THE COMMON COUNCIL OF THE CITY OF BEVERLY AUGUST 8, 2017 MINUTES CALL TO ORDER Council President Bancroft called the meeting to order at 7:31 p.m. OPEN PUBLIC MEETINGS ACT STATEMENT “The Provisions of the Open Public Meetings Act have been met. Notice of this meeting, Resolution 2017-16, was posted on the Official Bulletin Board in City Hall, was published in The Burlington County Times on January 16, 2017, emailed to the Camden Courier Post, filed with the Municipal Clerk, on January 10, 2017, and was mailed to all persons who requested and paid for such notice.” Read by Council President Bancroft. Kennedy APPROVAL OF MINUTES July 25, 2017 Regular Session Minutes MOTION - Councilman Thibault made a motion to approve the above referenced minutes as present, seconded by Councilman Schwedes. Ayes – Lowden, Schwedes, Thibault, Bancroft. Nays – None. Absent – Carlbon. Motion carried. PUBLIC COMMENT ON AGENDA ITEMS ONLY Please state your name and address clearly for the record. 1 Mr. Paice, 527 Broad Street, asked what were the fire inspection fees, to which Mr. Wolbert advised that this is done when someone is selling a home. They check for smoke detectors, etc. Mr. Haaf, 124 River Bank, asked if the housing inspector does an inspection for resale, to which Mr. Wolbert advised that this is just done for rental housing. Mr. Haaf asked when they inspect for a CO, to which Mr. Wolbert responded that a CO is for when a structure is first constructed. President Bancroft opened the meeting to public comment on agenda items. MOTION – Councilman Thibault made a motion to close public comment, seconded by Councilman Schwedes, and unanimously carried by those present. Motion carried. PUBLIC HEARING ~ ORDINANCE 2017-08 FIRE OFFICIAL INSPECTION FEES President Bancroft opened the meeting to public hearing on Ordinance 2017-08. John Haaf, 124 River Bank, asked if fees were going up as expenses are going up, to which Mr. Wolbert responded that this is correct. They have not gone up since 2004. MOTION – Councilman Thibault made a motion to close public hearing on Ordinance 2017-08, seconded by Councilman Schwedes, and unanimously carried by those present. Motion carried. ADOPTION ~ ORDINANCE 2017-08 Councilman Thibault made a motion to adopt Ordinance 2017-08, seconded by Councilman Schwedes. Mr. Lowden asked how many life hazards there were, to which Mr. Wolbert explained this is for multiple dwellings and commercial enterprises. Mr. Coleman advised that in the Administrative Code, the fee schedule for a fire district is done through the municipality; however, they are not our fees. Councilman Lowden felt that the people pay too much in taxes now without this extra cost. Ayes –Schwedes, Thibault, Bancroft. Nays – Lowden. Absent – Carlbon. Motion carried. INTRODUCTION ~ ORDINANCE 2017-09 SITE TRIANGLE MOTION - Councilman Thibault made a motion to approve the introduction of Ordinance 2017- 09 as amended, seconded by Councilman Lowden. Councilman Thibault was concerned with the obstructions of site on page two. Mr. Wolbert advised him this is a ‘T’ intersection. Councilman Thibault was concerned with the 80’ distance as there are many areas that would be impacted. Council President Bancroft added that if they eliminate each car right to the corner, it would be helpful. Councilman Schwedes said they could not park on Manor with these setbacks; they would have to park on Melbourne. Mr. Wolbert asked the Solicitor if they could regulate this under Title 39, to which Mr. Coleman responded they could. They could amend the ordinance for introduction this evening. Mr. Wolbert said there are trees and vines at Broad and Warren that were obstructing traffic. Ayes, included the language changes as discussed – Lowden, Schwedes, Thibault, Bancroft. Nays – None. Absent – Carlbon. Motion carried. Councilman Thibault discussed the ordinance further questioned fences, i.e. in front and side yards, fences around pools. Mr. Wolbert explained that the new fence ordinance that will address these issues. Councilman Schwedes asked what if the fence ordinance is in conflict with this site triangle ordinance. Mr. Wolbert replied there would be a severability clause. Mr. Coleman explained that the fence ordinance is coming. The latitude is with the Planning Board. 2 RESOLUTION 2017-93 ~ APPOINTMENT OF ACTING MUNICIPAL CLERK MOTION - Councilman Thibault made a motion to adopt Resolution 2017-93, seconded by Councilman Lowden. Councilman Thibault asked if the salary included overtime, to which Mr. Wolbert explained that all the time is inclusive in the salary. Mr. Wolbert gave a background of Ms. Hannah. Ayes –Lowden, Schwedes, Thibault, Bancroft. Nays – None. Absent – Carlbon. Motion carried. RESOLUTION 2017-94 ~ AMENDING SALARY RESOLUTION 2017-73 MOTION – Councilman Thibault made a motion to adopt Resolution 2017-94, seconded by Councilman Schwedes. Ayes – Lowden, Schwedes, Thibault, Bancroft. Nays – None. Absent – Carlbon. Motion carried. OLD BUSINESS There was none. NEW BUSINESS There was none. BILL LIST – AUGUST 8, 2017 MOTION – Councilman Thibault made a motion to approve the bills as presented on the August 8, 2017, bill list, seconded by Councilman Schwedes. Ayes – Lowden, Schwedes, Thibault, Bancroft. Nays – None. Absent – Carlbon. Motion Carried. CORRESPONDENCE  League of Municipalities Conference 11/14-11/16.  PSE&G change electric solar pilot recover charge public hearing 8/28 Mt. Holly, NJ. Reported by Mayor Miller. REPORTS Mayor – Mayor Miller had nothing to report at this time. Council  Councilman Thibault discussed Community events, with the concert being this Friday night, Halloween coming up, and the Community Day being September 30th.  Councilman Carbon was absent.  Councilman Schwedes had nothing to report at this time.  Councilman Lowden advised Council he would not be at the next meeting. Administrator/Public Safety Director  Mr. Wolbert reported that the flooding last week spared us. There is a problem at Putnam and Locust. One storm inlet was breached on Bentley. Professionals  Mr. Coleman had nothing at this time. 3 Municipal Court Administrator Acceptance of the June 2017 Court Report MOTION – Councilman Thibault made a motion to accept the June 2017 Court Report, seconded by Councilman Lowden. Ayes – Lowden, Schwedes, Thibault, Bancroft. Nays – None. Absent – Carlbon. Motion Carried. PUBLIC COMMENT President Bancroft opened the meeting to public comment. John Haaf, 124 River Bank, advised the Council that today the Burlington County Times had the kids pictures of the clean up in town. MOTION – Councilman Thibault made a motion to close public comment, seconded by Councilman Lowden, and unanimously carried. Motion carried. RESOLUTION 2017- EXECUTIVE SESSION – NOT ADOPTED ADJOURNMENT MOTION - Being no further business, Councilman Thibault made a motion to adjourn, seconded by Councilman Schwedes, and unanimously carried.
