Presentations and Appointment 4.1 Life Saving Recognition – Detective Rodolfo Camacho, Officers Evan Trader, Tamara Cuchna, Terrence Mastrino and Tyson Lewis-Congratulations All! Public Safety Director Tim Larem presents life saving recognition award to Police Department members. Chief Larem briefs on the call that took place November 21 regarding an apartment fire, where a disabled individual was left inside. Responding officers took initiative to get individual out of apartment fire. President Lee commends the officers for their actions to save a life. 5. Public Hearings 6. Chief Larem states had the bulk of police activity in the last week. He states a car jacking was involved at an establishment Super Taco Express. He has addressed issues and concerns with establishment. He also states a search warrant took place at the business Happy Vape which resulted in confiscation of elicit product. Chief Larem suggest banning the sale of these products. President Lee gains consensus from board to take action to ban certain products at an upcoming Board meeting. He states State-funded projects have restrictions on tree removal due the endangered species of the long-eared bat. Trustee Hammar states Village has used 50 tons less of road salt so far this winter season then last year. There is no neighborhood watch meeting in January. Trustee Perez is working on entertainment for 2025 season. 9. Village President 2/4/25-Village Board Meeting at 6:30 p.m. President Lee reports did attend the inauguration for Illinois House of Representatives. Speaker Chris Welch was sworn in, great to see the Welch family. President Lee met with all department heads for quarterly meeting. He wants to thank Berkeley Park District for the loop path, ribbon cutting was held. Thanked Bonnie Routen and Lions Club for hosting the hot chocolate at the rink. Wants to thank resident Teresa McKelvy who provided electricity at the event. Congratulations to the Village of Hillside for hosting MLK breakfast. President Lee states Police doing a light survey Page 8 of 48  checking with what block possibly needs more lighting. 10. Village Administrator No Report 11. Village Attorney Attorney Greg Smith states spring session has begun with a flood of bills being presented. Last Village meeting there was discussion regarding lawn decorations, so he to presented a couple of options the Village could use. Board consensus was to draft an ordinance regarding restrictions on height and timeframe to display lawn decorations. 12. Public Comments and Questions Please limit comments to three (3) minutes in length, unless further granted by the Board Jerry Jenkins- 36-year resident wanted to make everyone aware that he is running for School District 209 board as a Berkeley representative and wants everyone's support. Bonnie Routen-Thanked everyone for participating in the Lions Club sponsored ice rink event. Also wanted to inform everyone of the Annual Winter Celebration sponsored by the Lions Club taking place on February 28 2025 at Alpine Banquets. Regarding expenditures and of note, there were increases in costs in regards to the staff salaries (one-time equity adjustment). In the other funds, staff expects increases in expenditures in the Tollway Fund related to the purchase of a new fire engine, MFT Fund due to costs related to the East Side Paving Project, and Capital Projects Fund related to the resurfacing of High Street (jointly with the City of Elmhurst). Staff still expects revenues to be higher than budgeted amounts which will be more than enough to offset increased expenses at the end of the current fiscal year, for general fund related expenses. Larem, Director of Public Safety DATE: August 20th, 2024 RE: Zoning Code Amendment to Regulate the Maximum Height of Lawn Decorations Background Title 12 (Zoning Regulations), Chapter 2 (Rules and Definitions) defines the various items regulated within the Code. The provisions set fourth within this section of the Village Code are designed to, among other things, provide a coherent uniformity throughout the Village and aid in the greater curb-appeal of all properties. Recently complaints have been brought before the Village Board in regards to large, stationary and animatronic hard decorations being displayed year-round. Some of these decorations pose a potential public hazard should they fall due to their heights and weight and others may constitute a public nuisance due to their flashing lights and audible recordings. Staff has concluded that the most effective way to address this ongoing issue is to amend the Zoning Code by adding the following sections to restrict the maximum height of any yard decoration to twelve (12’) feet outside of the allotted seasonal window of October 1st- January 15th: Section 12-2-3 of the Zoning Code be amended to add the following defined terms: LAWN DECORATION: A decorative item, including, without limitation, statue, lawn