Belton City Council Meeting January 14, 2020 -5:30 P.M. The Belton City Council met in regular session in the Wright Room at the Harris Community Center with the following members present: Mayor Marion Grayson, Mayor Pro Tern Wayne Carpenter and Councilmembers David K. Leigh, John R. Holmes, Sr., Craig Pearson, Guy O'Banion and Dan Kirkley. Staff present included Sam Listi, Gene Ellis, John Messer, Amy Casey, Mike Rodgers, Charlotte Walker, Cheryl Maxwell, Matt Bates, Wes Gilbreath, Paul Romer, Chris Brown , Angellia Points, Judy Garrett, Cynthia Hernandez, Bob van Til, Tina Moore and Kim Kroll. The Pledge of Allegiance to the U.S. Flag was led by Mayor Marion Grayson and the Pledge of Allegiance to the Texas Flag was led by City Manager Sam Listi. The Invocation was given by Alton McCallum, Police Chaplain . 1. Call to order. Mayor Grayson called the meeting to order at 5:31 p.m . 2. Public Comments. (Audio 2:14) There were none. Consent Agenda (Audio 2:18) Items 3-10 under this section are considered to be routine by the City Council and may be enacted by one motion . If discussion is desired by the Council, any item may be removed from the Consent Agenda prior to voting, at the request of any Councilmember, and it will be considered separately. 3. Consider minutes of the December 10, 2019, City Council Meeting. 4. Consider appointments/reappointments to Boards and Commissions: A. Reappoint Todd Schiller to the Central Texas Housing Consortium Board of Directors. B. Appoint David K. Leigh as a regular member and Marion Grayson as an alternate member of the KTMPO Policy Board. 5. Consider a resolution declaring that the updated January 1, 2020, population of the City of Belton is 22,532. 6. Consider an agreement with Siddons-Martin for repairs to Belton's damaged fire engine. 7. Consider a one-year extension to the contract with FleetCor Technologies Operating Company, LLC, through the National Intergovernmental Purchasing Alliance purchasing cooperative, for the purchase of fuel for City vehicles. Belton City Council Meeting January 14, 2020 - Page 2 8. Consider ordinances on second and final reading granting commercial solid waste franchises to the following companies: A. Waste Connections B. Temple Iron & Metal C. Sunbright Disposal Services D. Eagle Disposal E. Waste Management F. Red Box Plus 9. Consider authorizing an lnterlocal Agreement with Bell County, the City of Temple, Bell County WCID #1. Central Texas WSC, Brazos River Authority, the City of Rogers, Fort Hood, and the Clearwater UWCD for an Aquifer Storage and Recovery study in Bell County. 10. Consider authorizing the City Manager to execute an agreement with CTCOG to prepare a Benefit/Cost Analysis in support of a Federal BUILD Grant for 6th Avenue (FM 93) between IH 35 and Main Street (TX 317), and Connell Street between Loop 121 and IH 14. Councilmember Leigh asked that Item #6 be pulled for discussion. Upon a motion for approval of Items #1-5 and #7-10 by Councilmember Holmes, and a second by Councilmember Pearson , Consent Agenda Items #1-5 and #7-10, including the following captioned resolution and ordinances, were unanimously approved by a vote of 7-0. Upon a motion by Councilmember Leigh , and a second by Councilmember O'Banion , Consent Agenda Item #6 was unanimously approved upon a vote of 7-0. Planning and Zoning 11. Hold a public hearing and consider a zoning change from Agricultural District to Commercial-Two Zoning District on a 5 acre tract located at 8588 and 8600 Amity School Road, west of IH 35 and south of Amity School Road . (Audio 8:45) Public Hearing: no one spoke for or against. Upon a motion by Councilmember O'Banion , and a second by Pearson, 8588 and 8600 Amity School Road was rezoned to Commercial-Two upon a vote of 7-0. ORDINANCE NO. 2020-07 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM AGRICULTURAL TO COMMERCIAL-TWO DISTRICT ON A 5 ACRE TRACT, WITH DEVELOPMENT TO BE REGULATED UNDER TYPE AREAS 2 AND 4 DESIGN STANDARDS. Belton City Council Meeting January 14, 2020 - Page 5 12. Hold a public hearing and consider a final plat of Three Creeks Phase IA Subdivision. comprising 5.45 acres, being a replat of Lot 13. Block 91 Three Creeks Phase I. to create 13 residential lots. on the east side of Imogen Drive. between Juno Drive and Lucius Lane. in Belton's ETJ. Upon a motion by Councilmember Leigh, and a second by Mayor Pro Tern Carpenter, the final plat of Three Creeks Phase IA was unanimously approved upon a vote of 7-0. 13. Consider a final plat of The Ridge at Belle Meadows Phase II. comprising 8.334 acres. located on the south side of W. Avenue 0 1 between S. Loop 121 and Connell Street. (Audio 27:25) Councilmember Holmes made a motion for approval of the final plat of The Ridge at Belle Meadows Phase II, subject to the following conditions: • Approval of reduction in front yard setback from 25' to 20' for single family lots in Block 6. • Approval of variance request for key lot requirement to allow a 15' setback along Dowdy Drive for Lot 32, Block 5. • All items addressed in the City's December 30, 2019, letter of conditions to the applicant. The motion was seconded by Councilmember Kirkley, and was unanimously approved upon a vote of 7-0. Miscellaneous 14. Consider authorizing the City Manager to execute a contract with Lone Star Paving for the 2020 Street Overlay Proiect. and any change orders associated with the contract. not to exceed the amount authorized under State law. Hold a public hearing and consider an ordinance amending "Chapter 24 - Vehicles for Hire" of the Code of Ordinances. ORDINANCE 2020-08 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEL TON, TEXAS, REPEALING AND REPLACING CHAPTER 24 OF THE CODE OF ORDINANCES OF THE CITY OF BELTON DEALING WITH "VEHICLES FOR HIRE;" PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN OPEN MEETINGS CLAUSE 16. Consider an ordinance amending the City of Belton Fee and Rate Schedule by adding fees for Taxi/Ground Transportation Services. ORDINANCE NO. 2020-09 AN ORDINANCE AMENDING THE FEE SCHEDULE OF THE CITY OF BELTON FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2019, AND ENDING SEPTEMBER 30, 2020. 17. Consider authorizing the Executive Director of the Belton Economic Development Corporation to execute a contract for the purchase of office space at 412 East Central Avenue. (Audio 53:10) Upon a motion for approval by Councilmember Kirkley, and a second by Councilmember O'Banion , BEDC's purchase of office space at 412 E. Central Avenue was unanimously approved upon a vote of 7-0. Executive Session The Mayor announced that the Executive Session was not needed. 18.
