CITY OF BLUE SPRINGS, MISSOURI MINUTES OF COUNCIL MEETING DECEMBER 17, 2018 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, December 17, 2018, 6:00 p.m. in the Council Chambers of the Howard L. Brown Public Safety Building, 1100 Smith Street with Mayor Carson Ross presiding. CALL MEETING Mayor Ross called the City Council meeting to order at 6:00 p.m. TO ORDER CONSENT AGENDA Councilman Culpepper moved to approve the Consent Agenda and the motion was seconded by Councilman Carter. • Minutes of the December 3, 2018 City Council meeting • Resolution No. 104-2018 approving a "Lease of Premises" between the City of Blue Springs and the Missouri Highways and Transportation Commission (MoDOT) for lease of ground surface, at no cost to the City, for the display of art titled "Jet Stream" on the northeast corner of the intersection of Interstate 70 and Missouri Highway 7 as requested by the Public Art Commission • Resolution No.105-2018 approving a Change Order in the amount of $2,400.00 with Capital Electric Line Builders, Inc. for traffic signal & street light maintenance and repair, Contract # 2015-153.2A, November 24, 2017 to November 23, 2018 term, to cover the additional costs incurred due to the final repair made under the contract • Resolution No. 106-2018 approving an AmendmenUChange Order in the amount of $15,000.00 with Superior Electrical Construction, Inc. for on call electrical services Contract # 2015- 096.1A, July 13, 2018 through July 12, 2019 term. This amendment exceeds 10% of the original $25,000.00 contract • Resolution No. 107-2018 approving Task Order #1 to a contract with Bliss Associates, LLC in the amount of $102,500 for appraisal and acquisition services to obtain construction easements along NW South Outer Road to allow the placement of a new water main The Consent Agenda was approved with the following vote: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye December 17, 2018 City Council Minutes Page2 INTRODUCTION AND 1sr Councilman Culpepper introduced Bill No. 4623 approving a Contract READING - BILL NO. 4623 for Services with Robert K. City Clerk Sheryl Morgan made the first ATTORNEY reading of Bill No. 4623 by title; copies of the proposed Bill having previously been made available to the public. Councilman Fowler moved to approve Bill No. 4623 upon its first reading and proceed with the second reading. Councilman Fowler moved to approve Bill No. 4624 upon its first reading and proceed with the second reading. City BOBCAT Clerk Sheryl Morgan made the first reading of Bill No. 4625 by title; copies of the proposed Bill having previously been made available to the public. Councilman Fowler moved to approve Bill No. 4625 upon its first reading and proceed with the second reading. Motion seconded by Councilman Culpepper and carried with the following vote: Councilman Kaylor - Aye Councilman Carter - Aye Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Mayor Ross - Aye PRESENTATION - 2018 Jeanie Lauer and Bryan Pratt, Co-Chairs of the 2018 Charter Review CHARTER REVIEW Commission. presented the Commission's findings, recommendations COMMISSION for amendment, as well as items for Council consideration. A copy of the PowerPoint presentation is attached to these Minutes and incorporated herein. Council directed the City Attorney to draft ballot language for the amendments proposed by the Charter Review Commission for the April 2, 2019 election, to be presented to Council at the January 7, 2019 Council meeting for approval. MOTION TO ADD Councilman Culpepper moved to direct the City Attorney to draft AMENDMENT TO additional ballot language for the April 2, 2019 election to amend CHARTER SECTION 3.12D Charter Section 3.12.D-Voting to reflect the City's current process for -VOTING taking votes during Council meetings. Motion seconded by Councilman Carter and carried with the following vote: Councilman Lievsay - Aye Councilman Edmondson - Aye Councilman Fowler - Aye Councilman Culpepper - Aye Councilman Carter - Aye Councilman Kaylor - Aye Mayor Ross - Aye MAYORAL Mayor Ross thanked Councilmen Kent Edmondson and Susan ANNOUNCEMENTS Culpepper for their years of service and presented Councilman Edmondson with his 10-year service award pin, and Councilman Culpepper with her 5-year service award pin. December 17, 2018 City Council Minutes Page 4 Mayor Ross wished everyone a Merry Christmas and a happy New Year. "If you can't explain it simply, you don't understand it well enough." (Albert Einstein) PUBLIC Scott Casey address Council and requested the City consider adding language to the Charter and Code to prohibit discrimination of all types. CLOSED SESSION At 6:38 p.m. , Councilman Carter moved for the Council go into closed session pursuant to Section 610.021 , subparagraph (1), Revised Statutes of Missouri, for the purpose of privileged communications between a governmental body or its representative and legal counsel relating to potential litigation, and that any minutes, documents and other records discussed or taken during the closed session remain closed, and that this body stand adjourned at the completion of such session.