ornament, lawn art, figurine, fountain, or birdbath. Hemp-derived THC, CBD, and Kratom products are all examples or unregulated, chemically synthesized intoxicating compounds that are being sold as cannabis alternatives. Many of these products are marketed towards minors and the long-term health effects of these products remains uncertain. Recommendation Staff recommends that the Board of Trustees approve an Ordinance Amending the Village of Berkeley Village Code to Prohibit the Sale of Products Containing Illicit THC And Kratom. DELIVER OR DELIVERY: The actual, constructive or attempted transfer of possession, with or without consideration, whether or not there is an agency relationship. DRUG PARAPHERNALIA: All equipment, products and materials of any kind which are intended to be used unlawfully in planting, propagating, cultivating, growing, harvesting, manufacturing, compounding, converting, producing, processing, preparing, testing, analyzing, packaging, repackaging, storing, containing, concealing, injecting, ingesting, inhaling or otherwise introducing into the human body a controlled substance in violation of the Illinois controlled substances act, 720 Illinois Compiled Statutes 570/100 et seq., or the methamphetamine control and community 1 4929-7513-7043, v. 3 Page 33 of 48  protection act, 720 Illinois Compiled Statutes 646/1 et seq. The term includes, but is not limited to: A. Kits intended to be used unlawfully in manufacturing, compounding, converting, producing, processing or preparing a controlled substance. B. Isomerization devices intended to be used unlawfully in increasing the potency of any species of plant which is a controlled substance. C. Testing equipment intended to be used unlawfully in a private home for identifying or in analyzing the strength, effectiveness or purity of controlled substances. D. Diluents and adulterants intended to be used unlawfully for cutting a controlled substance by private persons. E. Objects intended to be used unlawfully in ingesting, inhaling, or otherwise introducing cocaine, hashish, hashish oil, methamphetamine or other controlled substances, as defined by law, into the human body including, where applicable, the following items: 1. Water pipes. 2. Carburetion tubes and devices. 3. Smoking and carburetion masks. 4. Miniature cocaine spoons and cocaine vials. 5. Carburetor pipes. 6. Electric pipes. 7. Air driven pipes. 8. Chillums. 9. Bongs. 10. Ice pipes or chillers. 11. Glass pipes. 12. Any item whose purpose, as announced or described by the seller, is for use in violation of this article. 2 4929-7513-7043, v. 3 Page 34 of 48  ILLICIT THC PRODUCT: Means any product, material, compound, isomer, acid, salt, mixture, or preparation: A. Used or intended for human consumption; B. That is not made, manufactured, sold, given away, bartered, exchanged, distributed, furnished, marketed, advertised, or otherwise held out for sale by cannabis business establishments duly licensed under the Compassionate Use of Medical Cannabis Program Act (410 ILCS 130/1, et seq.) or the Cannabis Regulation and Tax Act (410 ILCS 705/1-1, et seq.); and C. That contains: (1) any amount of synthetic cannabinoids of any kind, inclusive of acid forms, regardless of name, and including but not limited to THC-O, delta-8 tetrahydrocannabinol, and delta-10 tetrahydrocannabinol, (2) a total delta-9 tetrahydrocannabinol content concentration level in excess of 0.3% on a dry weight basis, or (3) a total delta-9 tetrahydrocannabinol content in excess of 0.5 milligrams per labeled serving or individual unit or 2.5 milligrams per package regardless of the number of labeled servings or individual units therein. KRATOM: Means any parts of the plant Mitragyna speciosa, whether growing or not, and any compound, manufacture, salt, derivative mixture, or preparation of that plant, including but not limited to mitragynine and 7-hydroxymitragynine, as defined in Section 5(a) of the Illinois Kratom Control Act, 720 ILCS 642/5(a), as may be amended. SYNTHETIC CANNABINOID: Means a cannabinoid-like compound that was produced using chemical synthesis, chemical modification, or chemical conversion, including in vitro biosynthesis or other bioconversion of such a method. Synthetic cannabinoids include the conversion of cannabinoids from one chemical structure to another, such as tetrahydrocannabinol (THC) that was produced by the conversion of cannabidiol. TETRAHYDROCANNABINOL OR THC: Means any naturally occurring or synthetic tetrahydrocannabinol, including its salts, isomers, and salts of isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation and any preparation, mixture, or substance containing, or mixed or infused with, any detectable amount of tetrahydrocannabinol or tetrahydrocannabinolic acid (THCA), including, but not limited to, delta-8-tetrahydrocannabinol, delta-9-tetrahydrocannabinol, delta- 10- tetrahydrocannabinol, tetrahydrocannabolic acid, tetrahydrocannabipherol, or hexahydrocannabinol, however derived. For the purposes of this definition, "isomer" means the optical, position, and geometric isomers. 