DEVELOPMENT BUSINESS City of Blaine Page 4 City Council Minutes - Final November 20, 2014 11.-1 ORD 14-2290 FIRST READING GRANTING A REZONING FOR A PORTION OF THE EMBERWOOD APARTMENT PROJECT FROM B-2 (COMMUNITY COMMERCIAL) TO DF (DEVELOPMENT FLEX) AT 126th AVENUE/CENTRAL AVENUE NE. (CASE FILE NO. 14-0002/LSJ) Sponsors: Schafer Planning and Community Development Director Schafer stated the Council had previously reviewed this project and proposed plans in a Workshop. He stated staff has concerns about the phasing of the three building project. He commented that a one or two building project would be more appropriate for the location. He stated if Council choses to move forward with the three building project, staff suggests that the later phases be given concept plan approval only which will allow staff and Council time to evaluate each process. Councilmember Bourke asked if the developer will put in road improvements. Planning and Community Development Director Schafer replied road improvements will be completed with Phase I. Mayor Ryan commented the applicant has upgraded interior fixtures and appliances. Planning and Community Development Director Schafer stated one finished unit will be inspected and approved. Councilmember Hovland stated he is concerned about the road’s curve and having access points on both sides of the curve. Councilmember Kolb stated the new development on 129th will add traffic to the road and she is concerned about the road’s curve. Planning and Community Development Director Schafer stated the elevation will be dropped down and will make a large difference. He noted that the east driveway is the most problematic. He suggested moving the driveway away from the curve. Councilmember Bourke asked if the project is done in three phases, would the developer have to pay fees three times. He stated he is in favor of the project. Planning and Community Development Director Schafer replied no additional or extra fees. Councilmember Herbst stated he is most concerned about the curve of the City of Blaine Page 5 City Council Minutes - Final November 20, 2014 road and the quality of the apartments. He is in favor of Phase I. Councilmember Kolb stated she is in favor of phasing the project. Councilmember Bourke stated he is concerned that the neighborhood does not want any more buildings after Phase I or the developer is unable to finish the project. Councilmember Hovland stated he is in favor of phasing the project. He is concerned about the curve in the road. Councilmember Swanson stated he is in favor of phasing the project. He stated the neighborhood want a quality building. Councilmember Herbst stated he is in favor of phasing the project and a quality building. Jerry Anderson, JM Architects, commented that normally one CUP covers an entire development project. Planning and Community Development Director Schafer replied DF gives the Council options. He noted that staff will closely monitor the work. Councilmember Clark commented the lot may be better suited for single family. Tom Pierson, 122663 Johnson Street NE, stated he is concerned about the increased density and the amount of traffic that will be generated. He noted the current traffic is manageable. He stated he would like to see a smaller development on this site. He noted the resolution authorizes a committee comprised of the Mayor, City Manager, and Finance Director to accept a bid as outlined in the resolution - an aggregate principal amount not to exceed $2,600,000 and a true interest cost not to exceed 2%. He stated the funding is from interest earned in the CIF. He stated staff is recommending projects in Mary Elizabeth Park, Westwood Park, and Lakeside Park. Councilmember Swanson asked if the basketball court in Mary Elizabeth Park will be made smaller. Planning and Community Development Director Schafer replied the basketball court will be the same size or a little larger. Councilmember Herbst stated he has heard complaints about the fee increase. He stated he is concerned about the increase being passed onto the buyer. INDIVIDUAL SEWAGE TREATMENT SYSTEMS Sponsors: Schafer Planning and Community Development Director Schafer stated the State of Minnesota has made law and rule changes to individual sewage treatment systems that require an update of the City’s private on-site septic ordinance. He noted the entire ordinance is being replaced with a new ordinance. Introduced, Read, and Placed on File for Second Reading 12.-5 RES 14-225 ADOPT CROSSWALK POLICY Sponsors: Keely Attachments: City of Blaine Crosswalk Policy - Final 110714.pdf City Engineer Keely stated Federal and State guidelines have been prepared to help cities in the decision process of where crosswalks are warranted. She noted that crosswalks should be installed where there is substantial conflict between vehicle and pedestrian movement. Councilmember Clark asked about the current petition for a crosswalk in The Lakes. City Engineer Keely replied the conditions are currently not conducive for a crosswalk because it is winter. She noted the area will be reviewed in the spring. Mayor Ryan asked about striping and restriping crosswalks. City Engineer Keely replied crosswalk striping is done every year. Councilmember Bourke asked if all of the crosswalk requests will be reviewed. City Engineer Keely replied yes, all requests will be reviewed. He stated that all affected property owners have been notified of their respective delinquent bills and if payment is not received before the remittance deadline to the County, the resolution authorizes staff to certify the amount due to the County Auditor for collection with the 2015 property taxes. He noted the City agreed to increase the monthly contribution to the cafeteria plan for 2014 by $30, 2015 by $30; and a reopener at yearend 2015 for 2016. He commented Columbus Day holiday has been dropped and a floating holiday has been added.
