CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING December 5, 2016 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, December 5, 2016, 6 :00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. COUNCILMEN IN Jeff Qui bell Dale Carter ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were Deputy City Administrator Adam Norris, Assistant City Administrator Christine Cates, interim City Attorney Bob McDonald, and City Clerk Sheryl Morgan. CALL MEETING Mayor Carson Ross called the City Council meeting to order and led TO ORDER in the Pledge of Allegiance. APPROVE CITY COUNCIL Councilman Edmondson moved to approve the minutes of the MINUTES November 21 , 2016 meeting of the City Council meeting. Motion seconded by Councilman Carter and carried with the following votes: Councilman Qui bell - Aye Councilman Carter- Aye Councilman Lievsay- Aye Councilman Edmondson- Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross - Aye RESOLUTION 73-2016 - Councilman Edmondson moved to adopt Resolution No. 73-2016 SEWER approving a contract with lnsituform Technologies USA, LLC for REHABILITATION AND citywide sewer rehabilitation and emergency storm pipe repair. EMERGENCY STORM Motion seconded by Councilman Carter and carried with the PIPE MAINTENANCE following votes: Councilman Quibell -Aye Councilman Carter- Aye Councilman Lievsay- Aye Councilman Edmondson- Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross - Aye CHANGE TO LIQUOR Councilman Edmondson moved to approve adding Sunday retail LICENSE FOR "THE DIVE selling of intoxicating liquors by the drink, on the premises; or in BAR, LLC" original package for consumption on or off premises to the current liquor license for The Dive Bar LLC, located at 1325 SW US Highway 40, Blue Springs, MO 64015. Motion seconded by Councilman Carter and carried with the following votes: Councilman Quibell -Aye Councilman Carter- Aye Councilman Lievsay- Aye Councilman Edmondson -Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross -Aye December 5, 2016 City Council Meeting Page 2 CHANGE TO LIQUOR Councilman Edmondson moved to approve changing the Doing LICENSE FOR "DIRTY Business As (DBA) name on the current liquor license from "Dirty HARRY'S PUB LLC Harry's Pub LLC Location 2" to "Confetti's" located at 1200 NW LOCATION 2" Highway 7, Blue Springs, MO 64014. Motion seconded by Councilman Carter and carried with the following votes: Councilman Qui bell -Aye Councilman Carter- Aye Councilman Lievsay- Aye Councilman Edmondson - Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross - Aye APPROVE Councilman Edmondson moved to approve the appointments of APPOINTMENTS OF Nafkot Seife and Mark Walker as student representatives to the STUDENT Human Relations Commission for a one-year term . Motion REPRESENTATIVES TO seconded by Councilman Carter and carried with the following votes: THE HUMAN RELATIONS COMMISSION Councilman Qui bell - Aye Councilman Carter- Aye Councilman Lievsay- Aye Councilman Edmondson - Aye Councilman Fowler- Aye Councilman Culpepper- Aye Mayor Ross -Aye PUBLIC HEARING - Mayor Ross opened the Public Hearing for consideration to approve VACATION OF SANITARY a vacation of an existing 15-foot sanitary sewer easement located SEWER EASEMENT- generally at the Southwest corner of NW Woods Chapel Road and QUIKTRIP STORE NO. NW South Outer Road at 6:03 p.m. The minutes of the public 180R (VAC-11-16-5570) hearing was recorded by a certified court reporter. City Clerk Sheryl Morgan entered one exhibit into the record for the public hearing. STAFF REPORT Scott Allen, Director of Community Development, stated the Applicant, QuikTrip Corporation, has met the requirements for the request, and the Planning Commission unanimously recommended approval on November 28, 2016. The Mayor hearing no further comments for or against, closed the public hearing at 6:05p.m. INTRODUCTION AND 15 T Councilman Edmondson introduced Bill No. 4461 approving the READING - BILL NO. vacation of an existing 15-foot sanitary sewer easement located 4461- VACATION OF generally at the southern boundary of Lot 3 and the northern SANITARY SEWER boundary of Lot 2 for the Oaks and Woods Chapel 2nd Plat, Lots 1- EASEMENT- QUIKTRIP 3 and Tract A. City Clerk Sheryl Morgan made the first reading of STORE NO. 180R (VAC- 11-16-5570) Bill No. 4461 by title; copies of the proposed Bill having previously been made available to the public. Councilman Fowler moved to approve Bill No. 4461 upon its first reading and proceed with the second reading. Motion seconded by Councilman Carter and carried unanimously. 