CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING APRIL 4, 2016 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday April 4, 2016, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. CALL MEETING Mayor Carson Ross called the City Council meeting to order and led TO ORDER in the Pledge of Allegiance. MAYOR COMMENTS Mayor Ross gave a brief recap of the meeting agenda and expla ined the Consent Agenda. APPROVE CITY COUNCIL Councilman Quibell moved to approve the minutes of the March 21, MINUTES 2016 meeting of the City Council meeting. Motion seconded by Councilman Carter and carried with the following votes: Councilman Qui bell -Aye Councilman Carter- Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross - Aye APPROVE FIREWORKS Councilman Quibell moved to approve seventeen (17) fireworks PERMITS FOR 2016 permits for the 2016 license year. Motion seconded by Councilman Carter and carried with the following votes: Councilman Qui bell -Aye Councilman Carter- Aye Councilman Lievsay- Aye Councilman Edmondson- Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross- Aye PRESENTATION- Kyla Renta, Customer Success Manager for OpenGov gave a OPENGOV presentation to Council on the cloud-based platform. City staff has been working with OpenGov over the last year to develop a transparency portal to share financial information with the public via the City's website. The use of OpenGov will follow the Strategic Plan Framework as adopted by Council. A copy of the PowerPoint presentation is attached to these Minutes and incorporated herein. PUBLIC HEARINGS - Mayor Ross opened the Public Hearings on the Rezoning of REZONING OF COLONIAL Colonial Highlands and the Colonial Highlands Planned HIGHLANDS (RZ-02-16- Development Concept Plan concurrently at 6:18 p.m. The minutes 5203) and COLONIAL of the public hearing were recorded by a certified court reporter. HIGHLANDS PLANNED Assistant City Clerk Dylan Gibson entered four exhibits into the DEVELOPMENT CONCEPT PLAN (PDC-02- record for each public hearing. 16-5204) STAFF REPORT Community Development Senior Planner Matt Wright stated the applicant, Randy Sallee of Sallee Homes, Inc. is requesting to rezone the 62.65+/- acre Colonial Highlands residential development from "SF-7/PR-0" (Single Family/Planned Residential Overlay) to "SF-7" (Single Family Residential) (48.78 acres) and "TF" (Two-Family Residential) (13.87 acres). The applicant is proposing to develop 115 single-family residential lots, 33 duplexes (66 dwelling units), community amenities and two stormwater retention/detention areas. The Planning Commission recommended approval of the rezoning request with a vote of 6-1. The applicant is also requesting approval of a Planned Development Concept Plan for the Colonial Highlands residential 2 April 4, 2016 City Council Meeting Page 3 development for 181 new dwelling units with a gross density of 2.89 units per acre. The Planning Commission recommended approval with a vote of 6-1 with 12 conditions. COUNCIL DISCUSSION At the request of Councilmen Culpepper and Edmondson, Mr. Wright provided clarification that the width of the buffer area from Wyatt Road to the alley would be a minimum of 25 feet but could vary up to 60 feet based on the location of the alley. APPLICANT Greg Musil, attorney for the applicant, discussed the sight plan, the overall plan of the development, and the three phases of the development plan. Mr. Musil addressed the five concerns expressed by the Planning Commission. Wayne Kirchhoff, Planner for WLK Urban Design, LLC, discussed the housing types and planned livability of the development. Mr. Kirkoff addressed the traffic concerns that were raised during the Planning Commission meeting. Mr. Kirchhoff confirmed Councilman Culpepper's understanding of the right-of-way and buffer. David Rinne , President of Schlagel & Associates, addressed the Planning Commission's concern on how the planned development would handle storm water runoff. Council inquired whether the streets were private or public streets. Mr. Rinne confirmed they were public streets with the exception of the alleys. IN OPPOSITION TO Mrs. Linda Redwine , Mr. David Redwine, and Ms. Diane Jones, expressed their concerns about how the previous developer left the land in poor condition and has damaged ponds in the area. Mrs. Redwine was disappointed in the proposed rezoning from single- family homes to two-family and multi-family homes. Ms. Jones and Mr. Redwine offered pictures for the record , which were entered by City Clerk Sheryl Morgan as Exhibits 5 and 6, respectively, for both public hearings. Ms. Patricia Kopple expressed her opposition to multi-family duplexes due to traffic concerns. Ms. Penny Jolly requested that the development consider swapping the locations of the Single-Family units with the Multi-Family units for traffic concerns and for how the development would look when her and her neighbors have to look out their windows. The Mayor hearing no further comments for or against, closed the public hearings at 7:18p.m. INTRODUCTION AND 15 T Councilman Edmondson introduced Bill No. 4419 approving the READING- BILL NO. 4419 rezoning of Colonial Highlands from "SF-7/PR-0 " (Single- 3 April 4, 2016 City Council Meeting Page 4 APPROVING REZONING Family/Planned Residential Overlay) to "SF-7" (Single Family OF COLONIAL Residential) and ''TF" (Two-Family Residential). Councilman Fowler moved to approve Bill No. 4419 upon its first reading and proceed with the second reading . Motion seconded by Councilman Carter. COUNCIL DISCUSSION Councilman Fowler conveyed that he understands concerns of the planned development relating to property values. He hopes that the development can find a way to create more of a buffer or fence around the properties until vegetation grows if Multi-Family units and Single-Family homes cannot swap locations within the development. Councilman Culpepper shared the concerns of Councilman Fowler. She was also concerned about amount of duplexes in the City. Councilman Quibell noted that since 2008 Blue Springs has fallen behind the rest of the cities in the Kansas City metro area for Multi- Family units. He noted that the types of tenants to rent Two-Family units are usually young families. Councilman Quibell said that he wanted to see new families coming to Blue Springs. Mayor Ross wanted to consider what the millennia! generation of young families want in a homes, which he believes is smaller homes or Two-Family homes. He noted that the neighboring city of Lee's Summit has grown because of accommodating those new housing developments that are desirable to young families. COUNCIL DISCUSSION Councilman Fowler commented on the rezoning, stating that property owners were annexed in 2003 by the City with Single- Family lots in the planned development area. DEVELOPMENT CONCEPT PLAN (PDC- 02-16-5204) Councilman Fowler moved to approve Bill No. 4420 upon its first reading and proceed with the second reading. Motion seconded by Councilman Quibell. COUNCIL DISCUSSION Councilmen Fowler and Carter asked the developer how long it would take for vegetation to be fully grown and asked if there was a temporary solution until vegetation matured. Mr. Salle said that they will irrigate, fertilize , and treat the berm along Wyatt Road properly to help it grow. MOTION TO AMEND BILL Councilman Fowler moved to amend Condition 10 of Bill No. 4420 NO. 4420 to require an irrigation system in the buffer area along Wyatt Road. Motion seconded by Councilman Carter and carried unanimously. COUNCIL DISCUSSION Councilman Edmondson inquired about on-street parking in the development. Mr. Sallee stated there will not be on-street parking in the alleyways and this will be incorporated into the Homeowners Covenants and Restrictions. Mr. Sallee confirmed two two-family homes would continue to be maintained after the Homeowners Association assumes responsibility for the common grounds.
