THE COMMON COUNCIL OF THE CITY OF BEVERLY SEPTEMBER 26, 2017 MINUTES CALL TO ORDER Council President Bancroft called the meeting to order at 7:32p.m. OPEN PUBLIC MEETINGS ACT STATEMENT “The Provisions of the Open Public Meetings Act have been met. Notice of this meeting, Resolution 2017-16, was posted on the Official Bulletin Board in City Hall, published in The Burlington County Times on January 16, 2017, emailed to the Camden Courier Post, filed with the Municipal Clerk, on January 10, 2017, and was mailed to all persons requesting and paying for same.” FLAG SALUTE Council President Bancroft led those in the Flag Salute ROLL CALL Present: Mayor: Randy H. Hannah APPROVAL OF MINUTES September 12, 2017 ~ Regular Session Minutes September 12, 2017 ~ Executive Session Minutes MOTION - Councilman Thibault made a motion to approve the above referenced minutes as presented, seconded by Councilman Carlbon. Ayes – Bancroft, Carlbon, Thibault and Lowden, Nays – None. Absent - Schwedes Abstain - None. Motion carried. 1 PUBLIC COMMENT ON AGENDA ITEMS ONLY Mr. Paice, 527 Broad Street, asked if there would be a discussion on Ordinance 2017-11. Mr. Wolbert stated that this is the first reading and that there would be discussion. MOTION-Councilman Thibault made a motion to close public comment and Mr. Lowden Seconded. Motion carried with a unanimous voice vote. INTRODUCTION ORDINANCE NO. 2017 – 11 AN ORDINANCE ESTABLISHING CERTAIN TRAFFIC CONTROL REGULATIONS WITHIN THE CITY OF BEVERLY Mr. Wolbert explained that Ordinance 2017-11is about traffic control regulations. Mr. Wolbert stated that he and the Deputy Clerk drove around town to look and to identify the stop signs. Mr. Thibault questioned if there will be new signs. Mr. Wolbert said that there would be new ones on Locust Street also Front Street. Mr. Carlbon asked how many signs are there. Mr. Wolbert stated that there are approximately 117 signs. In addition, any sign that does not meet the retro- reflectivity standard will be replaced; also, Mr. Wolbert explained the process of refurbishing the stop signs. Mr. Carlbon asked about the curbs being painted. Mr. Wolbert said that this would be another ordinance in the future. The County is asking that the curbs be painted red but it is actually up to the Municipality to decide. Mr. Thibault asked about the cost of the signs. Mr. Wolbert said there is not a cost estimate at this time. RESOLUTION NO. 2017-106 RESOLUTION CERTIFYING COSTS INCURRED BY THE CITY OF BEVERLY FOR THE BOARDING AND SECURING OF THE UNSAFE STRUCTURE LOCATED AT 20 PINE STREET AKA 22 PINE STREET, BLOCK 1590, and LOT 31.01, IN ACCORDANCE WITH THE PROPERTY MAINTENANCE CODE Mr. Thibault asked the cost of the boarding up of this property. Mr. Wolbert stated that it was approximately $1,445.00. MOTION - Councilman Lowden made a motion to adopt Resolution 2017-106, seconded by Councilman Thibault, Ayes – Thibault, Bancroft, Lowden, Nays – None. Absent - Schwedes Abstain - None. Motion carried. RESOLUTION NO. 2017-107 TO ENTER INTO A SHARED SERVICE FOR POLICE CHAPLAIN SERVICES Mr. Wolbert explained that this group would help with death notifications. As all officers are given grief training, some may not be as compassionate as others. Even more so, in certain situations the officers are needed at the scene. The chaplains will help in delivering the message of a passing. As of now, there are four chaplains and possibly more to come. There were shootings in the last year and this will help deescalate those situations. These chaplains are not out to convert people just help in stressful situations. 