TOWN OF VERMONT PLAN COMMISSION MEETING 4017 County Hwy JJ, Black Earth, WI 53515 Monday, November 24, 2025, 6:00 P.M. Call to order and posting certification Tim called the meeting to order at 6:02 p.m. The meeting was properly noticed: posted on the front door of the Town Hall, posted on the town website, emailed to the online subscribers, and published in the Mount Horeb Mail and Times Tribune. Present: Tim Pierce, Diane Anderson, Dean Bossenbroek, Jim Elleson, Polly Kawalek, Doug Meier, and Max Scoll Approval of agenda Polly moved and Doug seconded a motion to approve the agenda. Motion carried 7-0. Approval of October meeting minutes Polly moved and Dean seconded a motion to approve the October meeting minutes. Motion carried 7-0. Public input/general comments Mark Haukoos will be running against seat two in the Spring election. Mark handed out a density study on the Henry H Bakken property. Discussion on Potential Development Rights for Donna Greenwood property in Section 31 • Glen and Fern Frame density study combined the two properties and had 7 PDRs as of January 1. 1985. • Letter from Brain Standing dated 5-6-09 allowed marital property to be combined in determining the PDRs. • David Frame etal has 32.6 acres and 1 PDR which must stay with that parcel. • April 2009 Comprehensive Plan does not allow TDRs. • Total 8 PDRs less Schneider and Buros lots leaves 6 PDRs. • The landowner wants to know available PDRs as they are looking to sell. • For the 81 acres owned by Donna Greenwood, the County and the town agree that there are 2 PDRs, 1 in the Northen portion and 1 in the southern portion which cannot be transferred. • 66 ft of roadside frontage gave access to the northern Parcel 3 was transferred to Brian Zwettler and left the 81-acre parcel landlocked. • Access to the property will be difficult. • The best access to the southern parcel would be an easement from Iowa County • The northern Greenwood parcel is an illegal lot that was created outside of our purview, no action to be taken, just a statement of fact. Discussion and possible recommendations on the County proposed blanket rezone to correct zoning map discrepancies • Bridgit Van Bellegham from Dane County was part of this discussion. • The Perkins motion from the previous meeting is not doable because you cannot have a house on property zoned FP-1. There was a deed restriction on the property, so it was flagged by the County. • In 2019 little snippets of land cut off by the road were labeled UTR, which by state law should be FP-1. Some were labeled FP-35, and state law says they must be their own parcel and labeled FP-1. • The PC was nervous about agreeing to the change unless the landowner said they agreed. • SFR is the same category, just making them match based on acreage. • All landowners received a letter telling them about the change. • None of these changes will affect development rights. Dean moved and Polly seconded a motion to recommend approval of the 13 rezones on the County initiated blanket rezone. Motion carried 7-0. Discussion on accessory building height on rural zoned residential properties • An accessory building that is not in a NR-I zoning category could be a maximum height of 35’. • Agricultural buildings have no height limit. • If they want to build an accessory building in NR-I zoning area, the maximum height is 28’ unless they can prove it is an agricultural building. • If we have problems we will deal with them then. Comprehensive Plan Review – working topic. • The DOA community survey, required by law to be included in our plan, has a large margin of error, making the data worthless. • Bridgit will review all our comments and will update our draft. • We will provide Bridgit with pictures: o Tim will contact Gary Cox. our web master, to get pictures. o We can also use the Then and Now project. o Polly will contact Vermont Lutheran to get pictures of their prairie restoration. • State law states that the town cannot deny a CUP, only the County can. • The County can say that it is not consistent with the town plan. • Bridgit will provide draft CUPs that the town would be willing to approve.