3 4929-7513-7043, v. 3 Page 35 of 48  TOTAL DELTA-9 THC CONTENT: Means the value determined after the process of decarboxylation, or the application of a conversion factor if the testing methodology does not include decarboxylation, that expressed the potential total delta-9 tetrahydrocannabinol content derived from the sum of the THC and THCA content and reported on a dry weight basis, to be calculated either by using a chromatograph technique using heat, such as gaschromatography, through which THCA is converted from its acid form to its neutral form, or by using a liquid chromatograph technique, which keeps the THCA intact, and using the following conversion: [Total THC = (0.877 x THCA) + THC] which calculates the potential total THC in a given sample. Amendment Two: Section 6-5D-4 is created and will provide as follows: 6-5D-4: SALE OF ILLICIT THC PRODUCTS AND KRATOM PROHIBITED: A. Sale Prohibited. It is unlawful for any person or retail establishment to sell, or offer for sale, give away, or deliver any illicit THC product or kratom. B. Penalties. Any person or retail establishment whose agent or employee violates this Section will be fined not less than $200.00 and not more than $1,500.00 for each offense, and every day on which a violation occurs or continues is a separate and distinct offense. In addition, a violation of this prohibition is a menace to the health, safety, and welfare of the public, constituting grounds for suspension or revocation of a business license pursuant to Section 4-1-18 of the Village Code. In an effort to ensure that the Berkeley Police Department compensation packages remain competitive, the following Memorandum of Understanding (MOU) has been reached between ICOPS and the Village: 1. The Village will increase the base pay for bargaining unit employees by $4000.00 2. Whereas, the Village is willing to provide officers with an equity adjustment to their base salary in exchange for the Union’s agreement to bargaining unit employees’ being mandated to reimburse the Village for certain expenses under the circumstances detailed below. As such, the parties agree as follows: 1. The Village agrees to increase the base pay for bargaining unit employees by $4000.00 as detailed in the attached Exhibit effective February 1, 2025. See Exhibit 1. 2. The parties agree that in exchange for the additional base pay, officers that leave Village employment within Thirty-Six (36) months of their date of hire, will be required to reimburse the Village for all expenses incurred for training, education, equipment and uniforms which as set forth in Appendix D of the parties’ collective bargaining agreement. Reimbursement will be withheld from the employees last paycheck. 3. However, the reimbursement requirements set forth in Paragraph 2 will not apply to officers that are involuntarily terminated by the Village or leave Village employment due to injury or illness resulting in the officer’s inability to perform the officer’s normal duties of the position held at the time of the injury/illness. 4. Additionally, as part of this MOU, the parties agree to amend Section 18.11. Tuition Reimbursement. To include that Reimbursement will be withheld from the employees last paycheck as provided in Exhibit 2 5. This MOU shall be considered attached to and part of the parties’ collective bargaining agreement and constitutes the new status quo. Tuition Reimbursement. Tuition Reimbursement Program. The Village will reimburse tuition, for Full-Time employees, for approved courses or degree programs at colleges and universities under the following conditions: 1. The individual course or degree related course of study is job-related to the employee's present or future job responsibilities as determined by the Department Head. 2. The Department Head recommends and the employee receives written approval from the Department Head prior to the course beginning. This paperwork should be turned into Human Resources and put in the employee’s personnel file. 3. Reimbursement will be dependent on a sliding scale depending on the grade achieved and are as follows: a. Grade “A”: 100% reimbursement b. Grade “B”: 85% reimbursement c. Grade “C”: 65% reimbursement d. Pass: 50% reimbursement 4. Employees who anticipate requesting tuition reimbursement shall do so by December 31 of the year preceding the fiscal year in which they will request such reimbursement. The Village will then determine during the budget process whether there are sufficient funds to be budgeted and available to cover such costs. 5. Reimbursement per employee shall not exceed $2,000.00 per fiscal year. 6. Upon separation, employees will be required to reimburse the Village for any college tuition costs paid by the Village based upon a sliding scale.
