New Business – Ordinance 23007 STATE OF SOUTH CAROLINA } CHEROKEE COUNTY } ORDINANCE NO. 2023 – 007 } AN ORDINANCE TO PROVIDE FOR THE DISPOSITION BY CONVEYANCE OF PROPERTY LOCATED ADJACENT TO THE SEWER TREATMENT FACILITY, BLACKSBURG, SOUTH CAROLINA, BY THE TOWN OF BLACKSBURG TO SCOUT REALTY GROUP, LLC BE IT ORDAINED by the Governing Body of the Town of Blacksburg, in Council assembled: SECTION 1. That this Ordinance is being adopted in order to effect proper compliance with the provisions of the Home Rule Act of 1975, now South Carolina Code of Laws for 1976, Section 5-7-30 and Section 5-7-260 and the Code of Ordinances of the Town of Blacksburg. SECTION 2. That the Town of Blacksburg, South Carolina, is the owner of property bearing Cherokee County tax parcel number 154-00-00-093.00 consisting of approximately 20.05 acres including a portion of said tract consisting of approximately 8.5 acres in the Town of Blacksburg, Cherokee County, South Carolina; and that Scout Realty Group, LLC has agreed to purchase such 8.5 acre tract from the Town of Blacksburg for the sum of Eighty- Five Thousand and no /100 Dollars ($85,000.00) as such tract is shown and general terms described in the letter of intent (“LOI”) dated June 2, 2023 attached hereto. SECTION 3. That the sale and conveyance to Scout Realty Group, LLC of the above-referenced tract for the consideration set forth above, is hereby approved, authorized, directed, ratified and confirmed in all respects subject to the satisfaction of the City Administrator to the terms set forth in a purchase and sale agreement. Furthermore, it is hereby approved, authorized, directed, ratified and confirmed that the City Administrator shall have the right, without the need for any approval from this Council, to execute customary documentation to carry out this transaction. This right includes, but is not limited to, the City Administrator’s execution of the LOI, a purchase and sale agreement, approving the survey and subdivision to separate the 8.5-acre tract from the remainder of the 20.05-acre parcel as described herein, and executing a deed and customary closing documents. SECTION 4. That all ordinances or parts of ordinances inconsistent with this Ordinance are hereby repealed to the extent of such inconsistency. SECTION 5. That this Ordinance shall be and become finally binding immediately after same shall have received first and second readings, given in manner required by law.  IV. New Business – Ordinance 23008 STATE OF SOUTH CAROLINA } CHEROKEE COUNTY } ORDINANCE NO. 2023 – 008 } AN ORDINANCE TO PROVIDE FOR THE ANNEXATION, ZONING AND WARD DESIGNATION OF ONE TAX PARCEL LOCATED ALONG SHELBY STREET AND LOGAN DRIVE LYING ADJACENT TO THE TOWN LIMITS OF THE TOWN OF BLACKSBURG, S.C. BE IT ORDAINED by the Town Council of Blacksburg, in Council assembled (“Council”): 1. That the municipal limits of the Town of Blacksburg, be and the same is hereby amended adding the property described as follows: One Tax Parcel Located Along Shelby Street and Logan Drive. The area lying adjacent to the Town Limits of the Town of Blacksburg, identified and described in a Petition dated May 11, 2023, entitled "Petition For Annexation to the Town of Blacksburg of One Tax Parcel Located Along Shelby Street and Logan Drive Lying Adjacent to the Town Limits of the Town of Blacksburg, S.C., as Shown on Map titled "Annexation of 174-05-00-0064.000” and filed with the Municipal Clerk, has been duly annexed to and is a part of the Town of Blacksburg, S.C. 2. That the one tax parcel along Shelby Street and Logan Drive is being annexed responsive to a Petition signed by all persons owning the real property in said area, which Petition is duly approved by Town Council under and pursuant to the authority of Section 5-3-150, Code of Laws of South Carolina for 1976. 3. That all available Town services shall be commenced in said area as soon as practicable, as and where needed and required, and same shall become subject to all Town property taxes effective from the 1st day of January next following date of final passage of annexation ordinance. 4. That, in accordance with Sec. 303 of the Zoning Ordinance of the Town of Blacksburg, and incident to and as a part of the annexation proceedings, said annexation area is hereby classified for zoning purposes as Residential R1-B as shown on map entitled "Annexation of 174-05-00-0064.000 into Town of Blacksburg.” 5. That, in accordance with Section 6-1 of the Code of the Town of Blacksburg, and incident to and as a part of these annexation proceedings, said annexation area is hereby added to the Ward System Map identified in said section and made a part of District Four of the Town. 6. That all ordinances or parts of ordinances inconsistent with this Ordinance are hereby repealed to the extent of such inconsistency. IV. New Business – Ordinance 23009  V.
