Present: 6 - Mayor Ryan, Councilmember Swanson, Councilmember Bourke, Councilmember Herbst, Councilmember Clark, and Councilmember Hovland Absent: 1 - Councilmember King 3 New Business City of Blaine Page 1 City Council Workshop Minutes - Final January 22, 2015 3-1 WS 15-05 LOCAL WATER PLAN AND ORDINANCE UPDATES Sponsors: Hafner Attachments: Water Plan Storm Water Ordinance ESC Ordinance Stormwater Manager Hafner stated staff is proposing updates to the Local Surface Water Management Plan (LSWMP), Stormwater Ordinance, and Erosion Control Ordinance. He noted all metro cities are required to have a LSWMP as part of a Comprehensive Plan and has to be updated within two years of the Watershed Districts (WD) plan. He noted the LSWMP is reviewed by the Watershed Districts, Anoka County and Met Council. He stated the LSWMP is required criteria for funding and State programs. He gave an overview of the updates/changes: remove references to Six Cities WMO, update maps, update references to WD plans and rules, change reference to rainfall frequency model, update references to ordinance revisions, MS4 permit, non-degradation report, stormwater utility fee, TMDL’s, budget and CIP. Councilmember Herbst asked about holding ponds’ water used for residential irrigation. Stormwater Manager Hafner replied it is a possibility. Community Development Director Schafer replied the larger developments do use holding ponds’ water for irrigation. Stormwater Manager Hafner stated the City’s Comp Plan is scheduled for updating in 2018 and the LSWMP will be updated at the same time. He stated the plan has been through an internal preliminary review and the WD will have a 60-day review, and the Met Council and Anoka County will have a 45-day review. He stated He stated there are minor changes to the City ordinance: NPDES MS4 Stormwater Management, Chapter 34 Environment, MS4 permit renewed in August 2013, and several new permit items requiring updates. He stated stormwater ordinance changes include: Infiltrate first 1.1 inches of rainfall; add details to anti-degradation; infiltration limitations due to contaminant potential, non-porous soil or high bedrock, DWSMA, high water table; provide off-site treatment if on-site is not possible. He stated the zoning ordinance changes include NPDES construction site management; performance standards - 33.16, inspection requirement; and permitted staff training. He gave an overview of the time frame for adoption and noted the changes would be effective in March 2015. Councilmember Herbst asked what if the City did not do any updates. Stormwater Manager Hafner replied the City would be found non-compliant with the WDs. City of Blaine Page 2 City Council Workshop Minutes - Final January 22, 2015 Councilmember Hovland asked how often the ordinances and the plan are updated. Stormwater Manager Hafner replied the ordinances are reviewed every five years with the MS4 permit. He stated the water plan is on the WDs cycle, which is on a five to ten years cycle. He noted the City has to update their plan within two years after the WDs update. Councilmember Hovland asked if the ordinances and plan can wait to be updated with the Comp Plan. Stormwater Manager Hafner replied the updates to the Comp Plan could be off kilter with the ten years cycle, which is currently happening. Mayor Ryan commented the City needs to keep an eye on the project over on Lexington and the ditch backing up. Councilmember Bourke asked about the 120-day timeframe for review. Stormwater Manager Hafner replied the water plan is on a different schedule and the ordinances can be approved before the plan is approved. Councilmember Clark requested budget and operational impacts due to the proposed changes. Councilmember Herbst asked if any of the changes will be a burden on existing business. Stormwater Manager Hafner replied no, most changes are already in place. He commented the stormwater costs will be insignificant. He noted additional inspections will be needed, but will not affect the budget. Councilmember Bourke confirmed that the proposed changes are necessary to meet mandates. Stormwater Manager Hafner replied yes. City Manager Arneson commented Well 6 drilling will begin the first week in February 2015. Discussed City of Blaine Page 3 City Council Workshop Minutes - Final January 22, 2015 3-2 WS 15-06 HARPERS STREET AREA REGIONAL STORM DRAINAGE IMPROVEMENTS, IMPROVEMENT PROJECT NO. 13-12 Sponsors: Therres Attachments: Figure 1 - overall original concept.pdf Figure 2 - Proposed trunk storm sewer.pdf Public Services Manager Therres commented this project was initiated before 2005. He stated in order to develop the remaining five acre parcels, developers have been losing 2-3 lots of immediate development potential with onsite ponding. He stated the latest proposal shows temporary ponding on the individual parcel with an ultimate storm water design utilizing a regional storm water pond. Councilmember Herbst stated his son lives near the location of the proposed stormwater pond. He asked if his son would benefit from the stormwater pond. Public Services Manager Therres replied no, the pond is on the other side of the ditch. Councilmember Herbst asked if staff have talked to the neighborhood residents. Public Services Manager Therres replied yes, a public meeting was held with the property owners. Councilmember Herbst commented there is a culvert that is 1.5 feet too high and needs to be lowered. Public Services Manager Therres gave an overview of the area map, noting the area is separated into three alignment sections. He stated staff is suggesting a regional study be conducted on alignment area 1. Councilmember Hovland asked if the low-lying areas in District 2 are considered wetlands. Public Services Manager Therres replied he did not know. Councilmember Bourke asked if the pond had to be where it is currently shown. Public Services Manager Therres replied yes, due to the land elevation. Councilmember Hovland clarified that the City would have to purchase the land from the owner for the stormwater pond. Public Services Manager Therres replied yes and then assessed back to the development. She stated the contract would be awarded after MSA dollars are confirmed. She commented a public meeting will be held. Councilmember Hovland asked about 125th construction plans. City Engineer Keely replied changes have been made to the plan. She stated the County Board dictated a full opening for Xylite Street in the median, a sidewalk to Pioneer Park; new entrance off of Xylite Street, and two signalized intersections at Harpers and Cloud Drive. He noted State Aid has the signal justification reports. Police Chief/Safety Services Manager Olson gave an overview of a police arrest situation that took place in the early morning of January 22, 2015. Councilmember Hovland asked if the City is prepared for a public march or sit-in where to happen. Police Chief/Safety Services Manager Olson replied the City has a plan and would seek assistance from neighboring cities. ADJOURN The Workshop adjourned at 7:30 p.m. City of Blaine Page 5
