THE COMMON COUNCIL OF THE CITY OF BEVERLY APRIL 11, 2017 7:30PM MINUTES CALL TO ORDER Council President Bancroft called the meeting to order at 7:30PM. OPEN PUBLIC MEETINGS ACT STATEMENT Mr. Bancroft read the following statement into the Minutes: In compliance with the Open Public Meetings Act, NJSA 10:4-6, this is to announce that Adequate Notice of this meeting was provided in the following manner: On January 10, 2017 advance written notice of this meeting was posted on the Official Bulletin Board in the City Hall, was emailed to THE BURLINGTON COUNTY TIMES and published on January 16, 2017, emailed to the CAMDEN COURIER POST, filed with the Municipal Clerk, and was mailed to all persons who requested and paid for such notice. ORDINANCE 2017-04: SECOND READING/PUBLIC HEARING An Ordinance to Exceed the Municipal Budget Appropriation Limits and to Establish a CAP Bank (N.J.S.A. 40A:4-45.14) Mr. Bancroft called for Public Comment. There was none. Motion to Adopt by Thibault; Second by Schwedes. Roll Call Vote – All Ayes, except Carlbon-Absent. Motion Carried. ORDINANCE 2017-05: INTRODUCTION/FIRST READING An Ordinance Prohibiting Parking During Certain Identified Hours on Specific Streets within the City of Beverly. Said Ordinance will come before Council for Second Reading, Public Hearing, and Adoption at their Regular Meeting to be held on April 25, 2017 at 7:30PM at Beverly City Hall, 446 Broad Street, Beverly, NJ 08010, at which time all those wishing to be heard on same will be so heard. Copies of said Ordinance are available for review at the Office of the Municipal Clerk, at the aforementioned address, M-F, 9AM-5PM. Motion to Approve on Introduction by Thibault; Second by Schwedes. Roll Call Vote – All Ayes, except Carlbon-Absent. Motion Carried ORDINANCE 2017-06: INTRODUCTION/FIRST READING An Ordinance Adopting Certain Regulations relative to Drone Technology and Unmanned Aircraft within the City of Beverly. Said Ordinance will come before Council for Second Reading, Public Hearing, and Adoption at their Regular Meeting to be held on April 25, 2017 at 7:30PM at Beverly City Hall, 446 Broad Street, Beverly, NJ 08010, at which time all those wishing to be heard on same will be so heard. Copies of said Ordinance are available for review at the Office of the Municipal Clerk, at the aforementioned address, M-F, 9AM-5PM. Upon discussion by Council Members relative to additional language modifications, Mr. Bancroft called for a Motion to Approve on Introduction. Motion was made by Thibault; Second by Schwedes. Roll Call Vote – All Ayes, except Carlbon-Absent. Motion Carried. RESOLUTIONS RESOLUTION 2017-50 A Resolution approving the refund, in the dollar amounts herein stated, of unauthorized Payroll deductions made by CASA Payroll  3 Services for a Flexible Spending Plan (FSA) Program for which there was no participation by the following employees: Theresa Matthews - $1,373.26 and Shawn Mickle - $1,830.22 Upon clarification by Administrator Wolbert, Motion to Approve by Thibault; Second by Schwedes. Roll Call Vote – All Ayes, except Carlbon-Absent. Motion Carried. RESOLUTION 2017-51 A Resolution voiding Resolution 2016-82: “A Resolution authorizing a Developer’s Agreement with the Beverly Revitalization Group, LLC” and Resolution 2016-83: “A Resolution approving Affordable Housing Agreements with the Beverly Revitalization Group, LLC, and authorizing execution of Documents related to same” due to incorrect Regional Contribution Agreement (RCA)assignment. Upon clarification by Administrator Wolbert, Motion to Approve by Thibault; Second by Schwedes. Roll Call Vote – All Ayes, except Carlbon-Absent. Motion Carried. RESOLUTION 2017-52 A Resolution authorizing execution of the Burlington County Consortium Agreement between the Burlington County Board of Chosen Freeholders and the City of Beverly for participation in the Home Program Activities for Program Years 2018-2020. Motion to Approve by Thibault; Second by Lowden. Roll Call Vote – All Ayes, except Carlbon-Absent. Motion Carried. OLD BUSINESS There was no Old Business. NEW BUSINESS There was no New Business. BILL LIST Approval of the April 11, 2017 Bill List. Motion to Approve the April 11, 2017 Bill List made by Schwedes; Second by Lowden. Roll Call Vote – All Ayes, except Carlbon- Absent. Motion Carried. CORRESPONDENCE – (Note that all Correspondence will be handled/filed by and in the Office of the Municipal Clerk.) Mayor Miller read the following correspondence into the Minutes:  4 1. Township of Delanco: Notice of Hearing on Ordinance 2017-7 entitled “Amending Chapter 110-3 Zoning Map” to be held April 17, 2017 at 7:30PM at the Delanco Municipal Building. REPORTS Mayor Mayor Miller commended the Riverfront Historical Society for their recent Antique Show. They did an excellent job, and we received good press! Council Mr. Thibault reported that Community Events is continuing with Sponsorship funding efforts. Also, a reminder that the Community-wide Yard Sale is on Saturday, April 22, 2017 from 8AM- 2PM, with a rain date of April 29, 2017. Additionally, he stated that it was good to see the new Police cruisers out on the road! Mr. Schwedes echoed Mr. Thibault’s comment on the new Police vehicles, saying that they were quite impressive. Mr. Lowden stated the same, saying that the new Police vehicles were nice cars, looked sharp, and were outfitted with good equipment. He praised Administrator/Public Safety Director Wolbert for a job well done for having all this come to fruition. Administrator/Public Safety Director Mr. Wolbert explained for Council how the two new Police vehicles were outfitted, e.g., the new radar units have both forward and rear radar capability, etc. The new vehicles and equipment are good for the Officers, making them highly visible. Mr. Wolbert thanked Council for the authorization to purchase and outfit these two new vehicles for the Department. Mr. Wolbert also advised that Estimated Tax Bills will be done. The cost will run $500 - $1,000 for the mailing, but as the County is awaiting appointment of a new Tax Administrator, this mailing will at least stabilize our finances. He further advised that an explanatory statement will go out with the bills. Mr. Wolbert added that 808 Warren Street received their Road Opening Permit, so there will be some “Detouring”. There is no set date yet; hopefully, it will only take one day. Professionals Solicitor Coleman advised that Judge Bookbinder affirmed and upheld the Lauinger Field House Improvement Project to Fasolino. The contractor can start after their pre-construction meeting.  5 Mr. Wolbert added that there was a recent challenge to our Rental Registration Ordinance by a Beverly City property owner, and our Ordinance was upheld as being Constitutional! Municipal Clerk Ms. Snyder had no additional comments at this time. PUBLIC COMMENT Please state you name and address clearly for the record. Ron Paice asked for clarification on Council President Bancroft’s shortened reading of Resolution 2017-51. Solicitor Coleman advised that this was acceptable, as the full Resolution Title was on the Agenda. Loretta Kimber asked for an update on recent shootings in the City. Public Safety Director Wolbert advised that we are making progress, but no detail can be given at this time. He stated that we are making headway with Rental properties by speaking with the Landlords. Additionally, Tenants will be receiving letters regarding the Registration process. As there was no further Public Comment, this portion of the meeting was closed.
