Belton City Council Meeting August 23, 2022 – 5:30 P.M. The Belton City Council met in regular session in the Wright Room of the Harris Community Center. Members present included Mayor Wayne Carpenter, Mayor Pro Tem David K. Leigh (via videoconference) and Councilmembers Dan Kirkley, John R. Holmes, Sr., Daniel Bucher and Stephanie O’Banion. Councilmember Pearson was absent. Staff present included Sam Listi, Gene Ellis, John Messer, Amy Casey, Mike Rodgers, Jon Fontenot, Tina Moore, Chris Brown, Matt Bates, Bob van Til, Larry Berg, Daniel Aguirre, Charlotte Walker, Cynthia Hernandez, James Grant, Manuel Zapata and Jo-Ell Guzman. The Pledge of Allegiance to the U.S. Flag was led by Councilmember Stephanie O’Banion, and the pledge to the Texas Flag was led by Director of Planning Bob van Til. The Invocation was given by Councilmember Dan Kirkley. 1. Call to order. Mayor Carpenter called the meeting to order at 5:30 p.m. 2. Public Comments. (Audio 1:58) There were none. Consent Agenda Items 3-5 under this section are considered to be routine by the City Council and may be enacted by one motion. If discussion is desired by the Council, any item may be removed from the Consent Agenda prior to voting, at the request of any Councilmember, and it will be considered separately. (Audio 2:07) 3. Consider minutes of August 9, 2022, City Council Meeting. 4. Consider appointments to the following Boards and Commissions: A. Historic Preservation Commission (T.C. Lipe, Ann West, Tammie Baggerly) B. Civil Service Commission (Jimmy Rowton) Upon a motion by Councilmember Holmes, and a second by Councilmember Kirkley, Consent Agenda Items #3 and #4 were unanimously approved upon a vote of 6-0. 5. Consider authorizing the City Manager to execute a settlement agreement with Bridon American Corporation. Upon a motion by Councilmember Holmes, and a second by Councilmember Bucher, Consent Agenda Item #5 was unanimously approved upon a vote of 6-0. Regular Agenda 6. Consider appointments to the Youth Advisory Commission, administer oath of office to newly appointed members, and appoint a Chair. (Audio 7:19) Belton City Council Meeting August 23, 2022 – Page 2 Recreation Coordinator Manuel Zapata introduced the proposed members of the Youth Advisory Commission. Upon a motion by Mayor Pro Tem Leigh, and a second by Councilmember Kirkley, the following students were appointed to the Youth Advisory Commission: Christian Kunz, Chase Moore, Madison Combest, Oscar Constacio, Arianna Ryan, Nathan Ogden, Brendan Hall, Ashutosh Ghamande and Kira Woods, by a unanimous vote of 6-0. Christian Kunz was appointed Chair. City Attorney John Messer administered the Oath of Office to each of the newly appointed members. Planning and Zoning 7. Z-22-27 Hold a public hearing and consider a zoning change from Agricultural District to Single Family-3 Residential District for approximately 0.31 acres located at 3679 Village Hill Road and described as Village Hills, Block 1, Lots 16 and Part 17. Upon a motion for approval of the rezoning by Councilmember O’Banion, and a second by Councilmember Holmes, the rezoning was unanimously approved upon a vote of 6-0. ORDINANCE NO. 2022-42 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM AGRICULTURAL TO SINGLE FAMILY-3 RESIDENTIAL DISTRICT ON APPROXIMATELY 0.31 ACRES PROPERTY LOCATED 3679 VILLAGE HILL ROAD. 8. Z-22-28 – Hold a public hearing and consider a zoning change from Agricultural District to Multiple Family District on approximately 6.35 acres located at 708 W. 2nd Avenue, located at east of North Loop 121 and west of Sparks Street. (Audio 16:43) Planner Tina Moore presented this item. Public Hearing: no one spoke for or against. Upon a motion for approval of the rezoning by Councilmember Holmes, and a second by Mayor Pro Tem Leigh, the rezoning was unanimously approved upon a vote of 6-0 with the following conditions: • The development must conform to all applicable standards of the Multiple Family Zoning District. • A final subdivision plat, meeting the requirements of the adopted Subdivision Ordinance, is required. Belton City Council Meeting August 23, 2022 – Page 3 • Civil site plan and construction plans in compliance with adopted standards are required. ORDINANCE NO. 2022-43 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM AGRICULTURAL TO MULTIPLE FAMILY DISTRICT ON APPROXIMATELY 6.35 ACRE PROPERTY LOCATED 708 W 2ND AVENUE. 9. Z-22-29 Hold a public hearing and consider a zoning change from Commercial Highway to Planned Development – Commercial Highway District on approximately 3.282 acres located at 3463 W. US Highway 190 Service Road to allow a 55-foot-tall High Profile Monument Sign. (This item has been withdrawn by the applicant.) At its meeting on August 16, 2022, the Planning and Zoning Commission voted unanimously to deny the zoning change. The applicant has chosen not to appeal and has withdrawn the application. Miscellaneous 10.A. Consider funding alternatives for the construction of the Heritage Park Improvements Project. B. Consider award of bid and authorizing the City Manager to execute the construction contract for the Heritage Park Improvements Project, and any change orders associated with the contract, not to exceed the amount authorized under State law. C. Consider authorizing the City Manager to execute Heritage Park Improvements Project Change Order No. 1, a deductive change order, to remove all bid items not associated with the restroom construction included in Bid Item F. D. Consider authorizing the City Manager to execute a contract amendment to the professional services agreement with KPA Engineers for construction administration services related to the Heritage Park Improvements Project. (Audio 20:50) City Manager Sam Listi, Director of Public Works Matt Bates and Director of Finance Mike Rodgers presented this item. Upon a motion by Mayor Pro Tem Leigh and a second by Councilmember Holmes, utilizing additional funding for the project from the Water & Sewer Capital Projects Fund and the TIRZ Fund was unanimously approved upon a vote of 6-0.