2 MOTION - Councilman Thibault made a motion to adopt Resolution 2017-107, seconded by Councilman Carlbon, Ayes – Thibault, Bancroft, Lowden Nays – None. Absent – Schwedes, Abstain - None. Motion carried. RESOLUTION NO. 2017-108 RESOLUTION OPPOSING SENATE BILL S1046,COMPANION BILL A 2697, BILL TO BE ABLE TO MAKE CERTAIN CHANGES TO OPEN PUBLIC RECORDS ACT, SENATE BILL S1045, COMPANION BILL A 2699, BILL TO MAKE VARIOUS CHANGES TO LAW ADDRESSING MEETINGS OF PUBLIC BODIES WILL PROVIDE GREATER ACCESS TO MEETING INFORMATION. Mr. Wolbert spoke of the various added changes that could be applied to these Bills. MOTION - Councilman Carlbon made a motion to adopt Resolution 2017-108, seconded by Councilman Lowden. Ayes – Thibault, Bancroft, Lowden Nays – None. Absent - Schwedes Abstain - None. Motion carried. RESOLUTION NO. 2017-109 RESOLUTION TO APPROVE PAYMENT OF PAY ESTIMATE #1 TO EAGLE CONSTRUCTION IN THE AMOUNT OF $238,202.97. Mr. Wolbert stated that there were a few minor issues with this project. Mr. Wolbert said that he had concerns because of all the concrete and maybe there would be a problem with runoff water. Harry Fox, engineer, did all the needed calculations and may install a drain to correct that issue. There were some lighting issues also. The lights have been put on dusk to dawn timers and the pavilion will only have a motion sensor. MOTION - Councilman Thibault made a motion to adopt Resolution 2017-109, seconded by Councilman Carlbon. Ayes – Thibault, Bancroft, Lowden Nays – None. Absent - Schwedes Abstain - None. Motion carried. OLD BUSINESS No old business NEW BUSINESS Elected official training BILL LIST Approval of the September 26, 2017 Bill List Mr. Thibault questioned which property is the RCA property. Mr. Wolbert stated that it is 434 Cooper Street. Mr.Wolbert stated that there is a developers Agreement to make three units with parking in the rear. MOTION - Councilman Thibault made a motion to approve the above referenced bill list as presented, seconded by Councilman Carlbon. Ayes – Thibault, Bancroft, Lowden Nays – None. Absent - Schwedes Abstain - None. Motion carried. 3 CORRESPONDENCE No correspondence REPORTS Mayor - Mayor Miller stated that he had attended the meeting for shared service for police chaplains. He commented that he was very impressed with the presentation. Council – Councilman Thibault stated that the Harvest Festival is the 30th and is hopeful that everyone will come out. The weather is going to be nice for the event. Jennifer Gross, who is helping plan the event has done a great job and has everything in order for the day. There will be many vendors. Councilman Thibault also stated that the band that is performing really does a great job. All the food vendors will be on Broad St. Vendors will be arriving approximately 9:00AM and there will be plenty of volunteers to direct them where to set up. Councilman Carlbon encouraged everyone to come out to the event. Councilman Lowden mentioned that there will be a Planning Board meeting for September and that there is only the approval of the minutes on the agenda. Administrator/Public Safety Director – Mr. Wolbert spoke of the JIF Land use claims. This means that the policy only covers up to $150,000.00. There are upgrade fees that will extend the amount of coverage to $1,000,000. This coverage is for when litigation with the Planning Board should arise. Professionals- Mr. Coleman stated that he had nothing to report at this time. PUBLIC COMMENT Mr. Paice, 527 Broad Street. Mr. Paice asked who is responsible for sidewalk. Mr.Wolbert stated that the homeowners are responsible for the sidewalks. RESOLUTION 2017- ~ EXECUTIVE SESSION – Not Adopted ACTION TAKEN AFTER EXECUTIVE None taken ADJOURNMENT MOTION - Being no further business, Councilman Thibault made a motion to adjourn, seconded by Councilman Lowden, and unanimously carried.
