanked Assistant Director of Finance Susan Allamon for her leadership over the last several months as the Interim Director of Finance. Belton City Council Meeting December 10, 2019- Page 2 Consent Agenda (Audio 11 :46) Items 5-9 under this section are considered to be routine by the City Council and may be enacted by one motion. If discussion is desired by the Council, any item may be removed from the Consent Agenda prior to voting , at the request of any Councilmember, and it will be considered separately. 5. Consider minutes of the November 26, 2019, City Council Meeting. 6. Consider authorizing an lnterlocal Agreement with the City of Temple for the use of a Temple fire engine until Belton's fire engine is back in service. 7. Consider a resolution granting the City Manager, Director of Finance, Assistant Director of Finance and designated deputy the authority to conduct financial transactions on behalf of the City of Belton. 8. Consider authorizing the purchase of the following: A. Asphalt recycler for the Streets Department from Crafco through the HGACBuy purchasing cooperative. B. SCBA Air Packs and accessory equipment for the Fire Department from Casco through the BuyBoard purchasing cooperative. 9. Consider authorizing the City Manager to enter into an lnterlocal Agreement with Bell County Municipal Utility District No. 1 to provide solid waste collection services. Upon a motion for approval by Councilmember Kirkley, and a second by Councilmember Pearson , the Consent Agenda, including the following captioned resolution, was unanimously approved by a vote of 7-0. RESOLUTION NO. 2019-25-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BEL TON, TEXAS, GRANTING THE CITY MANAGER, DIRECTOR OF FINANCE, ASSISTANT DIRECTOR OF FINANCE AND DESIGNATED DEPUTY THE AUTHORITY TO CONDUCT FINANCIAL TRANSACTIONS ON BEHALF OF THE CITY OF BELTON. Planning and Zoning 10. Consider a final plat of The Ridge at Belle Meadows Phase I, compr1smg 34.747 acres, located on the south side of W. Avenue 0 1 between S. Loop 121 and Connell Street. (Audio 13:28) Belton City Council Meeting December 10, 2019- Page 3 Councilmember Kirkley made a motion for approval of the final plat of The Ridge at Belle Meadows Phase I, subject to the following conditions: • Approval of reduction in front yard setback from 25' to 20' for single family lots in Blocks 3 and 4. • Approval of variance request for the parkland dedication/fee requirement for the duplex development on Block 1, Lot 2, to allow privately maintained amenities with the condition that a Certificate of Occupancy will not be issued for the duplex development until the amenities are in place, or the park fee ($24,000 for 120 duplex dwelling units) is paid and placed in an escrow account. Park fee of $8,200 will be paid for the 41 single family units proposed in Phase I, due at time of plat signatures. • All items addressed in the City's December 10, 2019 , letter of conditions to the applicant. The motion was seconded by Councilmember Holmes, and was unanimously approved upon a vote of 7-0. Miscellaneous 11. Consider authorizing the City Manager to execute a contract for the East Street Sidewalk project in conjunction with the Belton Economic Development Corporation, and any change orders associated with the contract, not to exceed the amount authorized under State law. (Audio 22:42) Upon a motion for approval by Mayor Pro Tern Carpenter, and a second by Councilmember Pearson , the contract with TTG Utilities was unanimously approved by a vote of 7-0. 12. Hold a public hearing and consider an ordinance on first reading authorizing franchise agreements for commercial solid waste services with the following companies: (Audio 28:25) Waste Connections Temple Iron & Metal Sunbright Disposal Services Eagle Disposal Waste Management Red Box Plus Public Hearing: No one spoke for or against. Upon a motion for approval by Councilmember Holmes, and a second by Councilmember Pearson , the franchise ordinances were unanimously approved on Belton City Council Meeting December 10, 2019- Page 4 first reading by a vote of 7-0. Second reading will be held at the City Council meeting scheduled for January 14, 2020. 13. Consider a response to Gated River One, LLC, regarding the City's Right of First Refusal to purchase the northernmost 30 acres of the former Leon Valley Golf Course. (Audio 31 :25) Councilmember Kirkley made a motion to not purchase the northernmost 30 acres of the former Leon Valley Golf Course. The motion was seconded by Councilmember Pearson , and was unanimously approved upon a vote of 7-0. Executive Session 14. Executive Session pursuant to the provisions of the Texas Open Meetings Act, Chapter 551, Govt. Code, Vernon's Texas Codes Annotated, in accordance with the authority contained in Section 551.072, to discuss real estate transaction.
