CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING MAY 16, 2016 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, May 16, 2016, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. COUNCILMEN IN Jeff Quibell Dale Carter ATTENDANCE Chris Lievsay (arrived at 6:06p.m.) Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, Deputy City Administrator Adam Norris, Assistant City Administrator, Christine Cates, City Attorney Nancy Yendes, and City Clerk Sheryl Morgan. CALL MEETING Mayor Carson Ross called the City Council meeting to order and TO ORDER Scouts from Troop 175 of Timothy Lutheran Church led in the Pledge of Allegiance. MAYOR COMMENTS Mayor Ross gave a brief recap of the meeting agenda and explained the Consent Agenda. APPROVE CITY COUNCIL Councilman Edmondson moved to approve the minutes of the May MINUTES 2, 2016 meeting of the City Council meeting . Motion seconded by Councilman Carter and carried with the following votes: Councilman Quibell -Aye Councilman Carter- Aye Councilman Lievsay - ABSENT Councilman Edmondson -Aye Councilman Fowler- Aye Councilman Culpepper - Aye Mayor Ross- Aye ADOPT RESOLUTION 17- Councilman Edmondson moved to adopt Resolution No. 17-2016 2016- SECOND approving the Second Amendment to the On Call Electrical AMENDMENT TO ON Services Agreement with Superior Electrical Construction, Inc. CALL ELECTRICAL dated July 14, 2015. Motion seconded by Councilman Carter and SERVICES AGREEMENT carried with the following votes: Councilman Quibell -Aye Councilman Carter- Aye Councilman Lievsay -ABSENT Councilman Edmondson- Aye Councilman Fowler- Aye Councilman Culpepper - Aye Mayor Ross - Aye ADOPT RESOLUTION 18- Councilman Edmondson moved to adopt Resolution No. 18-2016 2016- DEVELOPMENT approving a Development and Maintenance Agreement with AND MAINTENANCE Gaming Partners International for the stormwater infiltration basins AGREEMENT for an expansion project located at 2925 NW Highway 7, Blue Springs, Missouri. Motion seconded by Councilman Carter and carried with the following votes: May 16, 2016 City Council Meeting Page 2 Councilman Quibell- Aye Councilman Carter- Aye Councilman Lievsay - ABSENT Councilman Edmondson -Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross -Aye ADOPT RESOLUTION 19- Councilman Edmondson moved to adopt Resolution No. 19-2016 2016-AGREEMENTFOR approving a contract with Black & Veatch Management Consulting, WATER AND SEWER LLC in the amount of $80,700 for a consulting services agreement RATE STUDY to perform a cost of service study for water and sewer. Motion seconded by Councilman Carter and carried with the following votes: Councilman Quibell -Aye Councilman Carter- Aye Councilman Lievsay -ABSENT Councilman Edmondson -Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross -Aye APPROVE Councilman Edmondson moved to approve the following APPOINTMENTS TO appointments to the Downtown Review Board: DOWNTOWN REVIEW BOARD Joe Haney: Planning Commission Representative James Wallace: Planning Commission Representative Jacqueline Fairbanks: Alternate Planning Commission Representative Motion seconded by Councilman Carter and carried with the following votes: Councilman Quibell -Aye Councilman Carter- Aye Councilman Lievsay- ABSENT Councilman Edmondson- Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross- Aye PUBLIC HEARING - Mayor Ross opened the Public Hearing on the Vacation of a VACATION OF stormwater drainage easement in the Parkway Villas Development STORMWATER at 6:03 p.m. This public hearing was continued from the May 2, DRAINAGE EASEMENT - 2016 Council meeting. The minutes of the public hearing were PARKWAY VILLAS (VAC- recorded by a certified court reporter. City Clerk Sheryl Morgan 03-16-5235) entered one exhibit exhibits into the record for the public hearing. STAFF REPORT Community Development Director Scott Allen stated the applicant, Roy C. Allen Ill of World Land Investments, LLC is requesting a vacation of a stormwater drainage easement located generally at the northwest corner of SE Adams Dairy Parkway and SE Moreland School Road in the Parkway Villas development. The applicant has met the requirements of Section 403.090 of the Code. The Planning Commission recommended approval of the request with a vote of 10-0. 2 May 16, 2016 City Council Meeting Page 3 The Mayor hearing no comments for or against, closed the public hearings at 6:05p.m. INTRODUCTION AND 1sT Councilman Fowler introduced Bill No. 4423 approving the vacation READING- BILL NO. 4423 of a stormwater drainage easement located generally at the APPROVING THE northwest corner of SE Adams Dairy Parkway and SE Moreland VACATION OF A School Road in the Parkway Villas development. City Clerk Sheryl STORMWATER Morgan made the first reading of Bill No. 4423 by title; copies of the DRAINAGE EASEMENT IN PARKWAY VILLAS (VAC- proposed Bill having previously been made available to the public. 03-16-5235) Councilman Fowler moved to approve Bill No. 4423 upon its first reading and proceed with the second reading . Ms. Morgan made the second reading of Bill No. 4423 by title. 