2No READING- BILL NO. Ms. Morgan made the second reading of Bill No. 4461 by title. 4461 Councilman Quibell moved to adopt Bill No. 4461 upon its second December 5, 2016 City Council Meeting Page 3 reading and give it ORDINANCE NO. 4634, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilman Culpepper and carried with the following vote: Councilman Lievsay- Aye Councilman Edmondson - Aye Councilman Fowler- Aye Councilman Culpepper- Aye Councilman Carter- Aye Councilman Qui bell- Aye Mayor Ross- Aye INTRODUCTION AND 1sr Councilman Edmondson introduced Bill No. 4462 approving the READING - BILL NO. Final Plat for Amended Oaks at Woods Chapel 2nd Plat, Lots 2-3 A 4462 - FINAL PLAT FOR Replat of Lots 2 and 3, Oaks at Woods Chapel 2nd Plat, Lots 1-3 and AMENDED OAKS AT Tract A. City Clerk Sheryl Morgan made the first reading of Bill No. WOODS CHAPEL 2ND PLAT (PF-11-16-5564) 4462 by title; copies of the proposed Bill having previously been made available to the public. Councilman Fowler moved to approve Bill No. 4462 upon its first reading and proceed with the second reading . Motion seconded by Councilman Carter and carried unanimously. 2ND READING- BILL NO. Ms. Morgan made the second reading of Bill No. 4462 by title. 4462 Councilman Quibell moved to adopt Bill No. 4462 upon its second reading and give it ORDINANCE NO. 4635, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilman Culpepper and carried with the following vote: Councilman Fowler- Aye Councilman Culpepper- Aye Councilman Carter- Aye Councilman Quibell- Aye Councilman Edmondson- Aye Councilman Lievsay- Aye Mayor Ross -Aye RESOLUTION 74-2016- Councilman Edmondson moved to adopt Resolution No. 74-2016 DEVELOPMENT AND approving a Development and Maintenance Agreement with MAINTENANCE QuikTrip Corporation for the private maintenance of stormwater AGREEMENT WITH facilities on the lot for Store 180R on the southwest corner of NW QUIKTRIP CORPORATION Woods Chapel Road and South Outer Road, Lot 3 of the Amended Oaks at Woods Chapel 2nd Plat. Motion seconded by Councilman Culpepper and carried unanimously. PRESENTATION- Gail Porter, GIS Coordinator, and Tina Dale, Business Services CITIZEN ACCESS Coordinator, presented the City's new Citizen Access Portal (CAP) PORTAL for online permitting and business licensing. The CAP system allows users to search for business licenses, permits, and planning applications. Although the new system does not yet have the capacity to accept full building plans, applicants can submit plans for smaller-scale projects (e.g., deck replacement, driveways, etc.) in a ledger-size or smaller PDF with their online applications. PUBLIC HEARING - Mayor Ross opened the Public Hearing on the Amended PR-O AMENDED PR-O Concept Plan for Eagles Ridge Estates PR-O Tracts 1 thru 4. At the CONCEPT PLAN EAGLES request of the applicant, David Ward, the public hearing will be December 5, 2016 City Council Meeting Page 4 RIDGE PR-O (PROC-1 0- continued to the December 19, 2016 Council meeting. A motion to 16-5526) continue this public hearing is in order. MOTION TO CONTINUE Councilman Carter moved to continue the public hearing on the (PROC-1 0-16-5526) Amended PR-O Concept Plan for Eagles Ridge Estates PR-O Tracts 1 thru 4 to the December 19, 2016 Council meeting. Motion seconded by Councilman Quibell and carried unanimously. MAYORAL Mayor Ross expressed sympathy to the Eric Johnson family for the ANNOUNCEMENTS loss of Eric's father. Tomorrow night at 5:30 at City Hall is the Mayor's Christmas Tree Lighting Ceremony. Thoughts to Ponder: "Coming together is a beginning; keeping together is progress; working together is success.
