MINUTES OF COUNCIL MEETING
June 19, 2017
A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, June
19, 2017, 6:00p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100
Smith Street with Mayor Carson Ross presiding.

CALL MEETING Mayor Ross called the City Council meeting to order and led in the
TO ORDER Pledge of Allegiance.
APPROVE CITY COUNCIL Councilman Culpepper moved to approve the Minutes of the June
MINUTES 5, 2017 meeting of the City Council meeting. Motion seconded by
Councilman Carter and carried with the following votes:

Councilman Lievsay - ABSENT Councilman Edmondson -Aye
Councilman Fowler- Aye Councilman Culpepper- Aye

RESOLUTION 44-2017- Councilman Culpepper moved to adopt Resolution No. 44-2017
PAYMENT OF authorizing the payment of $1,526,252.25 to Midwest Public Risk for
INSURANCE PREMIUMS the City's property, casualty, liability and workers' compensation
insurance premiums for the 2017-18 plan year. Motion seconded by
Councilman Carter and carried with the following votes:

APPROVE NEW LIQUOR Councilman Culpepper moved to approve a new liquor license for C
LICENSE- C AND D & D Indian Restaurant, Inc. at 1214 NW 7 Highway Blue Springs,
INDIAN RESTAURANT MO 64014, to sell beer and wine only by the drink, or in the original
package (weekdays). C & D Indian Restaurant, Inc. is also renewing
its license for the 2017-2018 license year. Motion seconded by
Councilman Carter and carried with the following votes:

APPROVE 2017-18 Councilman Culpepper moved to approve liquor license renewals for
LIQUOR LICENSE the 2017-18 license year. Motion seconded by Councilman Carter
RENEWALS and carried with the following votes:

RESOLUTION 45-2017 - Councilman Culpepper moved to adopt Resolution No. 45-2017
FALL FUN FESTIVAL designating Friday, September 15, 2017, through Sunday,
DATES September 17, 2017 as the dates for the 2017 Blue Springs Fall Fun
Festival. Motion seconded by Councilman Carter and carried with
the following votes:

APPROVE NEW LIQUOR Councilman Culpepper moved to approve a new liquor license for
LICENSE - RAM 11 LLC Ram 11 LLC dba Quick Mart at 1500 SW US Highway 40 Blue
dba QUICK MART Springs, MO 64015, to sell intoxicating liquors in the original
package, for consumption off premises, to include Sunday selling of
intoxicating liquors by the drink, on the premises; or in original
package for consumption on or off premises. Motion seconded by
Councilman Carter and carried with the following votes:

RESOLUTION 46-2017- Councilman Culpepper moved to adopt Resolution No. 46-2017
FUNDING AGREEMENT approving a Funding Agreement between the City and RGH Land ,
WITH RGH LAND, LLC LLC (the Developer), the Developer of the location at 2401-2701 NW
South Outer Road. Motion seconded by Councilman Carter and
carried with the following votes:

PUBLIC HEARING - Mayor Ross opened the Public Hearing to consider an application
REZONING FROM AG TO by Sallee Real Estate Investments to rezone The Gardens of
TF (RZ-05-17 -5836) Colonial Highlands from "AG" (County Agriculture) to "TF" (Two
Family) at 6:02 p.m. The minutes of the public hearing were
recorded by a certified court reporter. City Clerk Sheryl Morgan
entered one exhibit into the record for public hearing.

