NOTICE OF WORKSHOP MEETING

The meeting was called to order by Mayor Ryan at 6:30 p.m.

WS 14-63 UTILITY EXTENSION FOR WEST CENTRAL ACRES

Public Services Manager Therres stated the City received a request for
extension of utilities to serve two parcels of the south side of 113th Avenue
for a single family residential development. He stated the developer, Broker
Rose Lorsung, is requesting the City assist in constructing the trunk sanitary
sewer from the two parcels to the existing trunk sanitary sewer line in Little
League Park. He noted the developer is calling this Option 1 and is prepared
to acquire the easements from adjacent property owners to construct the trunk
connection. He stated the construction of the trunk sanitary sewer to Little
League Park would allow for a gravity sewer connection at the north end of
Fillmore Street in the plat of Coopers Meadow. He stated that the developer
included an Option 2 for the sewer extension to serve the two parcels, but
would have to be pumped north by a temporary lift station and force main.
He noted that the developer would pay for this option, but it does not allow
for the development of adjacent parcels without construction of the permanent
trunk sewer or removal of the existing lift station to the south. He noted there
will be a cost to the City’s Utility Fund for a number of years.
Mayor Ryan asked if the neighborhood is aware of the discussions. Public
Services Manager Therres replied no.
Councilmember Kolb asked if the neighbors want to connect to utilities.
Public Services Manager Therres replied some do and the connections will be
charged individually.
Councilmember Herbst confirmed Option 1 will cost the City. Public
Services Manager Therres replied yes, but there is $100,000 in a fund for the
project. He noted Option 2 would be no cost to the City. He stated Option 1
has public and private benefit.
Councilmember Swanson stated he supports Option 1 and do the project right
the first time.
Public Services Manager Therres commented all property owners would be
notified of the project.
Councilmember Swanson asked what happens if the developer is not
successful in getting easements. Public Services Manager Therres replied
than the project would go ahead with Option 2.

Councilmember Kolb asked if 113th is designed similar to 117th in order to
handle traffic. Public Services Manager Therres replied 113th will be able to
handle the traffic.
Mayor Ryan asked about the storm sewer design. City Engineer Keely replied
the storm sewer was designed for a mock plat in 1996. She noted the
developer will pay a per acre charge.
Councilmember Clark commented he is concerned about the neighborhood
streets funneling toward Fillmore Street and it becoming a raceway.

Planning and Community Development Director Schafer stated the three
property owners (Pulte Homes, Alliance Bank and Allina/United Hospital
Foundation) are on different timeframes for development, which is a problem
with utility connection. He noted that Pulte and Alliance have Army Corps
permits. He stated the EDA has the responsibility to complete utilities on its
own property. He stated the issue is Allina needs to install their utilities in
order for Alliance and Pulte to have utilities. He noted Allina has an
established wetland line. He stated the next step is for staff to prepare a
feasibility report and a pre-development agreement.
Councilmember Bourke asked if the City pays for the utilities would the City
recoup the costs. Planning and Community Development Director Schafer
replied yes, approximately 1/3 from the three property owners.
Councilmember Bourke asked about funding. Planning and Community
Development Director Schafer replied the project costs would be paid from
pooled TIF and the Utility Fund.
Councilmember Clark asked if there are enough pooled TIF funds to use for
109th and 105th projects. Community Development Director Schafer replied
yes.
Council consensus to move forward with the project.

WS 14-65 MEDICAL CANNABIS STATUS

Police Chief/Safety Services Manager Olson stated in preparation for possible
future medical cannabis production and distribution, staff is requesting
Council approval to explore changes in zoning regulations, ordinance
changes, and licensing process for medical cannabis in the event that a
distribution site would come to the City. He commented changes in zoning
requirements would make the business obtain a Conditional Use Permit in
B-2, B-3 and Planned Business District zoning districts. He commented a
licensing process would be needed to avoid being inundated with distribution
sites. He also noted the City’s drug paraphernalia ordinance would need to be
updated. He noted one city in Washington has 20 distribution sites and is
having a difficult time with managing people coming into their city. Council
discussion on Washington and legalized marijuana.
Councilmember Swanson stated it is better to be proactive than reactive.
Councilmember Clark stated he is not in favor of restricting licenses without
further research.
Police Chief/Safety Services Manager Olson stated staff will work on zoning
and ordinance changes.

WS 14-66 MAC/CITY OF BLAINE BALLFIELD LEASE

City Manager Arneson stated the lease of the Blaine Soccer Complex with
MAC expires on December 31, 2014. He noted there are two, one year
renewals permitted in the agreement with a two percent increase each year.
He gave an overview of the MAC/City of Blaine Term Sheet.
Councilmember Clark stated he is in favor of extending the agreement for
another two years until the Lexington Athletic Park is complete.
Councilmember Bourke asked if the City could buy the property. City
Manager Arneson replied no, the property can only be leased up to a 99 year
maximum. He noted MAC is willing to lease the property. He commented
there is a 60 day termination clause.
Councilmember Bourke asked how much money has been put into the
property and its life expectancy. Public Services Manager Therres replied $10
million and 10 years. He noted the newest item is the concession stand.
Councilmember Herbst commented the two athletic groups have invested
funds in the park.
Public Services Manager Therres commented the City’s park fee covers costs.
Council consensus to renew the agreement for two years and extend it for five
years.

OTHER BUSINESS
Councilmember Herbst commented a drainage issue that was near Home
Depot has been resolved.
Councilmember Bourke stated he is concerned about the phasing of the
Paxmar development and he would like to see more access to the
neighborhood. Planning and Community Development Director Schafer
replied the access to Lexington and 125th will be done in phase two. He
noted the development will have four access points total.
