CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING APRIL 2, 2018 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, April 2, 2018, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. COUNCILMEN IN Jerry Kaylor Dale Carter ATTENDANCE Chris Lievsay Kent Edmondson Ron Fowler Susan Culpepper Also present were City Administrator Eric Johnson, Assistant City Administrator Christine Cates, City Attorney Jacqueline Sommer, and City Clerk Sheryl Morgan. CALL MEETING Mayor Ross called the City Council meeting to order and led in the TO ORDER Pledge of Allegiance. Mayor Ross stated that Councilman Kaylor wanted to pull item 3c - Change Order to contract with Turner Construction from the Consent Agenda for separation consideration. APPROVE CITY COUNCIL Councilman Culpepper moved to approve the Minutes of the March MINUTES 19, 2018 City Council meeting. Motion seconded by Councilman Carter and carried with the following votes: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye APPROVE FIREWORKS Councilman Culpepper moved to approve the issuance of 15 PERMITS FOR 2018 fireworks permits for the 2018 license year, of the 18 permits authorized, and to allow an additional three permits if received prior to June 1, 2018. Motion seconded by Councilman Carter and carried with the following votes: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye RESOLUTION NO. 23-2018 Councilman Culpepper moved to adopt Resolution No. 23-2018 - RATIFYING AN ratifying the City Administrator's authority to enter into a contract on AGREEMENT WITH March 9, 2018 in the amount of $185,349.71 with KCP&L Greater KCP&L RELATED TO CITY Missouri Operations Company for relocation of power lines on the HALL RENOVATION City Hall campus as part of the renovation project. Motion seconded by Councilman Carter and carried the following votes: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye April 2, 2018 City Council Meeting Page2 Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye LIQUOR LICENSE - Councilman Culpepper moved to approve a new liquor license for JOSEMA RESTAURANT Josema Restaurant LLC dba Casa Mexico 3 located at 1414 NW 7 LLC Highway, to sell retail intoxication liquors by the drink for consumption on premises, Restaurant-Bar/Lounge-Bar, as well as Sunday retail selling of intoxication liquors by the drink, on the premises; or in original package for consumption on or off premises. Motion seconded by Councilman Carter and carried with the following votes: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye RESOLUTION NO. 22-2018 Councilman Kaylor advised he will be abstaining from the vote on - CHANGE ORDER TO the Change Order Contract with Turner Construction as his son-in- CONTRACT WITH law is employed by Turner Construction. TURNER CONSTRUCTION Councilman Culpepper moved to adopt Resolution No. 22-2018 approving amendment No. 1 to Contract No. 2017-125-1R approved June 5, 2017, with Turner Construction Company in the amount of $5,246,700 for the Guaranteed Maximum Price for the renovation and construction of the City Hall Complex (BF-36). This amendment brings the total contract amount to $5,266,700. Motion seconded by Councilman Carter and carried with the following votes: Councilman Lievsay - No Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Councilman Carter - Aye Councilman Kaylor - Abstain Mayor Ross - Aye PRESENTATION - HUMAN Kynette Campbell, Chainman of the Human Relations Commission, RELATIONS COMMISSION presented an update on accomplishments and future goals. A copy of the PowerPoint presentation presented to Council is attached to these Minutes. INTRODUCTION AND 1ST Councilman Culpepper introduced Bill No. 4562 approving the READING - BILL NO. 4562 Mayor's recommendation to appoint Stephanie Graham-Taormina - APPOINTING as Municipal Court Judge to complete the term vacated by John MUNICIPAL COURT Jack (through June 30, 2019), and Donald Lograsso as Presiding JUDGES Municipal Judge. Compensation for the Municipal Court Judge shall remain at $25,000 annually, and the Presiding Municipal Judge shall remain at $28,000 annually. City Clerk Sheryl Morgan made the first reading of Bill No. 4562 by title; copies of the proposed Bill having previously been made available to the public. 2 April 2, 2018 City Council Meeting Page 3 Councilman Fowler moved to approve Bill No. 4562 upon its first reading and proceed with the second reading. Motion seconded by Councilman Edmondson and, after Council discussion, carried unanimously. 2ND READING - BILL NO. Ms. Morgan made the second reading of Bill No. 4562 by title. 4562 Councilman Carter moved to adopt Bill No. 4562 upon its second reading and give it ORDINANCE NO. 4732, with a copy attached hereto and made a part of the minutes. Motion seconded by Councilman Kaylor and carried with the following vote: Councilman Fowler - Aye Councilman Culpepper - Aye Councilman Carter - Aye Councilman Kaylor - Aye Councilman Edmondson - Aye Councilman Lievsay - Aye Mayor Ross - Aye SWEARING IN OF JUDGES City Clerk Sheryl Morgan swore in Municipal Court Judge Stephanie Graham-Taormina, and Presiding Municipal Judge Don Lograsso. MAYORAL Tomorrow is election day and there are several items on the ballot, ANNOUNCEMENTS including the Use Tax and some fire district issues. (Plato) VISITORS Robert Taylor addressed Council requesting an amendment to the City Code relating to above-ground fuel tanks. ADJOURNMENT At 6:32 p.m., there was no further business to come before the Council, Councilman Carter the meeting be adjourned. Motion seconded by Councilman Fowler and carried unanimously.