STAFF REPORT Community Development Director Scott Allen outlined the proposed
rezoning . Mr. Allen stated the Planning Commission recommended
approval with a 9-0 on June 12, 2017. Mr. Allen stated this is the
original zoning on the property.
APPLICANT Greg Musil, attorney for the applicant, Sallee Real Estate
Investments presented the proposed use of the property and
answered questions presented by Council.
Mayor Ross hearing no comments for or against, closed the public
hearing at 6:14p.m.
INTRODUCTION AND 1sT Councilman Edmondson introduced Bill No. 4496 rezoning The
READING -BILL NO. Gardens of Colonial Highlands from "AG" (County Agriculture) to
4496 'TF" (Two Family). City Clerk Sheryl Morgan made the first reading
(RZ-05-17-5836) of Bill No. 4496 by title; copies of the proposed Bill having previously
been made available to the public.
Councilman Fowler moved to approved Bill No. 4496 upon its first
reading and proceed with the second reading . Motion seconded by
Councilman Edmondson and carried unanimously.
2"d READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4496 by title.
4496 Councilman Carter moved to adopt Bill No. 4496 upon its second
reading and give it ORDINANCE NO. 4665, with a copy attached
hereto and made a part of the minutes. Motion seconded by
Councilman Culpepper and carried with the following vote:

INTRODUCTION AND 1sT Councilman Edmondson introduced Bill No. 4497 approving the
READING - BILL NO. Final Plat for Sports Luxury Auto - 1st Plat (PF-05-17 -5834) located
4497 (PF-05-17-5834) at 1928 NW Woods Chapel Road. City Clerk Sheryl Morgan made
the first reading of Bill No. 4497 by title; copies of the proposed Bill
having previously been made available to the public.
Councilman Fowler moved to approved Bill No. 4497 upon its first
reading and proceed with the second reading. Motion seconded by
Councilman Carter and carried unanimously.

4497 Councilman Carter moved to adopt Bill No. 4497 upon its second
reading and give it ORDINANCE NO. 4666, with a copy attached

INTRODUCTION AND 1sT Councilman Edmondson introduced Bill No. 4498 amending
READING - BILL NO. Sections 125.080 and 125.090 of the City Code to change the
4498 retirement age of Municipal Judges from 70 to 75. City Clerk Sheryl
Morgan made the first reading of Bill No. 4498 by title; copies of the
proposed Bill having previously been made available to the public.
Councilman Fowler moved to approved Bill No. 4498 upon its first
reading and proceed with the second reading. Motion seconded by
Councilman Kaylor and carried unanimously.
2nd READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4498 by title.
4498 Councilman Carter moved to adopt Bill No. 4498 upon its second
reading and give it ORDINANCE NO. 4667, with a copy attached
hereto and made a part of the minutes. Motion seconded by

INTRODUCTION AND 1sT Councilman Edmondson introduced Bill No. 4499 amending
READING - BILL NO. Sections 115.301 and 115.302 of the City Code to clarify the type of
4499 contracts, which may not exceed $50,000 annually, that the City
Administrator can enter into, and to clarify the policies that the City
Administrator is authorized to establish. City Clerk Sheryl Morgan
made the first reading of Bill No. 4499 by title; copies of the proposed
Bill having previously been made available to the public.
Councilman Fowler moved to approved Bill No. 4499 upon its first
reading and proceed with the second reading . Motion seconded by
Councilman Culpepper and carried unanimously.

exemption pursuant to Chapter 353 of the Revised Statutes of
Missouri. City Clerk Sheryl Morgan made the first reading of Bill No.
4500 by title; copies of the proposed Bill having previously been

Councilman Fowler moved to approved Bill No. 4500 upon its first
reading and proceed with the second reading. Motion seconded by
Councilman Culpepper and carried unanimously.

MAYORAL Mayor Ross expressed his appreciation for the thoughts and prayers

Councilman Culpepper announced that Main Street in the downtown
area will be closed from 11 :00 a.m. - 7:00 p.m. for the Corks and
Canvas event.
ADJOURNMENT At 6:22 p.m., Councilman Carter moved for the Council go into
closed session pursuant to Section 610.021, subparagraphs (1) and
(2), Revised Statutes of Missouri, for the purpose of privileged
communications between a governmental body or its representative
and legal counsel including litigation and real estate, and that any
minutes, documents and other records discussed or taken during
the closed session remain closed, and that this body stand
adjourned at the completion of such session.
A work session will be held immediately after the completion of the
closed session for the presentation of public official liability training.