4423 Councilman Quibell moved to adopt Bill No. 4423 upon its second reading and give it ORDINANCE NO. 4596, with a copy attached hereto and made a part of the minutes. INTRODUCTION AND 1sT Councilman Edmondson introduced Bill No. 4424 approving the READING -BILL NO. Final Plat for Parkway Villas. City Clerk Sheryl Morgan made the 4424 APPROVING FINAL first reading of Bill No. 4424, by title; copies of the proposed Bill PLAT FOR PARKWAY having previously been made available to the public. VILLAS (PF-02-16-5200) Councilman Fowler moved to approve Bill No. 4424 upon its first reading and proceed with the second reading. Motion seconded by Councilman Carter and carried unanimously. 2"d READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4424, by title. 4424 Councilman Quibell moved to adopt Bill No. 4424, upon its second reading and give it ORDINANCE NO. 4597, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilman Edmondson and carried with the following vote: Councilman Fowler- Aye Councilman Culpepper- Aye Councilman Carter- Aye Councilman Quibell -Aye Councilman Edmondson - Aye Councilman Lievsay -Aye Mayor Ross -Aye ADOPT RESOLUTION 20- Councilman Carter moved to adopt Resolution No. 20-2016 2016- DEVELOPMENT approving a Stormwater Development and Maintenance Agreement 3 May 16, 2016 City Council Meeting Page 4 AND MAINTENANCE with Parkway Villas, LLC. Motion seconded by Councilman AGREEMENT Edmondson. Staff confirmed Councilman Fowler's understanding that this Maintenance Agreement was specific to stormwater management and not streets. After discussion, the motion carried unanimously. INTRODUCTION AND 1sT Councilman Edmondson introduced Bill No. 4425 adding a new READING -BILL NO. 4425 Section 220.700 to Article X, Chapter 220 of the Code of AMENDING THE CODE Ordinances to prohibit trespass on a school bus. City Clerk Sheryl OF ORDINANCES TO Morgan made first reading of Bill No. 4425, by title; copies of the PROHIBIT TRESPASS ON proposed Bill having previously been made available to the public. A SCHOOL BUS Councilman Fowler moved to approve Bill No. 4425 upon its first reading and proceed with the second reading . Motion seconded by Councilman Carter. COUNCIL DISCUSSION Staff confirmed that this Ordinance relates to all school buses operating within the City of Blue Springs. Chief McCoy stated that in addition to the letter of support from the Blue Springs School District, the Lee's Summit and Grain Valley School Districts, as well as Plaza Heights Christian Academy, are in support of the Bill. After Council discussion, the motion carried unanimously. 2"d READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4425 by title. 4425 Councilman Quibell moved to adopt Bill No. 4425 upon its second reading and give it ORDINANCE NO. 4598, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilman Edmondson and carried with the following vote: Councilman Edmondson -Aye Councilman Lievsay -Aye Councilman Culpepper- Aye Councilman Fowler- Aye Councilman Quibell -Aye Councilman Carter- Aye Mayor Ross- Aye INTRODUCTION AND 1sT Councilman Edmondson introduced Bill No. 4426 adding a new READING - BILL NO. 4426 Section 220.810 to Article X, Chapter 220 of the Code of AMENDING THE CODE Ordinances to prohibit misuse of the 911 emergency telephone OF ORDINANCES TO system. City Clerk Sheryl Morgan made first reading of Bill No. PROHIBIT MISUSE OF 911 4426, by title; copies of the proposed Bill having previously been EMERGENCY TELEPHONE SYSTEM made available to the public. Councilman Fowler moved to approve Bill No. 4426 upon its first reading and proceed with the second reading. Motion seconded by Councilman Carter. COUNCIL DISCUSSION Councilman Quibell gave an example of a call he made to 911 approximately 30 years ago and asked whether this would fall under the new Ordinance. Chief McCoy stated this would only address situations where someone intentionally calls 911 in an attempt to divert resources or cause problems. 4 May 16, 2016 City Council Meeting Page 5 After Council discussion, the motion carried unanimously. 2"d READING - BILL NO. Motion seconded by Councilman Culpepper and carried with the following vote : Councilman Culpepper- Aye Councilman Fowler- Aye Councilman Qui bell -Aye Councilman Carter- Aye Councilman Lievsay- Aye Councilman Edmondson -Aye Mayor Ross -Aye MAYORAL Mayor Ross complimented Chief McCoy and the Police Department ANNOUNCEMENTS staff on the 2015 Annual Report. Thoughts to Ponder: "When your work speaks for itself, don't interrupt." (Henry Kaiser) VISITORS Tony Wrisinger of the Greater Kansas City Football Coaches Association stated the 25th Annual Papa John's Kansas vs . Missouri High School Football All Star Game will be held on June 16th at Peve Stadium. Mr. Wrisinger requested $1 ,000 from the City for support for this game. Mr. Wrisinger said the event draws about 5,000 people to Blue Springs. Councilman Carter moved to appropriate $1,000.00 for this initiative. Motion seconded by Councilman Quibell and carried unanimously. ADJOURNMENT At 6:21 p.m. there was no further business to come before the Council; Councilman Carter moved the meeting be adjourned.
